The State and Local Government shall be collectively referred to as "the parties" hereinafter. WITNESSETH WHEREAS, the parties executed a contract on October 13, 2020, to effectuate their agreement to reconstruct Meandering Road; and, WHEREAS, the parties executed Amendment #1 to the contract on May 2, 2024 to change the project scope to include utilities phase work and to include Federal funds for CSJ 0902-90-172; and, WHEREAS, it has become necessary to amend that contract in order to increase Federal funds for CSJ 0902-90-172 due to inflation of construction costs; NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties, the parties do agree as follows: AGREEMENT The parties agree that the Agreement is amended as follows: 1. Attachment A-1, Resolution, Ordinance, or Commissioners Court Order, is supplemented by adding Attachment A-2, Resolution, Ordinance, or Commissioners Court Order. Funds increased for all phases of the project due to additional federal funds. 3. Attachment B, Location Map Showing Project, is deleted in its entirety and replaced with Attachment B-2, Location Map Showing Project, which is attached to and made part of this Amendment. The project map is revised to show all roadways due to being omitted from previous submittal. 4. Attachment C-1, Project Budget, is deleted in its entirety and replaced with Attachment G2, Project Budget, which is attached to and made a part of this Amendment. The total estimated cost of the Project increased by $ 5.020.963.00, from $ 22.207.642.00 to $ 27.228.605.00, due to additional Federal funding approved for CSJ 0902-90-172. The additional Federal funds were requested and approved due to inflation. The estimated costs for environmental, engineering, ROW, utilities, and construction have increased since May 2024. All other provisions of the original contract are unchanged and remain in full force and effect.
