AGENCY REPRESENTATIONS. The Agency represents and warrants to Vendor that it is a
subrecipient of the Housing and Urban Development (HUD}/HOPWA, Texas Veterans Commission
{NC)/VETERANS, Texas Department of Housing and Community Affairs (TDHCA)/ Comprehensive
Energy Assistance Program (CEAP) and Community Services Block Grant (CSBGj, Young Energy
Donation Fund, Fort Worth Water DepartmentJN/aier ponation Fund orother assistance programs
and as such is authorized and has received funding from the HOPWA, VETERANS, CSBG, Young
Energy Donation Fund, Water ponation Fund, CEAP or othe� assistance programs to provide bill
payment assistance service for eligible low-income households.
VENDOR'S REPRESENTATIONS The Vendor represents and warrants that itwill apply any payments
received from Agencyto the account of the customer that the Agency has determined to be eligible
under the guidelines and wch is a"Certifiied Custame�".
VENDOR'S PERFORMANCE. Vendor shall, with reference to a Certified Customer:
� Extend the applicant's utility service for up to 45 business days while the Agency
determines whether the applicant is eligible pursuant to the guidelines.
• Upon accepting pledge from Agency for Certified Customer, continue or restore utility
service to Certified CustQmer with no increases in cl�arges, service charges or other
charges affecting the totat cost of the bill, except as allowed by the stated tariff cost
registered with the Public Utility Commission "PUC" and/ar Texas Railroad Commission.
� In the event the full past due balance is not paid by the Agency, the Certified Customer must pay
the remaining balance on or before the disconnett date stated in the customer's Disconnect
Notice required by PUC regulations to avaid disconnection or be eligible far reconnectian. N'othing
in this Vendor Agreement requires the Vendor to reconnect the custamer upon receipt of a pledge
that does not cover the full past due balance or if the customer has already been disconnected by
the time the pledge is received by the Vendor.
• Invoice the Certified Customer in accordance with Vendor's normal billing practices.
• Uport verbal or written request from the Agency, provide at no cost to the Agency the Certified
Customer's billing and usage history for the previaus twelve (12) months, or available history plus
monthly sstimates if less than twelve (12) months of billing history and usage is available. Vendor
will transmit such billing history via electronic mai! or facsimiEe as soon as possible, but no later
than forty-eigMt �48) hours following the request.
• Work with Agency and Certified Customer to explore the feasibility of offering flexible
payment arrangements that may inc[ude, without limitatian, waiving security deposits,
reconnect fees, application fees, and all other fiees whenever possible.
• Not discrirr�inate against Certified Customer in price or services, including the availability of
tleferred payment plans, level or average payment plans, discount, budget, advante payment or
other credit plans.
• Not refuse to provide utility service or otherwise discriminate in the marketing and provision oF
utility service to any Ceetified Customer because of race, creed, color, national origin, ancestry,
sex, marital status, lawful source of income, fevel of income, disability, financial status, locatian
of customer in an economically distressed geographic area, or qualification for [ow-income or
energy-efficiency services.
+ Allow the Agency forty-five (45) days from the date of the pledge to forward payment to the
Vendor. Vendor agrees not to consider the portion of the Certified Custome�'s account to be paid
by the Agency delinquent if said payment is received within the above-mentioned forty-�ve �45)
day period, and Vendor is provided with a verbal or signed pledge from the Agency within forty-
five (45) days of identifying a Certified Customer.
• Not interrupt service i#Certified Customer is eligibie under PUC regufations, or other state
agency regulations (as applicable), and enters into an agreement with the Vendor
concerning h�w the Certified Customer will pay the balance owed Vendar and the
Certified Custamer is meeting the obligation under such agreement.
• If the Agency has paid for an initial deposit or simziar ref�ndable instrument, upon the
termination of service to #he Certified Customer, the Vendor shall return funds including
interest (after any balance owed) to the Agency in accordance with PUC regulations or
10 Texas Administrative Code �6312(f� (as applicable).
RGENCY'S PERFORMLtNCE. The Agency shall:
• Obtain written p�rmission for the Agency to request and have access to customer
information, including con#idential or personal account informatian, credit and payment
history, from custamers seeking Agertcy's assistance. Social Security numbers are not
required forthe program and may not be disclosed to Agen�r.
• Provide to Vendor, at Vendor's request, customer's written permission for Agency's
access to customer information as stated above.
• Not provide pledges on behalf of a Certified Customer to Vendarwithout havingadequate
funds to pay such a pledge.
• Pay pledges within forty-five (45) days af making pledge to Vendor,
• Determine if a customer is a Certified Customer within five days of contacting Vendor.
• Provide Vendor a list of names, telephone numbers and e-mail addresses of Agency staff
designated to make pledges on behalf of the Agency and Certifted Clients, if requested
from Vendor.
ASSIGNMENT. Agency's o6ligations underthis Vendor Agreement are continge�t upon the receipt
and availability offunding from the sQurces listed above under a contract fior utility services by and
between Agency and HOPWA, VETERANS, CSBG, Young Energy Donation Fund, Water ponation
Fund CEAP or other assistance programs. If funding for utility services under said contract is noC
available to make payments to Vendor under this Vendor Agreement, Agency will notify Vendor in
writing within a reasonable time after such fact is determined. Agency shall then assign its
responsibilities under this Vendor Agreement to HOPWA, VETERANS, CSBG, Yaung Energy
Donation Fund, Water ponation Fund or other assistance programs by executing an assignment
on a form approved by HOPWA, VETERANS, CSBG, Young Energy Donation Fund, Water ponation
Fund, CEAP or other assistance programs. If an assignment under this provision is required, the
Parties hereby agree to execute any and all instruments in arder to facilitate the assignment of the
Agency's responsibilities to HOPWA, VETERANS, CSBG, Young Energy Donation Fund, Water
Donation Fund, CEAP or other assistance programs under this Vendor Agreement.
CONFIDENTIALITY. The terms of any confidential transaction under this Vendor Agreement or any
other information exchanged by the Agency and Vendor relating to any transaction shall not be
disclosed to any person nat employed or retained by the Agency or Vendor, their affiliates, or
brokers, except to the extent disclosure is 1) required by law; 2) necessary to disclose to the other
Party in connection with a dispute between the Parties; 3) otherwise permitted by written consent
of the other Party; 4} required by guarantors to be disclosed; 5) information which must be
disclosed to a third party to transmit utility; 6) to meet reliability council, regulatory,
administrative, judicial, governmental, or regulated commodity exchange requirements where
necessary; or7) information which was or is hereafter in the publicdomain (except by breach of this
Vendor Agreement)

with Security Deposits, Rent, Mortgage, Utility Assistance and Accessibility and Safety
Modifications to their Homes, Approve Execution of Applicable Grant Contracts, Waive
Indirect Costs and Adopt Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Ratify the application for and, if awarded, acceptance of two Veterans' Assistance Grants
from the Texas Veterans Commission for a General Assistance Grant in an amount up
to $400,000.00 and a Housing for Texas Heroes Grant in an amount up to $300,000.00;
2. Authorize the execution of related contracts, including any renewals, amendments and
extensions in accordance with City policies and regulations with the Texas Veterans
Commission for the grant funds for the program year beginning on July 1, 2025 and ending
on August 31, 2026;
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations
in the Grants Operating State Fund, subject to receipt of the ,grants, in an amount up to
$700,000.00, for the purpose of assistance to veterans and families; and
4. Authorize a waiver of the Neighborhood Services Department indirect cost rate of 21.05\%,
for an estimated totaf of $17,769.99.
DISCUSSION:
The purpose of the Mayor and Cou�cil Communication (M&C) is to ratify the application for and, if
awarded, acceptance of two grants from the Texas Veterans Commission, a General Assistance
Grant in an amount up to $400,000.00 and a Housing for Texas Heroes Grant in an amounC up to
$300,000.00 that wiil benefit veterans in Fort Worth and Tarrant County. The Neighbarhood Services
Depaitment has already submitted applications for these grants to meet the November deadfine for
application.
The Forward Home Veteran Assistance Program funded by the General Assistance Grant will provide
emergency financial assistance such as deposits, rental/mortgage and uti(ity payments thaf are short-
term and temporary in nature. During program year 2023-2024, the grant was able to assis# 106
veteran/dependents and surviving spouses. This program year, through September 2024, the
program has served 9 F�ouseholds for a benefit average of $2,078.63 per household. This grant will
be administered by the Community Services Division of the Neighborhood Services Department. If
awarded, funding will allow to provide needed services to help stabilize veterans and prevent
homelessness.
The Housing far Texas Heroes Grant will be utilized to provide needed repairs, accessibility or safety
modificafions to the homes of low-income veterans or surviving spouses. During program year 2023-
2024, the Housing for Texas Heroes Grant provided assistance to 18 veterans and surviving
spouses. For the 2024-2025 program year, the City did not receive the Housing for Texas Heroes
grant. This grant will be administered by the Community Services Division of the Neighborhood

Services Clepartment, ff awarded, funding will provide needed services ta help with accessibi[ity and
critical housir[g repairs.
The Neighborhood Services 17epartment will connect with eligible veterans through vanous
resources, including 2-1-1 (First Call for Help), Mission United (a United Way initiative supporti�g
veterans, active-duty military, and their families), the Texas Veterans Network, and local Veteran
Assistance programs. The department will also with the City's Veterans Affairs O�ce tfl share
information about these programs.
Grant funris support administrative and program delivery allocations for 1.15 fuN #ime
employee positions in the Neighborhaod Services Depar#ment. Indirect casts tataling an estimated
$9 7,769.99 calculated by takirtg wages & safaries designated far this grant of approximately
$84,418.00 multiplied by the Neighborhood Service Departments' indirect cost rate of 21.051°/a
defined in the City's most recent Cost AI[ocation Plan, could be charged to these grants. A waiver of
these iRdirect costs is requested to allow alfocation of these ft.rnds to further support the programs
and services to assisi low-�o-moderate income veterans and families. If awarded, both grants will
begin on July 1, 2025 and end on August 31, 2d26.
Positions funded with Texas Veferan Cammissians grant funds are subject #o grant availability. In the
event flf a grant award being decreased or eliminated, Neighborhaod Services Department wauld
review pragrams and senrices funded by ihe grants and determine a level ofi service and staffing thai
aligns with the availabCe funding. Alternatives to consider may include staff and program reductions or
eliminatioRs.

No matching funds are required fram the City for these grants.

The Director af Finance certifies that upon approvat of ihe above recammendations and adoptian of
the attached appropriation ordinance, funds will be available in the current aperating budget, as
appropriated, in the Grants Operating State Fund. The Neighbarhood Senrices Departmen� (and
Financial Management Services) will be responsible for the collection and deposit of funds due to the
City. Prior to an expenditure being incurred, the Neighbofioad Services Department has the
responsibitity to validate the availability af funds. These are reimbursement grants.
