STORMWATER FACILITY MAINTENANCE AGREEMENT
This F I R S T AMENDMENT TO CITY SECRETARY CONTRACT
NO. 55729, STORMWATER FACILITY MAINTENANCE AGREEMENT is made and
entered into by and between the CITY OF FORT WORTH, a municipal corporation of
County, Texas, acting herein by and through its duly authorized City Manager or duly
designated Assistant City Manager, hereinafter referred to as the "City", and Bloomfield
Homes, L.P., a Texas limited partriership, hereinafter referred to as "Landowner", acting herein by
and through its duly authorized representative, Donald J. Dykstra, its President, and Hulen
Tiails Homeowneis' Association, Inc. hereinafter refen�ed to as "Associalion" , acting herein by and
through its duly authorized representatives, , its .
RECITALS
WHEREAS, the City of Fort Worth ("City"), Landowner made and entered into City
Secretary Contract No. 55729 (the "Agreement") to authorize the use of on-site stormwater
management facilities (the "Facility") to be constructed and maintained on a portion of Landowner's
property; and
WHEREAS, the Agreement was i-ecorded with the property records of the
County as Document No. D221149778 which is one and the same as City Secretaiy
Contract 55729.
WHEREAS, the Agreement contains exhibit(s) "A" and "B" that depicts the location and
design specifications of the Facility; and
WHEREAS, it advisable to execute this Amendment to the Agreement to revise exhibit(s)
"A" and "B" in the Agreement to depict changes location and design changes being added to the
original agreement; and

NOW THEREFORE, City and Landovuner, and Association acting herein by and
tlu�ough their duly authof-ized representati�es, entered in#a the follawing tl�at amends the
Agreement:

Exhibit A is herehy replaced with Exhibit A-1 attached hereto and incorporated herein ro the
Agreement, consisting of a revised location description of the Facility.
2.
Exllibii B is hereby replaced witl� Exhibit B-1 attached hez•eto and incozpoz•ated herein to the
Agreement, consisting ofrevased design specifications ofthe Facility.
3.
This Amendinent sliall be filed with tlle City Secretary as an amendinent to the Agreement
and also recorded among the land records of Tart-ant County, Texas, and shali constitute a covenant
running wit1� tl�e land, and sliall be binding ou the Landowner, its adinirustratars, executars, assigns,
heirs and any otl�er successars in interests, including any properiy ownei-s association.
4.
All other provisions ofthe Agreement which are not expressly arnended herein shall remain
in fiill force and effect

C�TY OF FQRT WORTH STORMWATER FACILITY
OPERATION AND MAINTENANCE PLAN
The onfy responsibility the City of Fort Worth has in the ope�•ation and maintenance of
this �acility is inspeetion.
General Maintenanee Prncedures
The structurai and fiinctional iz�tegrity af the �acility shal] be r�aintained at atl times by
removing and preventing drainage int�r%rence, obstructions, hlockages, or ather adverse
effects into, through, or out of the systerr�.
Periodic silt removal shall oecur when standing water conditians acct��' ar the pond's
storage volume is reduced by more than ] 0%. Siit shall be removed and the pond/basin
returned to original lines and grades shown on the approved e�igineeri��g pla��s. In
addition, corrective measures are �•equired any time a basin does not drain completely
withi�� 72 hours of cessation of inflow. NO STANDING WATER IS ALLOWED in
basi��s designed For d�•y de#entian purposes.
Accumulated �itter, sediment, and debris shall be z-e�x�oved e�ery 6 zz�zo��ths or as necessary
to maintain praper operation of the basin. Disposal shali b� in accordanc� with federal,
state aud local regulations.
Detentian faciiities shall be mowed monthly between the months of Aprii and October or
anytime vegetation exeeeds 12-inehes i�i height.
To prevent debris f'ro�n e��teri��.g aa�d cloggi��g the downstream starm sewer system a wire
mesh screen or similar screening device shali be instailed over th� outlet ui�til �nal
acceptance.
4. PREVENTNE MAINTENANCE/INSPECTION
Visual inspectians of all camponents wiil be conducted every 6 nnont�s.
A log shall be kept of maintena.��ce actions, aud inspections. The log should
dacurnez�t the condition of the detention syste�n's pri�nary components, r�owing,
and sii�, litfier and debris removal dates. Document aeratian of the basin bottoms
and replanting to prevent the sealing of the basin botto�n.
Written mair�tena�ce and repair records shall he maintair�ed by the party or
parties signin� the attached A�reement and shall be provided to the City upon
reques�.
