the z•emaindee oi' a called 18.�0�5 acre tract of land accordii�g to thc deed recorded in
Document No. D222261$62, Official Pub(ic Records, Tarrant County, 1�exas, hereinafter
called the '`Propecty";
V+�H�,REAS, ihe Landowner is proceeding to build on and devel�p the Property
aecordii�g to the Site PIanlSubdivision Plail kno�vn as Slate ShoUs — Sendera Ranclt
hereinafter called the "Plan", which is e�pressly illade a part hereof, as appi•oved or to be
appro��ed by the Cit}� and the Landowner provides for management of storm water within
the confines oi'the Property; a►id;
WHEREAS, tl�e City and the Lando�vner, and their successors and as5igns, a�ree
that ihe heaith, safety and welfare of the cesidents of the City of Fort Worth, Texas requirc
that on-site SCoriu��vater Management Pacilities be co�istr�icted and maintainecl on a portion
ot the Property; and

WHEREAS, the City reyuires that on-site Stormwaier Management Facilities
("Facility") as show�i on the Ylan be construclecl aild adequately maintained by tlie
Lando�vner, its successors and assigns, ihe location and dimensions of w�hich is shown and
more particularly described by metes anci bounds in the attached Eahibit '`A" ("Facility
Property"); and
NOW. THE;IZEFORE, in co�isideration of' the foregoitlg premises, the miitual
covenants coiliained herein, and the following te►�ms 111C� conditions, the parties liereto
agi•ee as follo��-s:
]. The Lando���ner, its successors and assi�ns, sh�ll adequately construct and
maintain the on-site Storimvater Management Facility (`'Facility") at na
expense to the Ciiy of F'ort Worth in accordance with the design specifications
for the Facility, attached as E�hibit `'B", and the cul•rent standards then in force
and effect in the City of Fort V��ortli a�id with the Operations and Maintenaiice
Plan attaclled to tliis Agreemeilt as E�:hibit "C". 1�lle Storm���ater Facility
includes all pipes, channcls or other conveyaizces built to convey Storm�vater
to the lacility, as «�ell as all slructuc•es, improvemznts, and ��egetation pi•ovided
to control the quantity �nd qualit}� of ihe Storm�vater. Adequate maintenance is
lierei�i detined as good �vorking condition so that these facilitics ai•e performing
their ciesig�i fiinctions. The StOClll�i�atei• Structural Control Maintenance
Checklists, attacl�ed to this Agreement as Eshibit "D", are to be used to
establish what good ��rorking condition is acceptable to the City.
2. The Landowner, its successors and assigns, shall inspect the Facility and
submit an inspection report to the City annually. The purposc of'the inspection
is to ensure the safe and proper functionin� of the Facility. The inspection
shall cuver the entire Facility, berius, outlet structw•e, �ond areas, �ccess roads,
etc. Components of the Facility, �vI11CI1 ll�Zd IT11111Le11c111Cf', OI' 1'ej�IaCelTlellt t0
perform their design i'unction. shall bc noted in the inspection report along with
the corrective actions to be taken.

;. Thc Landoumer, its successocs and assigns, hereby bC�lllt })Cl'lIt1SS1017 to the
City, its authoi•ized agenis and employees, to entei• upon the Pi•operty a»d to
inspect ihe Facility Properly �vhenever the City deems necessary. Tl�e ptu•pose
of inspection is to follow-up on i•epoi-ted deficiencies �nd/oi• to respond to
citizen complaints. '1'lie City shall provide the Landow�ler, its successors and
assigns, copies of'ihe inspection ti�idings and a dii•ective to conimence ���ith tlle
repairs if necessary.
4. In the event the Landowner, its successors 1nd assigns, fail to maintain the
Facilit}' in good working condition as specitied hcrein. the City, its autllorized
agents and employees, may enter upon the Ii'acility Property and take ���hatever
steps necessary to correct deticiencies ideniified in the inspection rcport and to
charge the costs of such repairs to the Lando�.vner, its successors and assigns.
It is expressla� understood and agreed that the Cih� is unde�• no obligation
to routinely maintain or repair said Facility, and in no e��ent shall this
Agreement be construed to impose any such obligation un the City�, such
obligation is Lando�vner's.
5. "I'he Lando��vner, its successors aiid assigils, �vill perfoi•m tlle �vork necessar}� to
keep the Facility in good working order as appropriate. In the event the City
pursuant to this A�reement, perforins ���ork of any nature, or expends any f'unds
in performance of saici work for labor, use oi� equipme�lt, suppfies, �llatei•ials,
and the like, the Lando�a�ner, its successors and assigns, shall reimburse the
Cit}� upon de�nand, ���ithin thirty (30) days oi'receipt thereof for ali actual costs
ineurred b}� the City hereunder. In the event that Landowner or its successors
or assigns fail to }�ay the City for the costs incurred under this sectiou, the City

Lando�vner. Such lien shal( be perfected by Iiiing in the oftice of the County

6. This Agreement imposes no liability ot�any l<ind whatsoevec on the City. THE

within the boundaries of tlle Property in which the Facility is located as
outlined on E�:hibit "A" but this pa��agraph shall not preciude construction of
other improvements �a%ithin the boundaries of the Yroperty in �vhich the Facility
is locatea, �vhich do not impede drainage. Lando�vner covenants and agrees
tllat no habitable building shall be erected on the above pi•opecty abutting such
boundaries of tlle P�•operty in ��-hich is Faeility is located, which shall have a

water in the detention pond which would occur during a 100-year fi•ec�uency
flood.
8. 1'his Agreement shall be recorded an�ong the land recards of' Tarrant Count}r,
Texas, shall constitute a covenant rimning �a�ith the land, and shall be bindi�lg
on the Lando�vncr, its administrators, eYecutors, assigns, heirs and any other
successors in interests, including any property owner's association.

SILT FENCE GENERAL NOTES:
1. DESIGN SHALL SHOW ON THE DRAWINGS THE LOCATIONS WHERE
OVERFLOW STRUCTURES SHALL BE INSTALLED. OVERFLOW
STRUCTURES ARE REQUIRED AT ALL LOW POINTS AND AT A SPACING OF
APPROXIMATELY 300 FEET WHERE NO LOW POINT IS APPARENT.
2. DESIGNER SHALL SHOW ON THE DRAWINGS THE LOCATIONS WHERE
SILT FENCE IS TO BE TURNED UPSLOPE AT THE ENDS. UPSLOPE
LENGTHS SHALL BE A MINIMUM OF 10 FEET.
3. POST WHICH SUPPORT THE SILT FENCE SHALL BE INSTALLED ON A
SLIGHT ANGLE TOWARD THE ANTICIPATED RUNOFF SOURCE. POST MUST
BE EMBEDDED A MINIMUM OF ONE FOOT.
4. THE TOE OF THE SILT FENCE SHALL BE TRENCHED IN WITH A SPADE
OR MECHANICAL TRENCHER, SO THAT THE DOWNSLOPE FACE OF THE
TRENCH IS FLAT AND PERPENDICULAR TO THE LINE OF FLOW.
5. THE TRENCH MUST BE A MINIMUM OF 6 INCHES DEEP AND 6 INCHES
WIDE TO ALLOW FOR THE SILT FENCE FABRIC TO BE LAID IN THE GROUND
AND BACKFILLED WITH COMPACTED MATERIAL.
6. SILT FENCE SHOULD BE SECURELY FASTENED TO EACH SUPPORT
POST OR TO WIRE BACKING, WHICH IN TURN IS ATTACHED TO THE FENCE
POST. THERE SHALL BE A 3 FOOT OVERLAP, SECURELY FASTENED
WHERE ENDS OF FABRIC MEET.
7. INSPECTION SHALL BE AS SPECIFIED IN THE SWPPP. REPAIR OR
REPLACEMENT SHALL BE MADE PROMPTLY AS NEEDED.
8. SILT FENCE SHALL BE REMOVED WHEN FINAL STABILIZATION IS
ACHIEVED OR ANOTHER EROSION OR SEDIMENT CONTROL DEVICE IS
EMPLOYED.
9. ACCUMULATED SILT SHALL BE REMOVED WHEN IT REACHES A DEPTH
OF HALF THE HEIGHT OF THE FENCE. THE SILT SHALL BE DISPOSED OF

CITY OF FORT WORTH STORMWATER FACILITY
OPERATION AND MAINTENANCE PLAN
The only responsibility the City of Fort Worth has in the operation and maintenance of
this Facility is inspection.
General Maintenance Procedures
The structural and functional integrity of the Facility shall be maintained at all times by
removing and preventing drainage interference, obstructions, blockages, or other adverse
effects into, through, or out of the system.
Periodic silt removal shall occur when standing water conditions occur or the pond's
storage volume is reduced by more than 10%. Silt shall be removed and the pond/basin
returned to original lines and grades shown on the approved engineering plans. In
addition, corrective measures are required any time a basin does not drain completely
within 72 hours of cessation of inflow. NO STANDING WATER IS ALLOWED in
basins designed for dry detention purposes.
Accumulated litter, sediment, and debris shall be removed every 6 months or as necessary
to maintain proper operation of the basin. Disposal shall be in accordance with federal,
state and local regulations.
Detention facilities shall be mowed monthly between the months of April and October or
anytime vegetation exceeds 12-inches in height.
To prevent debris from entering and clogging the downstream storm sewer system a wire
mesh screen or similar screening device shall be installed over the outlet until final
acceptance.
4. PREVENTIVE MAINTENANCE/INSPECTION
• Visual inspections of all components will be conducted every 6 months.
• A log shall be kept of maintenance actions, and inspections. The log should
document the condition of the detention system's primary components, mowing,
and silt, litter and debris removal dates. Document aeration of the basin bottoms
and replanting to prevent the sealing of the basin bottom.
• Written maintenance and repair records shall be maintained by the party or
parties signing the attached Agreement and shall be provided to the City upon
request.
