LANDLORD PERMISSION TO P�R�'ORM ASSESSM�NT &�NSPECTIONS �'OR RENTAL UNITS Yaur mu[tifamily or single family building(s), as applicable, is under consideratiqn to r�ceive services from the Weatherization Assistance Progran�► ("WAP'�}. The City of Fort Worth ("City") is under contract with the Texas Department of Housing ar�d Cnmmuniiy Affairs {"TDHCA") to administcr the WAP in Tarrant County. The WAP operates under Pederal and State rules which have certain requirements of which you, as a multi-family building landlord, sllould be aware. At the bottom of this }�age is a PERMISSION TO ENTER PltEM]SES see#ion granting your per�nission for the City of Fort Worth to enter your building(s) ta perform ener�y aucfits, collect eligibility documentation ft•orn your teilants, and complete applicat�ons. Before work begins on your bu�lding(s), yau wi[I be required fo sign a Landlord Agr�ement, a copy o�' which is attached %r your review. Piease be aware that only residentia! units �nay be weatherized. Meeting rooms, garr�e rooms, [aundry roo�r�s, maintenance rooins, daycare centers, of�'ice areas or cosnmercial business areas, and non-residentia[ facilities are not eli�ible far weatherization services. The City may request a fnar�cia] commitment from ti�e building's lar�dlord(s) based on t[�e estiEnated cost for each builci�ng containing multi-family rental units. �xceptions to this requirement ca�� be made when the owner is an income-eligible appticant or a non-proFii entity. The financia] com3nitment may be in tl�e form of monetary contributions (checks or money orders}, inateriaEs, or iabor provided to ii�stal� eligible measures. All monetary contributio��s prov�ded �y landlords �vill be used for labor and materials. The estimated cast of each bi�ilding will be hased on an energy a�fdit that is perFormed ot� each indi�+idual unit within the building. ��Jhe.n the energy audits are co�r�pleted. the City will contact you ta discti�ss the proposed weatherization measures for each bui[ding and your fnai�cial co�nmit3neE�t to the project arzc� t17e Landlord Agree�nent. After uTeatherization services have been provided, the City is required ta conduct a quality control inspection to ensure that u�ork was correpleted in accordance with the standards set forth by the WAP. T'he City skxall gather and keep cora�dential the names and incaines oi tenants living at the premises, to the extent allawed by la�u. 2. [t� the City, a� its sole discretion, deiermines that the �eemises are eligible for weatherization services, the City agre�s to weatherize the Pre�nises in accardance with applicable codes, laws and regulations. The City agrees to farward a summary of the proposed work to the La€�dlord after the energy audits are completed. ln exchai�ge for these services, the Landlord agrees to be bound by the ter�ns anc� conditions of this Agreement for a p�riod of 12 manths, commencing on the date the weatllerization work is co3npleted. 3. A tenant's lease may be renewed for successive periods diiring the period of the Agreemeni. If an eligible tenant's fease ends d�ring the term of the Agreement, the owner is not obli�;ated to renew tihe lease, as long as tE1e cEweiling unit is subsequently rented to an inco�ne eti�ible hausehold for �he re�naining time period of the Agreement. T'be Landlord shal] not increas� the rents durin� the term of this Agree�r�ent unless the increase is demonstrably rclated to matters other than weatherization work perft�rmed. I.andlarc� shall not evict teraanfs %r the time period of` this A�reement, except for just cause and for inatters unrelated to the weatherizatio�� work performed. A failure to provide such docu�nentatian prior to the execution of this Agree�ne��t will be considered a rriaterial breach of the Agreement_ 4. Weatherized units that become vacant during the terax� of this Agreement must be rented to income e[igib[e households. �. The City agrees to begin installat�on of weatherizatioa� anaterials on or about {date),TB� rt�ormal business hours, access by C�ty personnel, City subcontractars, and state and federal officials, to all dwelling units and common areas weatherized. 8. The City and Landlord agree that the tenants, present and future, are rneant as the persons to benefit from t17e Weatherization Assistance Program. The tenants of weatherized units sE�all receive copies of this Agreement. TE�e City a�rees to provide a copy of this Agree�ne��t to the tenant of the Premises and weatherized unit. The La��dlord agrees to provide a copy of this Agreement to all future tenants of Premises and weatherized units while this Agreemenf is in effect. 4. In the event the Land[ord defaults on or materially breaches any terrri of this Agreement, the Landlord shal] be €iable far liquidated damages im�nediately due a�ad payable to the City to be computed as follows: the total cast of the project not borne by the Landlord shall be divided i�to l2 equal shares. One share shal� be deducted for each full manth that elapses between t11e date of co��pletion o'f the u�ork and the date ot� Landlord's deFault or breach. The remainder shall be paid as liquidated damages, which the parties agree reasonably approximates the actual damages to Gity. ] 0.
