Ordinance No. AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS CAPITAL PROJECTS FEDERAL FUND,IN THE AMOUNT UP TO $9,300,000.00,SUBJECT TO RECEIPT OF THE GRANT,FOR FEDERAL PARTICIPATION FOR THE PURPOSE OF FUNDING THE EVERMAN SAFE STREETS PROJECT (CITY PROJECT NO.106479);PROVIDING FOR A SEVERABILITY CLAUSE;MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2025-2026 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Capital Projects Federal Fund in the amount up to $9,300,000.00, subject to receipt of the grant, for federal participation for the purpose of funding the Everman Safe Streets project (City Project No. 106479). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Amend the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to accept federal funding from Texas Department of Transportation (TxDOT), adopt a resolution authorizing execution of an Advance Funding Agreement (AFA) with TxDOT in the amount of $10,256,970.00 with Federal participation in the amount of $9,300,000.00, State participation in the amount of $491,970.00 and Local Participation by Transportation Development Credits in the amount of 1,860,000 and City Funds in the Amount of $465,000.00 for the Everman Safe Streets project (City Project No. 106479), adopt appropriation ordinances, and amend the Fiscal Years 2026-2030 Capital Improvement Program. The initial payment for the City participation is $232,500.00. The Transportation Development Credits (TDCs) in the amount of 1,860,000 will be appropriated and tracked as a non -spendable item in the Grants Capital Project Other Fund. The scope of work for the project consists of constructing a 10-foot wide cycle track on the east side of Oak Grove Road from Forum Way to Everman Parkway, a 5-foot wide bike lane/1-foot raised barrier on Everman Parkway from Oak Grove Road to Dan Meyer Road, green -stamped sharrows on both sides of Everman Parkway/Shelby Road from Dan Meyer Drive to Forest Hill Drive, 5-foot wide sidewalk on the north side of Everman Parkway/Shelby Road from just west of Dollar General to Forest Hill Drive, 5-foot wide sidewalk and green -stamped sharrows on Dan Meyer Drive from Everman Parkway to Townley Drive, 5-foot wide sidewalk on Townley Drive from Dan Meyer Drive to South Race Street and 5- foot wide protected sidewalk on South Race Street from Everman Parkway/Shelby Road. The project aims to improve safety, accessibility, and comfort for pedestrians, bicyclists, and multi -modal mobility users. The project area extends between the City of Fort Worth and the City of Everman. This project has federal funding for construction improvements and is scheduled to start construction in October 2027 and the City of Fort Worth will let this project. The funding appropriated by this M&C will be used for design, right-of-way acquisition, environmental clearance, utilities, project management, and construction. The AFA requires the City of Fort Worth to fund cost overruns. The scope of work for the project consists of constructing a 10-foot wide cycle track on the east side of Oak Grove Road from Forum Way to Everman Parkway, a 5-foot wide bike lane/1-foot raised barrier on Everman Parkway from Oak Grove Road to Dan Meyer Road, green -stamped sharrows on both sides of Everman Parkway/Shelby Road from Dan Meyer Drive to Forest Hill Drive, 5-foot wide sidewalk on the north side of Everman Parkway/Shelby Road from just west of Dollar General to Forest Hill Drive, 5-foot wide sidewalk and green -stamped sharrows on Dan Meyer Drive from Everman Parkway to Townley Drive, 5-foot wide sidewalk on Townley Drive from Dan Meyer Drive to South Race Street and 5- foot wide protected sidewalk on South Race Street from Everman Parkway/Shelby Road. The project aims to improve safety, accessibility, and comfort for pedestrians, bicyclists, and multi -modal mobility users. The project area extends between the City of Fort Worth and the City of Everman. This project has federal funding for construction improvements and is scheduled to start construction in October 2027 and the City of Fort Worth will let this project. The funding appropriated by this M&C will be used for design, right-of-way acquisition, environmental clearance, utilities, project management, and construction. The AFA requires the City of Fort Worth to fund cost overruns. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to provide additional funding for the Drainage Improvement programmable project (City Project No. P00043). This capital improvement project funds small-scale reactive drainage improvement efforts, such as easement acquisition, responding to emergencies such as sinkholes, and minor infrastructure upgrades. Many of the projects are the result of concerns that arise as a result of rain events and resident concerns. The funding from this project also contributes to partnership projects, such as street improvement projects, by supporting stormwater work in the vicinity of the street project, necessary to maintain the integrity of the storm drain system and/or improve maintenance of the drainage system. Due to increased reactive project needs and higher project costs, additional funding is required to tackle high priority reactive needs. Funding is currently available within the Flooding Assessments programmable project (City Project No. P00046). This project supports citywide planning, prioritization, and flooding assessments under the Stormwater Management Program and applies a data -driven, risk -based asset management approach to identify, evaluate, and prioritize stormwater system needs. The Flooding Assessments programmable project receives annual funding through the Capital Improvement Plan (CIP) process, and all current initiatives are fully funded at this time. Schultz, Inc. dba Circle C Construction Company in the amount of $9,242,595.00 for the construction of the Fort Worth Central City (FWCC) New Main Street Outfall Storm Drain & 8th Street project (City Secretary Contract No. 59910). This contract was subsequently revised by Change Order No. 1 and Change Order 2 as shown in the table below. This Mayor and Council (M&C) Communication authorizes Change Order No. 3 for additional materials and labor required to reorder thimble material for the sluice gate, which has resulted in a substantial delay to the project. This change order also covers additional pipe connections and junction box rework that Circle C Construction Company needs to perform due to additional underground utilities encountered in the field that were not identified in the original plans. It also incorporates increased trail quantities, as requested by Tarrant Regional Water District (TRWD), to accommodate a wider pedestrian trail and designated equipment crossing paths. If additional contract days are required, staff will coordinate with the Contractor and memorialize them in a subsequent change order.
