HomeMy WebLinkAbout28104-11-2025 - City Council - OrdinanceORDINANCE NO.2.8.104®LL-2,025 AN ORDINANCE AMENDING CHAPTER 22 "MOTOR VEHICLES AND TRAFFIC; ARTICLE IV "TRUCK TRAFFIC; SECTION 22-117 "VEHICLE RESTRICTIONS" OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (2015), AS AMENDED, TO ESTABLISH AN ALLIANCE LOGISTICS DISTRICT AND TO ELIMINATE THE REQUIREMENT THAT OVERWEIGHT VEIDCLES UP TO 120,000 POUNDS GROSS VEHICLE WEIGHT OPERATING ON CITY STREETS WITHIN THE ALLIANCE LOGISTICS DISTRICT OBTAIN PERMITS FROM THE CITY OF FORT WORTH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, on March 21, 2023, the City Council adopted Resolution No. 5724-03-2023 establishing an Innovation District Policy; and WHEREAS, Innovation Districts are specific geographic areas where leading -edge anchor institutions and companies cluster and connect with start-ups, business incubators, accelerators, and producers of marketable intellectual property; and WHEREAS, Innovation Districts rely on public support through the installation of basic infrastructure, advanced infrastructure, efficient development services, and direct support for facilities and incentives for innovation and commercial activity; and WHEREAS, the Innovation District Policy provides that the City will seek to support the long-term success of each Innovation District through the City's various policy decisions and investments in support infrastructure and the City will seek to collaborate with Innovation District partners on the installation of advance infrastructure, such as Smart City technologies; and WHEREAS, on March 21, 2023, the City Council adopted Resolution No. 5725-03-2023 establishing the Fort Worth Mobility Innovation Zone; and WHEREAS, the Fort Worth Mobility Innovation Zone is intended to promote innovation, research, and associated entrepreneurial and industrial activity together with increased economic productivity, new product development and commercialization, and support for new market opportunities in the field of mobility; and WHEREAS, in collaboration with Innovation District partners, the Transportation & Public Works Department has identified the need to support increased mobility opportunities within a distinct area within the Fort Worth Mobility Innovation Zone; and WHEREAS, the City Council find that overweight vehicles up to 120,000 pounds operating on City streets within an area to be defined as the Alliance Logistic District shall not be required to Ordinance No.28104-11-2025 Page I of obtain additional overweight vehicle permits from the City and pay the associated fees. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: SECTION 1. Chapter 22, "Motor Vehicles and Traffic," Article IV, "Truck Traffic," Section 22-117 "Vehicle Restrictions," of the Code of the City of Fort Worth, Texas (2015), as amended, is hereby amended to add subsection (f) which shall be and read as follows: (f) Subsections (c), (d) and (e) shall not apply to a commercial motor vehicle, truck - tractor, trailer, semi -trailer, or combination of such vehicles operating on City streets within the Alliance Logistic District ifthe total gross weight, with load, ofthe vehicle or combination of vehicles, does not exceed 1200,000 pounds. For purposes of this subsection, the term "Alliance Logistics District" shall mean the area described as follows: BEING a tract ofland situated in the G. Overton Survey, Abstract Number 1185, City of Fort Worth, Tarrant County, Texas, and the W. Sample Survey, Abstract Number 1207, the W. Zeckular Survey, Abstract Number 1454, the L.A. Butler Survey, Abstract Number 64, A.W. Robertson Survey, Abstract Number 1553, and the G. Overton Survey, Abstract Number 972, City of Fort Worth, Denton County, Texas, being all or part of the following tracts ofl and located in Tarrant County, Texas: the remainder of that tract of land described by deed to AIL Investment, LP, recorded in Volume 13588, Page 187; three tracts of land described by deed to WPRR, LP, recorded in Instrument Number D217128211, D218204956, and D218204955; two tracts of land described by deed to Alliance -Center West Association, recorded in Volume 15532, Page 271 and Instrument Number D209153995; SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and ofthe Code ofthe City of Fort Worth, Texas (2015), as amended, except where the provisions ofthis ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any ofthe remaining phrases, clauses, sentences, paragraphs and sections ofthis ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. All rights and remedies ofthe City of Fort Worth, Texas, are expressly saved as to any and all violations ofthe provisions ofthe Code ofthe City of Fort Worth, or any other ordinances ofthe Ordinance No.28104-11-2025 Page 7 of 8 City, that have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance, but may be prosecuted until final disposition by the courts. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to adopt an ordinance amending Chapter 22 of the City Code to establish the Alliance Logistics District within the Fort Worth Mobility Innovation Zone, to eliminate requirements and fees for overweight vehicles operating 01 City streets within the established district, and to adopt a resolution supporting the use of hostler trucks and autonomous vehicle technology within the Alliance Logistics District. a, March 21, 2023, the City Council approved Mayor and Council (M&C) Communication 23-0235 adopting a resolution establishing an Innovation District Policy, Resolution No. 5724-03-2023 (Policy). Innovation Districts are specific geographic areas where leading -edge anchor institutions and companies duster and connect with start-ups, business incubators, accelerators, and producers of marketable intellectual property. As outlined 7 the Policy, Innovation Districts rely 01 public support through the installation of basic infrastructure, advanced infrastructure, efficient development services, and direct support for facilities and incentives for innovation and commercial activity. The Policy provides that the City will seek to support the long-term success of each Innovation District through the City's various policy decisions and investments 7 support infrastructure and the City will seek to collaborate with Innovation District partners 01 the installation of advance infrastructure, such as Smart City technologies. M&C 23-0235 also adopted a resolution establishing the Fort Worth Mobility Innovation Zone, Resolution Na 5725-03-2023 (Zone). The Zone is intended to promote innovation, research, and associated entrepreneurial and industrial activity together with increased economic productivity, new product development and commercialization, and support for new market opportunities 7 the field of mobility. A map of the Zone and the proposed Alliance Logistics District is attached to this M&C. h collaboration with Fort Worth Mobility Innovation Zone partners, the Transportation & Public Works Department has identified the need to support innovative mobility improvements within certain areas within the Zone. Adoption of the attached ordinance will eliminate the requirement to obtain additional permits from the City and pay associated fees for the operation of overweight vehicles that are operating 7 accordance with State law 01 portions of Mobility Way, Distribution Drive and Intermodal Parkway between the BNSF yard and Mobility Way. Adoption of the attached resolution will support mobility innovation within the Zone. These actions are intended to enhance supply chain efficiency, optimize freight movement, and create a controlled environment for transportation innovation. Adoption of the attached ordinance and resolution support the City's goals set forth 7 the Policy and the purpose and intent of the establishment of the Zone. This project is LOCATED 7 Council District 10 A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
