Ordinance No.28223-01-2026 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS CAPITAL PROJECTS FEDERAL FUND, IN THE AMOUNT UP TO $982,196.00, SUBJECT TO RECEIPT OF THE GRANT, FOR THE PURPOSE OF FUNDING THE RISINGER ROAD AND POYNTER STREET PROJECT (CITY PROJECT NO. 106610); PROVIDING FOR A SEVERABILITY CLAUSE; MAILING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2025-2026 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Capital Projects Federal Fund, in the amount up to $982,196.00, subject to receipt of the grant, for the purpose of funding the Risinger Road and Poynter Street project (City Project No. 106610). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached resolution authorizing execution of an Advance Funding Agreement with the Texas Department of Transportation (CSJ# 0902-90-316) for the intersection improvements at Risinger Road and Poynter Street project (City Project No. 106610) in the amount Up to $1,166,243.00 with Federal participation in the amount Up to $982,196.00, State participation in the amount Up to $3,698.00 and Local participation in the amount of $180,349.00; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Federal Fund, in the amount up to $982,196.00, subject to receipt of the grant, for the purpose of funding the Risinger Road and Poynter Street project (City Project No. 106610); 3. Adopt the attached appropriation ordinance adjusting appropriations in the 2022 Bond Program Fund, by increasing estimated appropriations in the Risinger Road and Poynter Street project (City Project No. 106610) in the amount of $180,349.00, and decreasing appropriations in the Traffic Signals programmable project (City Project No. PB0006) by the same amount; and 4. Amend the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to adopt a resolution authorizing execution of an Advanced Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) in the amount of $1,166,243.00, with City participation in the amount of $982,196.00 for the intersection improvements at the Risinger Road and Poynter Street project (City Project No. 106610). The project intends to create a cost-effective solution to improve the efficiency of traffic flow while increasing the visibility and safety. The scope of work for the project consists of installing a traffic signal and pedestrian signals, providing safety lighting at the intersection, refreshing pavement markings, and installing pedestrian crosswalks to comply with the Americans with Disabilities Act (ADA) regulations. TxDOT will be responsible for the construction of the project. This project is expected to be let by TxDOT in August 2027. TxDOT is responsible for all construction activities within the scope of this project. Further, TxDOT is responsible for securing the Federal and State share of the funding required for the development and construction of the project. City funds appropriated for this project include professional services and local participation. The City bears the responsibility to pay for construction cost overruns. An advance payment of $67,107.00 to TxDOT is required for this project. The final payment to TxDOT for local participation will be based on actual costs. At the end of the project, the asset will remain with the City of Fort Worth. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25675-08-2022) provides liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). Funding for the grant portion of the project was not included in the Fiscal Years 2026-2030 Capital Improvement Program because grant funding is appropriated at the time of the grant award. The action in the M&C will amend the Fiscal Years 2026-2030 Capital Improvement Program as approved in connection with Ordinance 27979-09-2025. This project is located in COUNCIL DISTRICT 6 and COUNCIL DISTRICT 8. A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: Texas Department of Transportation FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Traffic Signals project within the 2022 Bond Program Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the Grants Cap Projects Federal Fund and 2022 Bond Program Fund for the W Risinger Rd and Poynter St project to support the execution of the Advance Funding Agreement. The Transportation & Public Works Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to expenditures being incurred, the Transportation & Public Works Department has the responsibility to validate the availability of funds. This is a State Advance Funding Agreement.
