HomeMy WebLinkAbout28055-10-2025 - City Council - OrdinanceOrdinance No. 28055-10-2025 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $75,205.00, FROM AVAILABLE PAYGO RESIDUALS IN THE WATER AND SEWER CAPITAL PROJECTS FUND, FOR THE PURPOSE OF FUNDING THE WATER AND SANITARY SEWER REPLACEMENTS CONTRACT 2023, WSM-1 PROJECT (CITY PROJECT NO. 104980); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2025-2026, as enacted by Ordinance 27979-09-2025, as amended, is hereby further amended to make the following adjustments by increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $75,205.00, from available PayGo Residuals in the Water and Sewer Capital Projects Fund, for the purpose of funding the Water and Sanitary Sewer Replacements Contract 2023, WSM-1 project (City Project No. 104980). That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. DISCUSSION: On January 30, 2024, Mayor and Council Communication (M&C 24-0103), the City Council authorized an engineering agreement in the amount of $332,355.00 with BGE, Inc. (City Secretary Contract No. 61003) for the Water and Sanitary Sewer Replacement Contract, WSM-1 project. The recommended appropriation will provide for Amendment No. 1 to the agreement with BGE, Inc. in the amount of $75,205.00 for design and survey services for an additional 1,150 linear feet of cast iron water pipe and sanitary sewer line replacement along Dunbar Street (Amanda Avenue to Vincennes Street) as requested by the City. It is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year, instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants. The actions in the M&C will appropriate funds in support of Water's portion of the City of Fort Worth's Fiscal Years 2026-2030 Capital Improvement Program. Funding is currently available in the Unspecified All -Funds project within the Water & Sewer Capital Projects Fund for the purpose of funding the W/SS Repl Contract 2023 WSM-1 project within the Water & Sewer Capital Projects Fund. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified All -Funds project within the W&S Capital Projects Fund and upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the W&S Capital Projects Fund for the W/SS Repl Contract 2023 WSM-1 project.
