U34018) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAILING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2024-2025, as enacted by Ordinance 27107-09-2024, as amended, is hereby further amended to make the following adjustments to appropriations in the 2018 Bond Program Fund, by increasing appropriations in the Miller Avenue Streetscape project (City Project No. 104805) in the amount of $786,518.89, and decreasing appropriations in the Authorized, Not Appropriated project (City Project No. U34018 ) by the same amount. E•�x0�I[a]►14 That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27107-09-2024 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. City of Fort Worth, Mayor and Texas Council Communication DATE: 08/12/25 M&C FILE NUMBER: M&C 25-0683 LOG NAME: 20MILLER AVENUE STREETSCAPE APPROPRIATION SUBJECT (CD 5 and CD 11) Adopt Appropriation Ordinances in the Combined Amount of $893,649.89 to Provide Additional Funding for the Miller Avenue Streetscape Project for the Purpose of Additional Design, Project Management and Construction Costs, and Amend the Fiscal Years 2025-2029 Capital Improvement Program (2022 Bond Program) RECOMMENDATION: It is recommended that the City Council: Adopt the attached appropriation ordinance adjusting appropriations in the 2018 Bond Program Fund, by increasing appropriations in the Miller Avenue Streetscape project (City Project No. 104805) in the amount of $786,518.89 and decreasing appropriations in the Authorized, Not Appropriated project (City Project No. U34018) by the same amount; Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the General Capital Projects Fund, by increasing estimated receipts and appropriations in the Miller Avenue Streetscape project (City Project No. 104805) in the amount of $107,131.00 and decreasing estimated receipts and appropriations in the Caville/Stop Six Roadway Redev programmable project (City Project No. P00095) by the same amount, for the purpose of converting to a static project; and Amend the Fiscal Years 2025-2029 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council communication (M&C) is to authorize appropriations in the combined amount of $893,649.89 for additional project management and construction costs for the Miller Avenue Streetscape project (City Project No. 104805). The scope of work for the project consists of reconstructing a portion of Miller Avenue as a context -sensitive roadway including the addition of sidewalks and lighting from East Rosedale Street to Windowmere Street. The project aims to improve safety by increasing visibility and separation for bicyclists and pedestrians and encouraging multi -modal mobility uses. This project has federal funding for construction improvements. The Advance Funding Agreement (AFA) will be executed at a later date. The project is scheduled for construction in the summer of 2028. The City of Fort Worth is responsible for funding engineering, right-of-way (ROW) acquisition, environmental studies, utility relocations, project management, and a minimum of twenty percent of the construction cost. The funding appropriated by this Mayor & Council Communication (M&C) will be used for these costs. This action is needed as funding for Miller Avenue Streetscape project (City Project No. 104805) is from other sources and the scope of this project differs from that of current programmable project. Funding for this project was not included in the FY2025-2029 Capital Improvement Program (CIP) because construction cost estimates adequate for Advance Funding Agreement execution were not complete at the time of CIP development. The action in this M&C will amend the FY2025- 2029 Capital Improvement Program as approved in connection with Ordinance No. 27107-09-2024. This project is located in COUNCIL DISTRICTS 5 & 11. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Authorized, Not Appropriated project within the 2018 Bond Program Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the 2018 Bond Program Fund for the Miller Avenue Streetscape project. Prior to an expenditure being incurred, the Transportation & Public Works Department has the responsibility of verifying the availability of funds.
