Home My WebLink About058155-T1 - Construction-Related - Contract - Heritage Development, LLCDate Received: 03/19/2026 Time Received: 3 :17 p.m. City Secretary Contract No.: 58155-T 1 TERMINATION OF CITY SECRETARY CONTRACT NUMBER 58155 A COMMUNITY FACILITIES AGREEMENT BETWEEN THE CITY OF FORT WORTH AND FORT WORTH HERITAGE DEVELOPMENT, LLC This TERMINATION OF CITY SECRETARY CONTRACT NUMBER 58155 ("Termination"), is made and entered into by and between the City of Fort Worth ("City"), a home -rule municipal corporation of the State of Texas, acting by and through its duly authorized Assistant City Manager, and FORT WORTH HERITAGE DEVELOPMENT, LLC ("Developer"), an Delaware limited liability company, acting by and through its duly authorized representative. WHEREAS, City and Developer entered into a Community Facilities Agreement for the construction of public infrastructure Improvements for project known as Swift Lofts (Majestic Stockyards Multi -Family), City Project Number 103 82 1, City Secretary Contract Number 58155 ("CFA"); and WHEREAS, after execution of the CFA, Developer did not proceed with construction of the Improvements; and WHEREAS, in accordance with the CFA, Developer has vacated the plat, FP-22-018, for the Project; and WHEREAS, City and Developer desire to terminate the CFA, release Developer's financial guarantee and refund fees paid minus any costs incurred by the City. NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, City and Developer agree as follows: City Secretary Contract Number 58155 is hereby terminated. 2. Upon execution of the CFA, Developer paid to the City $156,250.00 in construction inspection service fees, $5,880.00 in administrative material testing fees, and $1,200.00 in water testing lab fees (collectively $163,330.00). Upon execution of this Termination, the City will refund to Developer $156,250.00 in construction inspection service fees, $5,880.00 in the estimated administrative material testing service fees, and $1,200.00 in water testing lab fees (for a total refund of $163,330.00).
