HomeMy WebLinkAbout064906 - Construction-Related - Contract - Johnson County Special Utility DistrictCSC No. 64906 AGREEMENT FOR THE CITY OF FORT WORTH AND JOHNSON COUNTY SPECIAL UTILITY DISTRICT TO DECERTIFY A PORTION OF JOHNSON COUNTY SPECIAL UTILITY DISTRICT's CCN AND AMEND FORT WORTH'S CCN WHEREAS, the Johnson County Special Utility District ("JCSUD") is the holder of Certificate of Convenience and Necessity ("CCN") No. 10081, authorizing it to provide treated water service within the identified service area; and WHEREAS, the City of Fort Worth ("City") is the holder of Certificate of Convenience and Necessity No. 12311, authorizing it to provide treated water service within the identified service area; and WHEREAS, the boundaries of the Parcel are detailed in the data and maps filed with the Public Utility Commission of Texas ("PUCT") Interchange Docket, Item No. 14 (the "Filing"); and WHEREAS, the City of Fort Worth and JCSUD wish to include the area depicted and more particularly described in the Filing; and WHEREAS, the total area to be decertified from JCSUD's CCN and added to the City of Fort Worth's CCN is 68.06 acres, as referenced by data and mapping information in the Filing; and WHEREAS, the lands to be incorporated into the City's CCN are shown on the map attached hereto as Exhibit "A", and WHEREAS, Areas 1 and 2 on Exhibit "A" represent lands which have already been decertified and which the City is in the process of incorporating into its CCN; and WHEREAS, Area 3 on Exhibit "A" is a portion of the JCSUD CCN which JCSUD, through its General Manager Josh Howard, agreed to decertify and cede to the City of Fort Worth's CCN in City Contract CSC 61876, dated on or about August 20, 2024; and WHEREAS, Area 4 on Exhibit "A" is a portion of the JCSUD CCN which JCSUD, through its General Manager Peter Kampfer, agreed to decertify and cede to the City of Fort Worth's CCN in City Contract CSC 54117, dated on or about May 14, 2020; and WHEREAS, the PUC Staff requested a document memorializing the agreements with JCSUD; NOW, THEREFORE, the JCSUD, acting herein and through Joshua Howard, its duly authorized General Manager, and the City of Fort Worth, hereinafter referred to as Fort Worth, acting herein by and through Jesica McEachern, its duly authorized Assistant City Manager, do hereby agree as follows: OFFICIAL RECORD CITY SECRETARY FT. WORTH, TX I. JCSUD and Fort Worth agree to decertify 68.06 acres from JCSUD's CCN No. 10081 and transfer it to Fort Worth to amend Fort Worth's CCN No. 12311. The 68.06 acres are in two tracts and detailed in the data and maps identified in Public Utility Commission Interchange Docket No. 58824, Item No. 14. II. JCSUD and Fort Worth agree that the designation under this agreement of areas and customers to be provide water service is valid and enforceable and may be submitted to the PUC for approval at the appropriate time under Section 13.248 of the Texas Water Code regarding contracts designated to be served by retail public utilities. JCSUD and Fort Worth agree to cooperate in good faith in achieving formal resolution of the CCN amendment applications before the PUC. JCSUD hereby consents to the decertification as service areas within its CCN as stated herein. IV. No provision or term contained in this agreement shall be construed to create any type of partnership or joint venture between the parties hereto, nor shall same create any rights or liabilities except as stated herein. V. This agreement is subject to all applicable federal and state laws and any applicable permits, amendments, orders or regulations of any state or federal government authority having or asserting jurisdiction. VI. In addition to any other remedy as may be provided by law, this agreement shall be specifically enforceable by the parties hereto. Venue for any action shall lie in Tarrant County, Texas. This agreement shall be effective on the date signed by the City of Fort Worth Assistant City Manager.
