FORT WORTH WATER DEPARTMENT
PRETREATMENT SERVICES CONTRACT
WHEREAS, this Agreement is made under the authority granted to the City of Fort Worth
("Fort Worth") and the City of Hurst ("Hurst") pursuant to Texas Government Code Chapter 791,
known as the Interlocal Cooperation Act, and Chapter 552 of the Texas Local Government Code;
and
WHEREAS, Fort Worth and Hurst entered into contracts for wholesale wastewater service
on April 18, 1969 (Fort Worth City Secretary Contract No. 6300), May 8, 1987 (Fort Worth City
Secretary Contract No. 15709), and May 9, 2017 (Fort Worth City Secretary Contract No. 49764);
and
WHEREAS, Fort Worth City Secretary Contract No. 49764 (the "Wastewater
Agreement") requires Hurst to adopt and enforce an industrial pretreatment ordinance within its
jurisdiction; and
WHEREAS, Hurst has requested that Fort Worth sample and analyze industrial
wastewater within Hursfs jurisdiction; and
WHEREAS, Fort Worth desires to sample and analyze industrial wastewater on behalf of
Hurst to ensure that Hurst's wastewater does not negatively affect Fort Worth's wastewater
system.
NOW, THEREFORE, that for and in consideration of the mutual covenants, promises
and agreements contained herein, Fort Worth and Hurst, hereby do covenant and agree as
follows:
1. Significant Industrial Users. As of the date of this Agreement, there are two (2)
Significant Industrial Users (SIU) which operate within Hurst's jurisdiction. These SIU's
are described in Exhibit "A" to this Agreement. This Agreement, and the charges contained
herein are for existing SIU's. Except as provided otherwise herein, if additional SIU's begin
operations within Hurst's jurisdiction after the execution date of this Agreement, Fort Worth
and Hurst agree to amend the Agreement to include any additional SIU's, or Fort Worth's
obligations hereunder shall be limited to the existing SIU's.
2. Services. Fort Worth agrees to perform the following basic services which are related to
Industrial Connection and Monitoring, Section 9 of the Wastewater Agreement, for Hurst.
A. With Hurst's representatives, conduct an annual inspection of all SILT facilities
within Hurst's jurisdiction.
B. Obtain a minimum of two (2) samples per year from the SIU's for analysis and
compliance with the Wastewater Agreement. Sampling and analysis shall be
according to the attached Exhibit "A."

C. Assist Hurst in conducting two (2) semi-annual reports of SIU's by providing forms
to Hurst to be forwarded to the SIU. Hurst shall be responsible for returning the
completed forms to Fort Worth.
D. Assist Hurst with an annual survey and permitting of new SIJ's within Hurst's
jurisdiction.
E. Assist Hurst in determining if new industries within Hurst's jurisdiction are required
to be permitted so as to comply with the Wastewater Agreement.
3. Cost of Services. Hurst agrees to pay Fort Worth for the basic services described in Exhibit
"A" and a monthly Customer Service Charge of $25.00. Fort Worth shall include these
charges in the monthly wastewater statement submitted to Hurst pursuant to the Agreement.
Hurst shall pay these charges at the time its wastewater statement is due.
4. Additional Services. Hurst agrees to pay Fort Worth for the following additional services:
A. Hurst agrees to pay Fort Worth an additional $100.00 per employee per day fee for
services provided to support and assist pretreatment related enforcement actions by
Hurst against noncompliant SIU's for such services requiring Fort Worth's
attendance at show cause hearings, administrative hearings, or meetings involving
enforcement actions.
B. Hurst agrees to provide Fort Worth with 96 hours' advance notice, in writing, if Fort
Worth's appearance and testimony in an enforcement action is required.
C. Anything beyond the scope of this Agreement will be at a cost per sample for the
listed parameters in Exhibit A.
Fort Worth shall include the charges for these Additional Services in the monthly
wastewater statement submitted to Hurst pursuant to the Wastewater Agreement. Hurst
agrees to pay the charges for these Additional Services at the time such statement is due.
5. Termination. This Agreement shall terminate on September 30, 2037, unless renewed in
accordance with the terms herein.
6. Renewal. Hurst may renew this Agreement on a yearly basis by giving Fort Worth at least
thirty (30) days prior written notice of its intent to renew. Within fifteen (15) days after
receipt of such notice, Fort Worth shall advise Hurst of any escalation in charges. Within
three (3) business days, Hurst shall confirm, in writing, that it agrees to the escalation of
the charges. Hurst's failure to notify Fort Worth will result in the termination of the
Agreement at the end of the then current term.
7. Nothing contained in this Agreement shall be construed as amending, limiting, or reducing
Hurst's obligations contained in the Wastewater Agreement.

FOR HURST PERMITTED SIUs
The cost for AZZ Galvanizing Hurst and GPS Paints would follow the same procedure as Fort
Worth's permitted industrial users. It includes sampling and analysis cost. Administration costs
for inspection, permitting and sampling are also included in the cost calculation. Sampling
events are held at six-month intervals unless alternative permit status is achieved.
