HomeMy WebLinkAbout28331-02-2026 - City Council - OrdinanceOrdinance No.28331-02-2026 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE TAX INCREMENT REINVESTMENT ZONE (TIRZ) — GENERAL CAPITAL FUND, IN THE AMOUNT OF $1,830,267.00, TRANSFERRED FROM THE TAX INCREMENT REINVESTMENT ZONE (TIRZ) #4 — SOUTHSIDE MEDICAL DISTRICT FUND, FOR THE PURPOSE OF FUNDING THE ROUND 6- COUNCIL DISTRICT 9 STREET REPAIR AND RECONSTRUCTION PROGRAM PROJECT (CITY PROJECT NO. 106012); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2025-2026 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Tax Increment Reinvestment Zone (TIRZ) — General Capital Fund in the amount of $1,830,267.00, transferred from the Tax Increment Reinvestment Zone (TIRZ) #4 — Southside Medical District Fund, for the purpose of funding the Round 6-Council District 9 Street Repair and Reconstruction Program project (City Project No. 106012). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion orjudgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize execution of a contract with Stabile & Winn, Inc., in the amount of $2,026,734.45, for Round Six of the Council District 9 Street Repair and Reconstruction Program and Near Southside Medical District Water and Sanitary Sewer Main Improvements projects on various streets (City Project No's 106012 and CO2445); 2. Accept funding in the amount of $2,000,000.00 from Tax Increment Reinvestment Zone No. 4 (Southside TIF) for the Street Repair and Reconstruction Program for a revised amount of $18,000,000.00; 3. Adopt the attached appropriation ordinance reallocating estimated receipts and appropriations in the Economic Development Department of the Tax Increment Reinvestment Zone (TIRZ) #4 — Southside Medical District Fund By decreasing appropriations in the General Operating & Maintenance category in the amount of $1,830,267.00, and increasing appropriations in the Transfer & Other category by the same amount, for the purpose of transferring to the Tax Increment Reinvestment Zone (TIRZ) — General Capital Fund for funding the Round 6-Council District 9 Street Repair and Reconstruction Program project (City Project No. 106012); 4. DISCUSSION: This Mayor and Council Communication (M&C) is to authorize a construction contract for Round Six of the Council District 9 Street Repair and Reconstruction Program and Near Southside Medical District Water and Sanitary Sewer Main Improvements projects on approximately 1.26 lane miles, on the following streets: Street .......... ....... On November 6, 2025, the following bids were received: Bidders Stabile & Winn, Inc. Amount Time of Completion 250 $2,026,734.45 Calendar Days lam J. Schultz Inc., ConstructionCmpanydba Circle C1$2,768,767.50 Stabile & Winn, Inc. has met the City's small business goal. Stabile & Winn, Inc. is a small business contractor and will self -perform the work, The Transportation & Public Works (TPW) Department's share of this contract is $1,520,266.45. The paving funds for this project are available in the TIRZ — General Capital (City Project No. 106012). The Water Department's share of this contract is $506,468.00 and will be available in the Water and Sewer Capital Projects Fund for the project (City Project No. CO2445). In addition to the contract amount, $212,155.55 (Water: $48,742.00; Sewer: $8,413.00, and Paving: $155,000.55) is required for project management, material testing, and inspection. $205,647.00 (Water: $42,922.00; Sewer: $7,725.00 and Paving: $155,000.00) is provided for project contingencies. This project will have no impact on the Transportation & Public Works' or the Water Department's operating budgets when completed. Approximately 571 linear feet of cast iron water pipe will be removed and replaced as part of this project. It is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year (FY), rather than within the annual budget ordinance, as projects commence, additional funding needs are identified, and it complies with bond covenants. Funding is currently available in the Transfer to Water/Sewer account of the Water & Sewer Fund and in the Tax Increment Reinvestment Zone (TIRZ) #4 — Southside Medical District Fund. I $18,067,067.00 $2,444,537.001$20,511,604.00 This M&C will increase the Tax Increment Reinvestment Zone No. 4 (Southside TIF) participation in this program in the amount of $2,000,000.00. These additional funds will help in closing the funding gap due to City and Southside TIF adding street segments to the project, as well as due to increased costs resulting from the complexity of urban street reconstruction and coordination with dozens of private developments. Funding for Round 6 of the program project was not included in the FY 2026-2030 Capital Improvement Program due to insufficient funding to complete the original scope. The actions in this M&C will amend the Transportation & Public Works FY2026-2030 Capital Improvement Program as approved in connection with Ordinance 27979-09-2025. The project is located in COUNCIL DISTRICT 9. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the TIRZ #4 - Southside Med Dist Fund and in the Water & Sewer Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the TIRZ - General Capital Fund for the Round 6 - CD9 St. Repair Progr project and in the W&S Capital Projects Fund for the Near South Side Med. Dist. W S project. Prior to any expenditure being incurred, the Transportation & Public Works and Water Departments have the responsibility to validate the availability of funds.
