HomeMy WebLinkAbout28298-02-2026 - City Council - OrdinanceOrdinance No. 28298-02-2026 AN ORDINANCE ADJUSTING APPROPRIATIONS IN THE 2022 BOND PROGRAM FUND, BY INCREASING APPROPRIATIONS IN THE US 287 AND E BERRY STREET GOVERNOR'S COMMUNITY ACHIEVEMENT AWARD PROJECT (CITY PROJECT NO. 106623) IN THE AMOUNT OF $300,000.00, AND DECREASING APPROPRIATIONS IN THE BERRY STREET CAPITAL IMPROVEMENTS PROJECT (CITY PROJECT NO. 104222) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2025-2026, as enacted by Ordinance 27979- 09-2025, as amended, is hereby further amended to make the following adjustments to appropriations in the 2022 Bond Program Fund, by increasing appropriations in the US 287 and E Berry Street Governor's Community Achievement Award project (City Project No. 106623) in the amount of $300,000.00, and decreasing appropriations in the Berry Street Capital Improvements project (City Project No. 104222) by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance adjusting appropriations in the 2022 Bond Program Fund, by increasing appropriations in the US 287 and E Berry Street Governor's Community Achievement Award project (City Project No. 106623) in the amount of $300,000.00, and decreasing appropriations in the Berry Street Capital Imps project (City Project No. 104222) by the same amount; and 2. Amend the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to appropriate funding in the amount of $300,000.00 for the US 287 and E Berry Street Governor's Community Achievement Award (GCAA) project (City Project No. 106623). The project aims to provide landscape improvements within the US 287 Right -of -Way at the intersection with Vaughn Boulevard and East Berry Street. The project is part of the City's effort to revitalize landscape areas along roadways. The GCAA grant improvements will install plants and landscaping materials along the banks of US 287 and in the existing islands at East Berry Street/Vaughn Boulevard. The project is located south of the US 287 and East Berry Street Green Ribbon Landscape project (City Project No. 105831), which is in the process of going to construction. A design contract proposal by Kimley-Horn and Associates, Inc., in the amount up to $72,000.00, is being considered by Transportation and Public Works (TPW). Project management costs are estimated not to exceed $228,000.00. TPW recommends using $300,000.00 of the Berry Street Capital Imps project funds to fund the US 287 and E Berry Street GCAA project. On August 15, 2017, as part of its Governor's Community Achievement Award (GCAA) Program, The Texas Department of Transportation (TxDOT) awarded the City funding in the amount of $310,000.00 for the construction of the US 287 and E Berry Street GCAA Project (City Project No. 106623). This award is preliminary, pending a signed Advanced Funding Agreement and Landscape Maintenance Agreement, for which the Transportation and Public Works Department (TPW) will seek subsequent approval from City Council to accept the award and execute the agreements. The grant requires the City to fund the design contract and any other related activities. The City bears the responsibility for paying cost overruns. Upon completion of the landscape improvements, the City will be responsible for maintenance, which will be memorialized by the execution of a Landscape Maintenance Agreement with TxDOT. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25765-08-2022) provides liquidity to support the appropriation. Available resources will be used to make any interim progress payments until the debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). Funding for this project was not included in the Fiscal Years 2026-2030 Capital Improvement Program (CIP) because the scope and funding needs were not identified at the time of CIP development. The actions in this M&C will amend the Fiscal Years 2026-2030 Capital Improvement Program as approved in connection with Ordinance 27979-09-2025. This project is located in COUNCIL DISTRICT 8. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Berry Street Capital Imps project within the 2022 Bond Program Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the 2022 Bond Program Fund for the US 287 and E Berry Street GCAA project. Prior to expenditures being incurred, the Transportation & Public Works Department has the responsibility to validate the availability of funds.
