A RESOLUTION DETERMINING THE NECESSITY FOR ACQUIRING REAL
PROPERTY AND AUTHORIZING ITS APPROPRIATION OR
CONDEMNATION FOR PUBLIC USE
WHEREAS, the Fort Worth City Council on March 10, 2026 in M&C 26-0192, ordered and
decreed that a public necessity existed to acquire 0.654 acres in permanent sanitary sewer easement and
0.192 acres in temporary construction easement from real property owned by Canary Properties LP,
located at 220 Redbird Lane, in the Cornelius Connelly Survey, Abstract No. 319, Tarrant County, Texas,
as described in the exhibits attached to the above -referenced M&C; those exhibits are incorporated herein
for all purposes (the "Property");
WHEREAS, the Fort Worth City Council has determined that:
- the Property is needed for the M199C Parallel SS Interceptor Project (the "Project");
- the land rights in the Property are needed for construction, operation, maintenance,
replacement, upgrade and repair of the permanent relief sewer main;
- public necessity required the acquisition by condemnation of the Property, located within the
alignment of the Project;
- the use of the Property will be a public use; and
- the Real Estate Division of the Property Management Department is authorized to acquire by
negotiation the Property needed for the Project.
WHEREAS, negotiations between the City of Fort Worth and the property owner, Canary
Properties LP, were unsuccessful due to the inability to negotiate agreeable terms for the property interest
being acquired by the City of Fort Worth; and
WHEREAS, on this 1 Oth day of March 2026, at a regular meeting of the Fort Worth City Council,
upon Motion of Councilmember Hill, to wit:
"I move that the Fort Worth City Council adopt the resolution authorizing use of the power of
eminent domain to acquire 0.654 acres in permanent sanitary sewer easement and 0.192 acres in temporary
construction easement from real property owned by Canary Properties LP. The property interest is needed
for a public use, the M199C Parallel SS Interceptor project, for easements to construct a relief sewer main.
The property is located at 220 Redbird Lane in the Cornelius Connelly Survey, Tract No. 319, Tarrant
County, Texas. The property interest to be acquired is described by metes and bounds and depicted by
survey exhibits attached to this Mayor and Council Communication."
Seconded by Councilmember Crain, duly put and carried: RESOLUTION.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS THAT:
The City of Fort Worth, Texas, is authorized to use the power of eminent domain to acquire the
Property for the public use and inclusion in the Project; and
The City Attorney be and is hereby authorized and directed to file or cause to be filed, to spend all
reasonable and necessary legal expenses, and to carry through to final judgment proceedings in eminent
domain for the acquisition of the property interest listed above and attached to the M&C.

No. D206263900 and Instrument No. D206263901 of the Official Public Records of Tarrant
County, Texas, said 18.331 acre tract of land being a portion of Blocks 16, 17, 22, 23, 27 and 28
of N. H. Carroll Survey & C. C. Connelly Survey Subdivision to Tarrant County, Texas, as
recorded in Volume 755, Page 233 of the Deed Records of Tarrant County, Texas, said
temporary construction easement being more particularly described by metes and bounds as
follows:
COMMENCING at a 5/8 inch iron rod (control monument) found for the northwest corner of
said 18.331 acre tract of land, said 5/8 inch iron rod being the southwest corner of a 6.86 acre
tract of land (by deed) deeded to Tarrant County Water Control and Improvement District
Number One as recorded in Volume 4221, Page 77 of said Deed Records of Tarrant County,
Texas, said 5/8 inch iron rod being in the east right-of-way line of Redbird Lane (30.0' width
right-of-way), said 5/8 inch iron rod being in the south line of a 20.0' Permanent Sanitary Sewer
Easement granted to the City of Westworth Village, Texas as recorded in Volume 15499, Page
51 of said Deed Records of Tarrant County, Texas, said 5/8 inch iron rod also being the
northwest corner of a proposed Permanent Sewer Facility Easement, from which a 5/8 inch iron
rod (control monument) found for a corner in the northwesterly line of said 18.331 acre tract of
land bears North 80 degrees 49 minutes 57 seconds East, a distance of 209.70 feet, said 5/8 inch
iron rod being a corner in the southeasterly line of said 6.86 acre tract of land; THENCE South
00 degrees 35 minutes 03 seconds East, with the west line of said 18.331 acre tract of land, with
the west line of said proposed Permanent Sewer Facility Easement and with the east right-of-way
line of said Redbird Lane, a distance of 36.50 feet to a point for the southwest corner of said

RECOMMENDATION:
It is recommended that the City Council:
1. Declare that negotiations between the City of Fort Worth and the property owner to acquire 0.654 acres in permanent sanitary sewer
easement and 0.192 acres in temporary construction easement from real property owned by Canary Properties LP, located at 220 Redbird
Lane, in the Cornelius Connelly Survey, Abstract No. 319, Tarrant County, Texas, were unsuccessful due to the inability to
negotiate agreeable terms for the property interest being acquired by the City;
2. Declare the necessity to acquire the described property interest for the M199C Parallel SS Interceptor project (City Project No. 100836);
3. Adopt the attached resolution authorizing the City of Fort Worth to use its power of eminent domain to acquire the property for public use;
4. Authorize the City Attorney to institute condemnation by eminent domain proceedings to acquire the described property interest from the
property owner;
5. Authorize a payment pursuant to an award of commissioners or a negotiated settlement; and
6. Authorize the City Manager or his designee to accept and record the appropriate instruments.
DISCUSSION:
The property interest is needed for a public use, the construction of the M199C Parallel SS Interceptor project, for easements to construct a 48-
inch diameter relief sewer main parallel to the existing 30-inch diameter sewer main on the west side of Fort Worth. The existing 30-inch diameter
sewer main is inadequately sized to convey sewage flow from new development and growth on the west side of Fort Worth. The easement is
needed for the construction, operation, and maintenance of the sewer main.
An independent appraisal established fair market value for the property interest (shown below) in the total amount of $175,024.00. Negotiations
were unsuccessful due to the inability to negotiate agreeable terms for the property interest being acquired by the City.
Upon approval, a condemnation action will be brought and a Special Commissioners' hearing held to acquire the permanent sanitary sewer
easement interest on the property.

FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the Water & Sewer Bond
2020A Fund for the M 199C Parallel SS Interceptor project to support the approval of the above recommendations and the acquisition of land. Prior
to any expenditure being incurred, the Water Department has the responsibility to validate the availability of funds.
