HomeMy WebLinkAbout28321-02-2026 - Ethics Review Commission - OrdinanceOrdinance No. 28321-02-2026 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE CRIME CONTROL AND PREVENTION DISTRICT CAPITAL PROJECTS FUND, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STOCKYARDS TRAFFIC SAFETY IMPROVEMENTS PROJECT (CITY PROJECT NO.106626) IN THE AMOUNT OF $250,000.00 AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE FACILITY RENOVATION/EXPANSION — POLICE PROGRAMMABLE PROJECT (CITY PROJECT NO. P00050) BY THE SAME AMOUNT, FOR THE PURPOSE OF CONVERTING TO A STATIC PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2025-2026, as enacted by Ordinance 27979-09- 2025, as amended, is hereby further amended to make the following adjustments to estimated receipts and appropriations in the Crime Control and Prevention District Capital Projects Fund, by increasing estimated receipts and appropriations in the Stockyards Traffic Safety Improvements project (City Project No. 106626) in the amount of $250,000.00 and decreasing estimated receipts and appropriations in the Facility Renovation/Expansion — Police programmable project (City Project No. P00050) by the same amount, for the purpose of converting to a static project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Crime Control and Prevention District Capital Projects Fund, by increasing estimated receipts and appropriations in the in the Stockyards Traffic Safety Improvements project (City Project No. 106626) in the amount of $250,000.00 and decreasing estimated receipts and a appropriations in the Facility Renovation/Expansion — Police programmable project (P00050) by the same amount, for the purpose of converting to a static project; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the General Capital Projects Fund, in the amount of $610,000.00, from available Transfer from General within the Unspecified -All Funds project (City Project No. UNSPEC), for the purpose of funding the Stockyards Traffic Safety Improvements project (City Project No. 106626); 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Public Events Capital Fund, in the amount of $250,000.00, from available Transfer From Culture and Tourism Hotel Funds within the Unspecified-Cowtown Coliseum project (City Project No. UNSPCC), for the purpose of funding the Stockyards Traffic Safety Improvements project (City Project No. 106626); and 4. Amend the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to appropriate funding in the amount of $860,000.00 for the Stockyards Traffic Safety Improvements project (City Project No. 106626). The objective of the project is to enhance traffic safety within the Stockyards area, specifically along East Exchange Avenue from North Houston Street to Packers Avenue, through the installation of traffic bollards. A design contract with Dunaway Associates LLC, in the amount of $98,085.00, (CSC No. 63825 Task Order No. 1) was administratively authorized on December 18, 2025. Approval of Recommendation 1 will adjust appropriations between a programmable project (City Project No. P00050) and convert the Stockyards Traffic Safety Improvements project (City Project No. 106626) into a static capital project. This action is needed as funding for Stockyards Traffic Safety Improvements project (City Project No. 106626) is from other sources and the scope of this project differs from that of the current programmable project. The actions in this M&C will amend the Fiscal Years 2026-2030 Capital Improvement Program as approved in connection with Ordinance 27979-09-2025. Funding is budgeted in the General Capital Projects Fund, the CCPD Capital Projects Fund and the Public Events Capital Fund for the TPW Department for the purpose of funding the Stockyards Traffic Safety Improvement project. This project is located in COUNCIL DISTRICT 2. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Facility Renovation/Exp - Poli project within the CCPD Capital Projects Fund, the UNSPEC project within the General Capital Projects Fund and in UNSPCC project within the Public Events Capital Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the Stockyards Traffic Safety Impr project. Prior to an expenditure being incurred, the Transportation & Public Works Department has the responsibility of verifying the availability of funds.
