HomeMy WebLinkAbout063071-A2R1 - General - Contract - EnviroQuestCITY SECRETARY CONTRACT NO.: 63071-A2 R 1 SECOND AMENDMENT AND FIRST RENEWAL TO CITY OF FORT WORTH CITY SECRETARY CONTRACT No. 63071-A1 This Second Amendment and First Renewal is entered into by and between the CITY OF FORT WORTH (hereafter "City"), and EnviroQuest ("Vendor"). City and Vendor may be referred to individually as a Parry and collectively as the Parties. WHEREAS, on May 1, 2025, the Parties entered into City Secretary Contract No. 63071 for City to perform Lead -Based Paint Inspection/Risk Assessment services for residential housing units for implementation of the City's LeadSafe Program, Priority Repair Program, and Housing Rehabilitation and Repair Program on an as -needed basis. ("Agreement"); WHEREAS, it is the collective desire of both City and Vendor to amend the Agreement to update exhibit B with current insurance premium pricing; and. WHEREAS, it is the collective desire of both City and Vendor to renew the Agreement, as amended, for an additional one year term.; NOW, THEREFORE, the Parties, acting herein by and through their duly authorized representatives, enter into the following agreement: I. AMENDMENT TO AGREEMENT The following terms are hereby amended to either replace any conflicting terms in the Agreement or shall be added to the terms and shall be binding and enforceable as if they were originally included therein and the amended agreement shall be referred to as the Agreement in all future documents: I. Exhibit B, is hereby deleted in its entirety and replaced with the attached Exhibit B. II. RENEWAL OF AGREEMENT The Agreement, as amended herein, is hereby renewed for its Second Renewal Term, which shall begin May 1, 2026 and end on April 30, 2027. M. ALL OTHER TERMS SHALL REMAIN THE SAME All other provisions of the Agreement which are not expressly amended herein shall remain in full force and effect. OFFICIAL RECORD CITY SECRETARY FT. WORTH, TX Second Amendment and Second Renewal to Fort Worth City Secretary Contract No. 63071-A1 Page 3 of 4 CITY SECRETARY CONTRACT NO.: EXHIBIT B AMENDED FEE SCHEDULE Service and Fee per Inspection 1) Lead Inspection and Risk Assessment is to be performed within 21 working days from issuance of assignment with reports delivered to CFW Lead Safe Program within 10 workings days of inspection. Samples will be collected and shipped by contractor. CFW will be responsible for lab fees. Fee Per Inspection: $1,062.00 2) Healthy Homes Inspections will be conducted by qualified personnel to address the 29 hazards identified by the Healthy Homes Rating System. Average inspection time estimated to be 1-2 hours. Training will be paid for by the City of Fort Worth Lead -Safe Program. Travel and accommodations for training will be the responsibility of the Contractor. Fee Per Inspection: $250.00 Insurance Premium Reimbursement Vendor will invoice and bill for the following annual insurance premiums to be split equally in first 12 consecutive invoices issued after incurring the premiums. Annual insurance premiums must be billed in the same coverage year as premiums incurred. Coverage to be included is listed as follows: 1) Commercial General Liability - $1,000,000 - Each Occurrence $2,000,000 — Aggregate Total fee for annual coverage: $425.00 2) Professional Liability (Errors & Omissions)-$1,000,000 - Each Claim Limit $1,000,000 - Aggregate Limit Total fee for annual coverage: $1,438.04 Second Amendment and Second Renewal to Fort Worth City Secretary Contract No. 63071-A1 Page 4 of 4 FORT WORTH.
