HomeMy WebLinkAbout28144-12-2025 - City Council - OrdinanceOrdinance No. 28144-12-2025 AN ORDINANCE REALLOCATING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE FORT WORTH PUBLIC IMPROVEMENT DISTRICT 7 - HERITAGE FUND BY DECREASING APPROPRIATIONS IN THE GENERAL OPERATING AND MAINTENANCE CATEGORY BY $500,000.00, AND INCREASING APPROPRIATIONS IN THE TRANSFERS & OTHER CATEGORY BY THE SAME AMOUNT, FOR A TRANSFER TO THE GENERAL CAPITAL PROJECTS FUND FOR THE EXPOSITION WAY SLOPE STABILIZATION PROJECT (CITY PROJECT NO. 105816); PROVIDING FOR A SEVERABILITY CLAUSE; MAIQNG THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2025-2026, as enacted by Ordinance 27979-09- 2025, as amended, is hereby further amended to make the following reallocations to the Fort Worth Public Improvement District 7 - Heritage Fund by decreasing appropriations in the General Operating and Maintenance category by $500,000.00, and increasing appropriations in the Transfers & Other category by the same amount, for a transfer to the General Capital Projects Fund for the Exposition Way Slope Stabilization project (City Project No. 105816). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion orjudgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27979-09-2025, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached ordinance reallocating estimated receipts and appropriations in the Fort Worth Public Improvement District 7 - Heritage Fund by decreasing appropriations in the General Operating and Maintenance category by $500,000.00, and increasing estimated receipts and appropriations in the Transfers & Other category by the same amount, for a transfer to the General Capital Projects Fund for the Exposition Way Slope Stabilization project (City Project No.105816); 2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the General Capital Projects Fund as follows: (i) decrease the Contract Street Maintenance programmable project (P00020) by $100,000.00, and (ii) increase the Exposition Way Slope Stabilization project (City Project No.105816) by $600,000.00, consisting of $500,000.00 transferred from the Fort Worth Public Improvement District 7 - Heritage Fund and $100,000.00 converted from the programmable project, for the purpose of establishing the Exposition Way Slope Stabilization as a static project; 3. Authorize acquisition of a public access and slope easement from Heritage Homeowners Association, Inc. for the Exposition Way Slope Stabilization project; and 4. Amend Fiscal Year 2026 Adopted Budget and the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to facilitate a slope stabilization project on Exposition Way from Ellison Street to Mirage Drive by (i) adopting appropriation ordinances necessary to transfer money from the Fort Worth Public Improvement District 7 - Heritage Fund and to reallocate funds from a street maintenance programmable into a static project in the General Capital Projects Fund for design and construction and (ii) authorizing acquisition of easement rights for the project from Heritage Homeowners Association, Inc. in return for the facilitation of the slope stabilization project. The portion of Exposition Way between Ellison Street and Mirage Way is in need of repair, but that road work is not feasible without first addressing the significant erosion and slope failure on the abutting property owned by Heritage Homeowners Association, Inc. The budget for Public Improvement District 7 - Heritage (PID) includes $500,000.00 in funding for the slope stabilization project. Approval of the first recommendation and adoption of the associated ordinance would reallocate those operating dollars for a transfer to the General Capital Projects Fund. Adoption of the second recommendation and its ordinance would appropriate those transferred funds to a new static project and reallocate $100,000.00 in previously appropriated funds from a street maintenance programmable as well. As a result, a total of $600,000.00 would be available to address the erosion and slope failure and undertake drainage improvements to prevent and convey stormwater, reducing runoff impacts on the pavement and adjacent properties and making the road repairs feasible. Approval of this M&C also authorizes acquisition of necessary easement rights from Heritage Homeowners Association, Inc. in return for the City remediating the erosion and slope failures. These rights will allow the City to undertake the PID-funded slope repairs and give the City the right, but not the obligation, to re-enter the homeowners association property if further maintenance or repair to the slope is needed. Funding for any such future repair or maintenance would need to be identified at that time, with an expectation that the PID may again be asked to contribute in light of the benefit to the assessment payers in the district. The $100,000.00 for the programmable project (City Project No. P00020) was included in the FY2026-2030 Capital Improvement Program (CIP) for the year 2026, but the $500,000.00 from the PID for the slope stabilization project was not included in the CIP because the project need and funding source wasn't known at the time of its development. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the FWPID # 7 - Heritage Fund and General Capital Projects Fund, and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the General Capital Projects Fund for the Exposition Way Slope Stabiliza project. Prior to an expenditure being incurred, the Transportation and Public Works Department has the responsibility of verifying the availability of funds.
