COUNTY OF TARRANT
INTERLOCAL AGREEMENT
This Agreement is made and entered into this c 7 day of `1'2i-
1999, by and between the County of Tarrant, acting herein by and through it6tgoverning
body, the Commissioners Court, hereinafter referred to as COUNTY, and the City of Fort
Worth, acting herein by and through Mike Groomer, its duly authorized Assistant City
Manager, hereinafter referred to as CITY, both of Tarrant County, State of Texas,
witnesseth:
WHEREAS, this Agreement is made under the authority of Sections 791.001-
791.029, Texas Government Code; and
WHEREAS, each governing body, in performing governmental functions or in
paying for the performance of governmental functions hereunder, shall make that
performance or those payments from current revenues legally available to that party; and
WHEREAS, each governing body finds that the subject of this Agreement is
necessary for the benefit of the public and each has the legal authority to perform and to
provide the governmental function or service which is the subject matter of this
Agreement; and
WHEREAS, each governing body finds that the performance of this Agreement is
in the common interest of both parties and that the division of costs fairly compensates
the performing party for the services or functions under this Agreement; and
WHEREAS, each governing body agrees to share in the cost of the services
described below.
NOW THEREFORE, the COUNTY and CITY agree as follows:
1.
The COUNTY agrees to provide the labor and equipment necessary to: (a)
reconstruct South Norwood Drive from the concrete pavement, adjacent to Bell
Helicopter, North to Hurst Boulevard, for a distance of approximately 1600 feet in
length. The construction will include: reclaiming the existing s "

of material, stabilization of the sub -grade, application of 3" of HMAC binder and
resurfacing with 2" of HMAC; and, (b) reconstruct the City's portion of Wall Price
Keller Road, approximately 1000 feet in length. This work will include reclaiming the
existing surface, lime stabilization and application of a 2 course chip seal surface.

The CITY agrees, at its sole option, to either deliver to COUNTY all of the
materials necessary and required for the reconstruction of the roads, as described in
paragraph 1 of this agreement, or to pay for the actual cost of the materials as incurred by
the COUNTY. The value of the materials for the reconstruction of South Norwood shall
not exceed $48,000. The value of the materials for the reconstruction of Wall Price
Keller shall not exceed $5,500.
3.
The CITY agrees to the closing of the road for through traffic for the duration of
the project or as deemed necessary by the COUNTY.
4.
Nothing in the performance of this Agreement shall impose any liability for
claims against the COUNTY other than claims for which liability may be imposed by the,
Texas Tort Claims Act.

The parties to the Agreement do not intend for any third party to obtain a right by virtue
of this Agreement.
7.
By entering into this Agreement, the parties do not intend to create any
obligations express or implied other than those set out herein; further, this Agreement
shall not create any rights in any party not a signatory hereto.
8.
This Agreement shall terminate on completion of the subject matter of this
contract or on the conclusion of the COUNTY'S fiscal year, unless renewed for a period
of one year in written notice signed by both parties.

SUBJECT INTERLOCAL AGREEMENT WITH TARRANT COUNTY FOR THE RECONSTRUCTION
OF 1600 FEET OF SOUTH NORWOOD DRIVE ADJACENT TO BELL HELICOPTER
AND 1000 FEET OF WALL PRICE KELLER ROAD WITHIN THE CITY OF FORT WORTH
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute an interlocal agreement
with Tarrant County for the reconstruction of 1600 feet of South Norwood Drive adjacent to Bell
Helicopter and 1000 feet of Wall Price Keller Road within the City of Fort Worth at a total cost to the
City not to exceed $48,000 for South Norwood Drive and $5,500 for Wall Price Keller.
DISCUSSION:
Tarrant County has submitted an interlocal agreement to reconstruct South Norwood Drive from the
concrete pavement adjacent to Bell Helicopter north to Hurst Boulevard for a distance of approximately
1600 feet in length. The agreement also includes reconstruction of the City's portion of Wall Price
Keller Road, which is approximately 1000 feet in length. Under this agreement the City agrees, at its
sole option, to either deliver to the County all of the materials necessary and required for reconstruction
of the roads, or to pay for the actual cost of the materials as incurred by the County. The value of the
materials for the reconstruction of South Norwood shall not exceed $48,000. The value of the materials
for the reconstruction of Wall Price Keller shall not exceed $5,500. The City agrees to the closing of the

This project is located in COUNCIL DISTRICTS 4 and 5, Mapsco 53X and 22V.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current capital budget, as appropriated, of
the Contract Street Maintenance Fund.
