FOR VILLAGE CREEK WASTEWATER TREATMENT PLANT ADDITION OF DIGESTER GAS FUELED ENGINE/GENERATORS PROJECT NO. PS 46-070460300130 STATE OF TEXAS COUNTY OF TARRANT WHEREAS, on July 14, 1998, the City of Fort Worth, the "City," and Multatech Engineering, Inc., the "Engineer," made and entered into City Secretary Contract No. 24223, which was duly authorized by the City Council by M&C C-16891 on July 14, 1998, and WHEREAS, the "City" and "Engineer" desire to amend City Secretary Contract No. 24223. NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That the City of Fort Worth, a municipal corporation situated in Tarrant County, Texas, acting herein by and through its duly authorized City Manager, hereinafter called "City," and Multatech Engineering, Inc., acting herein by and through its duly authorized President, hereinafter called "Engineer," hereby make and enter into the following agreement: ARTICLE VII - ATTACHMENTS, SCHEDULES AND SIGNATURES A. Exhibit "A-2" — Air Permitting Scope of Work, pages 1-2 is hereby amended to expand the scope of services as follows: "Activity 6: Continued Assistance with New Source Review Permit for Energy Recovery Project. Activity 7: Evaluation of Feasibility of Emission Credit Banking for NOx Emissions. (Note: Application and paperwork to obtain emission credits would require additional fees if the City elects to pursue emission credits.) Complete Potentially Applicable Requirement Form. 5. Perform Compliance Review and Complete Compliance and Reporting Forms. 6. Put Additional Information on Plot Plan and Develop Overall Process Flow Diagram. 7. Meetings" B. Exhibit "B" Compensation is hereby amended by increasing the not -to -exceed fee by Thirty-seven Thousand Eight Hundred Eighty-four Dollars ($37,884.00) so that Paragraph "D" reads as follows: "D. Payments for expenses, costs and services as described in Attachment "A," Exhibits "A-1" and "A-2" shall not exceed Five Hundred Sixty-three Thousand Five Hundred Forty-five Dollars ($563,545)." C. FOR DESIGN AND CONSTRUCTION MANAGEMENT OF THE ADDITION OF A DIGESTER GAS FIRED ENGINE/GENERATOR AT THE VILLAGE CREEK WASTEWATER TREATMENT PLANT RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 to an engineering agreement with Multatech Engineering, Inc., City Secretary Contract No. 24223, for design and construction management of the addition of a digester gas fired engine/generator at the Village Creek Wastewater Treatment Plant (VCWTP), increasing the total fee by $37,884 for a total of $563,545. DISCUSSION: On July 14, 1998 (M&C C-16891), the City Council authorized the execution of an engineering agreement with Multatech Engineering, Inc. for design -and -construction management of the addition of a digester gas fired engine/generator at the VCWTP for a total fee not to exceed $525,661. The original contract included development of contract documents for installation of the new VCWTP engine/generator and all required modifications to existing plant facilities, assisting the City in developing lease/purchase procurement contracts for the additional VCWTP engine/generator project as necessary, and coordination with the Texas Natural Resource Conservation Commission (TNRCC) on VCWTP air permitting issues. The proposed Amendment No. 1 is for the engineer to assist the City with additional air -permitting issues including response to TNRCC requests on the New Source Review Permit application, evaluation of the feasibility of emission credit banking for nitrogen oxide emissions, and preparation of a Federal Title V Operating Permit application for the VCWTP. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the Commercial Paper -Sewer Fund.
