(No M&C Needed) COUNTY OF TARRANT 6 WHEREAS, the City of Fort Worth (City) and Veatch, L.L.P., (Engineer) made and entered into City Secretary Contract No. 22869, (the Contract) which was authorized by the City Council by M&C C-16111 on the 17th day of June 1997; WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of Sanitary Sewer Main 106R Drainage Area Sanitary Sewer System Rehabilitation and Sewer System Improvements (Group 4, Contract 2), Part 3. WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated May 14, 1999, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $5,857.00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $618,527.00. One contractor was low bidder on all three units and was recommend for contract award. The contractor's M/WBE participation and good faith efforts were unacceptable and the bids were being rejected. This request for contract amendment is to provide additional plans and specification, document modifications, and bidding assistance for the rebidding of the project. The plans and specifications were prepared to schedule work regarding property rights and railroad permits being obtained. Most property rights and railroad permit have been obtained and required changes to the plans and specifications. The plans and specifications were updated with new notice to bidders and the previous addendum was incorporated into the documents. DATE: May 20, 1999 RE: AMENDMENT NO. 1 TO SANITARY SEWER MAIN 106R DRAINAGE AREA REHABILITATION AND SEWER SYSTEM IMPROVEMENTS (GROUP 4, CONTRACT 2), PART 3, SEWER PROJECT NO. PS46- 070460410150 The proposed amendment will reimburse Black and Veatch, L.L.P., for the additional services that were provided on the project as requested by the City. Subsequent to the receipt of bids for this project on Part 9 of this project, it was deter- mined that the low bidder was in non-compliance with the City's M/WBE specifications. It was therefore necessary to reprint the project plans and readvertise the project for bids. Black and Veatch has requested a fee of $5,857.00 for the additional services that were provided thereby increasing the contract fee from $612,670.00 to $618,527.00. I believe this fee is reasonable for the additional services to be provided. Please authorize this additional design fee by your signatures on the attached contract amendment form.
