VENDOR SERVICES AGREEMENT
This VENDOR SERVICES AGREEMENT ("Agreement") is made and entered into by and between
the CITY OF FORT WORTH ("City"), a Texas home rule municipal corporation, acting by and
through its duly authorized Assistant City Manager, and Parker County Media Inc. ("Vendor"), a Texas
corporation and acting by and through its duly authorized representative, each individually referred to as a
"party" and collectively referred to as the "parties."
1. Scope of Services. Provide publishing of election notices for City of Fort Worth
Elections ("Services"), which are set forth in more detail in Exhibit "A," attached hereto and incorporated
herein for all purposes.
2. Term. The initial term of this Agreement is for 1 year beginning on April 2, 2026
("Effective Date"), unless terminated earlier in accordance with this Agreement ("Initial Term"). City will
have the option, in its sole discretion, to renew this Agreement under the same terms and conditions, for up
to 3 one-year renewal option(s) (each a "Renewal Term").
3. Compensation.
3.1 Total compensation under this Agreement will not exceed $20,101.25 Dollars
(Twenty -Thousand One -Hundred and One Dollars and Twenty -Five Cents).
3.2 City will pay Vendor in accordance with the Prompt Payment Act (Chapter 2251
of the Texas Government Code) and provisions of this Agreement, including Exhibit `B,"
which is attached hereto and incorporated herein for all purposes.
3.3 Vendor will not perform any additional services or bill for expenses incurred for
City not specified by this Agreement unless City requests and approves in writing the
additional costs for such services. City will not be liable for any additional expenses of
Vendor not specified by this Agreement unless City first approves such expenses in
writing.
4. Termination.
4.1. Written Notice. City or Vendor may terminate this Agreement at any time and for
any reason by providing the other party with 30 days' written notice of termination.
4.2 Non -appropriation of Funds. In the event no funds or insufficient funds are
appropriated by City in any fiscal period for any payments due hereunder, City will notify Vendor
of such occurrence and this Agreement will terminate on the last day of the fiscal period for which
appropriations were received without penalty or expense to City of any kind whatsoever, except as
to the portions of the payments herein agreed upon for which funds have been appropriated.

4.3 Duties and Obligations of the Parties. In the event that this Agreement is
terminated prior to the Expiration Date, City will pay Vendor for services actually rendered up to
the effective date of termination and Vendor will continue to provide City with services requested
by City and in accordance with this Agreement up to the effective date of termination. Upon
termination of this Agreement for any reason, Vendor will provide City with copies of all
completed or partially completed documents prepared under this Agreement. In the event Vendor
has received access to City Information or data as a requirement to perform services hereunder,
Vendor will return all City provided data to City in a machine readable format or other format
deemed acceptable to City.
5. Disclosure of Conflicts and Confidential Information.
5.1 Disclosure of Conflicts. Vendor hereby warrants to City that Vendor has made full
disclosure in writing of any existing or potential conflicts of interest related to Vendor's services
under this Agreement. In the event that any conflicts of interest arise after the Effective Date of this
Agreement, Vendor hereby agrees immediately to make full disclosure to City in writing.
5.2 Confidential Information. Vendor, for itself and its officers, agents and employees,
agrees that it will treat all information provided to it by City ("City Information") as confidential
and will not disclose any such information to a third party without the prior written approval of
City.
5.3 Public Information Act. City is a government entity under the laws of the State of
Texas and all documents held or maintained by City are subject to disclosure under the Texas Public
Information Act. In the event there is a request for information marked Confidential or Proprietary,
City will promptly notify Vendor. It will be the responsibility of Vendor to submit reasons objecting
to disclosure. A determination on whether such reasons are sufficient will not be decided by City,
but by the Office of the Attorney General of the State of Texas or by a court of competent
jurisdiction.
5.4 Unauthorized Access. Vendor must store and maintain City Information in a secure
manner and will not allow unauthorized users to access, modify, delete or otherwise corrupt City
Information in any way. Vendor must notify City immediately if the security or integrity of any
City Information has been compromised or is believed to have been compromised, in which event,
Vendor will, in good faith, use all commercially reasonable efforts to cooperate with City in
identifying what information has been accessed by unauthorized means and will fully cooperate
with City to protect such City Information from further unauthorized disclosure.
6. Right to Audit. Vendor agrees that City will, until the expiration of three (3) years after
final payment under this Agreement, or the final conclusion of any audit commenced during the said three
years, have access to and the right to examine at reasonable times any directly pertinent books, documents,
papers and records, including, but not limited to, all electronic records, of Vendor involving transactions
relating to this Agreement at no additional cost to City. Vendor agrees that City will have access during
normal working hours to all necessary Vendor facilities and will be provided adequate and appropriate work
space in order to conduct audits in compliance with the provisions of this section. City will give Vendor
reasonable advance notice of intended audits.
7. Independent Contractor. It is expressly understood and agreed that Vendor will operate
as an independent contractor as to all rights and privileges and work performed under this Agreement, and

not as agent, representative or employee of City. Subject to and in accordance with the conditions and
provisions of this Agreement, Vendor will have the exclusive right to control the details of its operations
and activities and be solely responsible for the acts and omissions of its officers, agents, servants,
employees, Vendors, and subcontractors. Vendor acknowledges that the doctrine of respondeat superior
will not apply as between City, its officers, agents, servants and employees, and Vendor, its officers, agents,
employees, servants, contractors, and subcontractors. Vendor further agrees that nothing herein will be
construed as the creation of a partnership or joint enterprise between City and Vendor. It is further
understood that City will in no way be considered a Co -employer or a Joint employer of Vendor or any
officers, agents, servants, employees, contractors, or subcontractors. Neither Vendor, nor any officers,
agents, servants, employees, contractors, or subcontractors of Vendor will be entitled to any employment
benefits from City. Vendor will be responsible and liable for any and all payment and reporting of taxes on
behalf of itself, and any of its officers, agents, servants, employees, or contractors.
Liability and Indemnification.
8.1 LIABILITY - VENDOR WILL BE LIABLE AND RESPONSIBLE FOR ANY
AND ALL PROPERTY LOSS, PROPERTY DAMAGE AND PERSONAL INJURY,
INCLUDING, INCLUDING, BUT NOT LIMITED TO, DEATH, TO ANY AND ALL
PERSONS, OF ANY KIND OR CHARACTER, WHETHER REAL OR ASSERTED, TO THE
EXTENT CAUSED BY THE NEGLIGENT ACT(S) OR OMISSION(S), MALFEASANCE OR
INTENTIONAL MISCONDUCT OF VENDOR, ITS OFFICERS, REPRESENTATIVES,
AGENTS, SERVANTS, EMPLOYEES, CONTRACTORS, OR SUBCONTRACTORS.
8.2 GENERAL INDEMNIFICATION -VENDOR HEREBY COVENANTS AND
AGREES TO INDEMNIFY, HOLD HARMLESS, AND DEFEND CITY, ITS OFFICERS,
AGENTS, REPRESENTATIVES, SERVANTS, AND EMPLOYEES, FROM AND AGAINST
ANY AND ALL CLAIMS OR LAWSUITS OF ANY KIND OR CHARACTER, WHETHER
REAL OR ASSERTED, FOR EITHER PROPERTY DAMAGE OR LOSS (INCLUDING
ALLEGED DAMAGE OR LOSS TO VENDOR'S BUSINESS AND ANY RESULTING LOST
PROFITS) AND PERSONAL INJURY, INCLUDING, BUT NOT LIMITED TO, DEATH, TO
ANY AND ALL PERSONS, ARISING OUT OF OR IN CONNECTION WITH THIS
AGREEMENT, TO THE EXTENT CAUSED BY THE NEGLIGENT ACTS OR OMISSIONS
OR MALFEASANCE OF VENDOR, ITS OFFICERS, AGENTS, REPREENTATIVES,
SERVANTS, EMPLOYEES, CONTRACTORS, OR SUBCONTRACTORS.
8.3 INTELLECTUAL PROPERTY INDEMNIFICATION — Vendor agrees to
defend, settle, or pay, at its own cost and expense, any claim or action against City for
infringement of any patent, copyright, trade mark, trade secret, or similar property right
arising from City's use of the software or documentation in accordance with this Agreement,
it being understood that this agreement to defend, settle or pay will not apply if City modifies
or misuses the software and/or documentation. So long as Vendor bears the cost and expense
of payment for claims or actions against City pursuant to this section, Vendor will have the
right to conduct the defense of any such claim or action and all negotiations for its settlement
or compromise and to settle or compromise any such claim; however, City will have the right
to fully participate in any and all such settlement, negotiations, or lawsuit as necessary to
protect City's interest, and City agrees to cooperate with Vendor in doing so. In the event
City, for whatever reason, assumes the responsibility for payment of costs and expenses for
any claim or action brought against City for infringement arising under this Agreement, City
will have the sole right to conduct the defense of any such claim or action and all negotiations
for its settlement or compromise and to settle or compromise any such claim; however,

Vendor will fully participate and cooperate with City in defense of such claim or action.
City agrees to give Vendor timely written notice of any such claim or action, with copies of
all papers City may receive relating thereto. Notwithstanding the foregoing, City's
assumption of payment of costs or expenses will not eliminate Vendor's duty to indemnify
City under this Agreement. If the software and/or documentation or any part thereof is held
to infringe and the use thereof is enjoined or restrained or, if as a result of a settlement or
compromise, such use is materially adversely restricted, Vendor will, at its own expense and
as City's sole remedy, either: (a) procure for City the right to continue to use the software
and/or documentation; or (b) modify the software and/or documentation to make it non -
infringing, provided that such modification does not materially adversely affect
City's authorized use of the software and/or documentation; or (c) replace the software and
documentation with equally suitable, compatible, and functionally equivalent non -infringing
software and documentation at no additional charge to City; or (d) if none of the foregoing
alternatives is reasonably available to Vendor terminate this Agreement, and refund all
amounts paid to Vendor by City, subsequent to which termination City may seek any and all
remedies available to City under law.
Assignment and Subcontracting.
9.1 Assigm-nent. Vendor will not assign or subcontract any of its duties, obligations
or rights under this Agreement without the prior written consent of City. If City grants consent to
an assignment, the assignee will execute a written agreement with City and Vendor under which
the assignee agrees to be bound by the duties and obligations of Vendor under this Agreement.
Vendor will be liable for all obligations of Vendor under this Agreement prior to the effective date
of the assignment.
9.2 Subcontract. If City grants consent to a subcontract, the subcontractor will execute
a written agreement with Vendor referencing this Agreement under which subcontractor agrees to
be bound by the duties and obligations of Vendor under this Agreement as such duties and
obligations may apply. Vendor must provide City with a fully executed copy of any such
subcontract.
10. Insurance. Vendor must provide City with certificate(s) of insurance documenting
policies of the following types and minimum coverage limits that are to be in effect prior to commencement
of any Services pursuant to this Agreement:
10.1 Coverage and Limits
(a) Commercial General Liability:

Coverage will be on any vehicle used by Vendor, or its employees, agents, or
representatives in the course of providing Services under this Agreement. "Any
vehicle" will be any vehicle owned, hired and non -owned.

(c) Worker's Compensation:
Statutory limits according to the Texas Workers' Compensation Act or any other
state workers' compensation laws where the Services are being performed

Professional Liability coverage may be provided through an endorsement to the
Commercial General Liability (CGL) policy, or a separate policy specific to
Professional E&O. Either is acceptable if coverage meets all other requirements.
Coverage must be claims -made, and maintained for the duration of the contractual
agreement and for two (2) years following completion of services provided. An
annual certificate of insurance must be submitted to City to evidence coverage.
10.2 General Requirements
(a) The commercial general liability and automobile liability policies must
name City as an additional insured thereon, as its interests may appear. The term
City includes its employees, officers, officials, agents, and volunteers in respect to
the contracted services.
(b) The workers' compensation policy must include a Waiver of Subrogation
(Right of Recovery) in favor of City.
(c) A minimum of Thirty (30) days' notice of cancellation or reduction in
limits of coverage must be provided to City. Ten (10) days' notice will be
acceptable in the event of non-payment of premium. Notice must be sent to the
City in accordance with the notice provision of this Agreement.
(d) The insurers for all policies must be licensed and/or approved to do
business in the State of Texas. All insurers must have a minimum rating of A- VII
in the current A.M. Best Key Rating Guide, or have reasonably equivalent financial
strength and solvency to the satisfaction of Risk Management. If the rating is
below that required, written approval of Risk Management is required.
(e) Any failure on the part of City to request required insurance
documentation will not constitute a waiver of the insurance requirement.

(f) Certificates of Insurance evidencing that Vendor has obtained all required
insurance will be delivered to the City prior to Vendor proceeding with any work
pursuant to this Agreement.
11. Compliance with Laws, Ordinances, Rules and Regulations. Vendor agrees that in the
performance of its obligations hereunder, it will comply with all applicable federal, state and local laws,
ordinances, rules and regulations and that any work it produces in connection with this Agreement will also
comply with all applicable federal, state and local laws, ordinances, rules and regulations. If City notifies
Vendor of any violation of such laws, ordinances, rules or regulations, Vendor must immediately desist
from and correct the violation.
12. Non -Discrimination Covenant. Vendor, for itself, its personal representatives, assigns,
contractors, subcontractors, and successors in interest, as part of the consideration herein, agrees that in the
performance of Vendor's duties and obligations hereunder, it will not discriminate in the treatment or
employment of any individual or group of individuals on any basis prohibited by law. IF ANY CLAIM
ARISES FROM AN ALLEGED VIOLATION OF THIS NON-DISCRIMINATION COVENANT
BY VENDOR, ITS PERSONAL REPRESENTATIVES, ASSIGNS, CONTRACTORS,
SUBCONTRACTORS, OR SUCCESSORS IN INTEREST, VENDOR AGREES TO ASSUME
SUCH LIABILITY AND TO INDEMNIFY AND DEFEND CITY AND HOLD CITY HARMLESS
FROM SUCH CLAIM.
13. Notices. Notices required pursuant to the provisions of this Agreement will be
conclusively determined to have been delivered when (1) hand -delivered to the other parry, its agents,
employees, servants or representatives, (2) delivered by facsimile with electronic confirmation of the
transmission, or (3) received by the other party by United States Mail, registered, return receipt requested,
addressed as follows:

14. Solicitation of Employees. Neither City nor Vendor will, during the term of this
Agreement and additionally for a period of one year after its termination, solicit for employment or employ,
whether as employee or independent contractor, any person who is or has been employed by the other
during the term of this Agreement, without the prior written consent of the person's employer.
Notwithstanding the foregoing, this provision will not apply to an employee of either party who responds
to a general solicitation of advertisement of employment by either party.
15. Governmental Powers. It is understood and agreed that by execution of this Agreement,
City does not waive or surrender any of its governmental powers or immunities.

16. No Waiver. The failure of City or Vendor to insist upon the performance of any term or
provision of this Agreement or to exercise any right granted herein does not constitute a waiver of City's or
Vendor's respective right to insist upon appropriate performance or to assert any such right on any future
occasion.
17. Governing Law / Venue. This Agreement will be construed in accordance with the laws
of the State of Texas. If any action, whether real or asserted, at law or in equity, is brought pursuant to this
Agreement, venue for such action will lie in state courts located in Tarrant County, Texas or the United
States District Court for the Northern District of Texas, Fort Worth Division.
18. Severability. If any provision of this Agreement is held to be invalid, illegal or
unenforceable, the validity, legality and enforceability of the remaining provisions will not in any way be
affected or impaired.
19. Force Majeure. City and Vendor will exercise their best efforts to meet their respective
duties and obligations as set forth in this Agreement, but will not be held liable for any delay or omission
in performance due to force majeure or other causes beyond their reasonable control, including, but not
limited to, compliance with any government law, ordinance, or regulation; acts of God; acts of the public
enemy; fires; strikes; lockouts; natural disasters; wars; riots; epidemics or pandemics; government action
or inaction; orders of government; material or labor restrictions by any governmental authority;
transportation problems; restraints or prohibitions by any court, board, department, commission, or agency
of the United States or of any States; civil disturbances; other national or regional emergencies; or any other
similar cause not enumerated herein but which is beyond the reasonable control of the Party whose
performance is affected (collectively, "Force Majeure Event"). The performance of any such obligation is
suspended during the period of, and only to the extent of, such prevention or hindrance, provided the
affected Party provides notice of the Force Majeure Event, and an explanation as to how it prevents or
hinders the Parry's performance, as soon as reasonably possible after the occurrence of the Force Majeure
Event, with the reasonableness of such notice to be determined by the City in its sole discretion. The notice
required by this section must be addressed and delivered in accordance with Section 13 of this Agreement.
20. Headings not Controlling. Headings and titles used in this Agreement are for reference
purposes only, will not be deemed a part of this Agreement, and are not intended to define or limit the scope
of any provision of this Agreement.
21. Review of Counsel. The parties acknowledge that each party and its counsel have
reviewed and revised this Agreement and that the normal rules of construction to the effect that any
ambiguities are to be resolved against the drafting party will not be employed in the interpretation of this
Agreement or its Exhibits.
22. Amendments / Modifications / Extensions. No amendment, modification, or extension
of this Agreement will be binding upon a parry hereto unless set forth in a written instrument, which is
executed by an authorized representative of each party.
23. Counterparts. This Agreement may be executed in one or more counterparts and each
counterpart will, for all purposes, be deemed an original, but all such counterparts will together constitute
one and the same instrument.
24. Warranty of Services. Vendor warrants that its services will be of a high quality and
conform to generally prevailing industry standards. City must give written notice of any breach of this
warranty within thirty (30) days from the date that the services are completed. In such event, at Vendor's

option, Vendor will either (a) use commercially reasonable efforts to re -perform the services in a manner
that conforms with the warranty, or (b) refund the fees paid by City to Vendor for the nonconforming
services.
25. Immigration Nationality Act. Vendor must verify the identity and employment eligibility
of its employees who perform work under this Agreement, including completing the Employment
Eligibility Verification Form (I-9). Upon request by City, Vendor will provide City with copies of all I-9
forms and supporting eligibility documentation for each employee who performs work under this
Agreement. Vendor must adhere to all Federal and State laws as well as establish appropriate procedures
and controls so that no services will be performed by any Vendor employee who is not legally eligible to
perform such services. VENDOR WILL INDEMNIFY CITY AND HOLD CITY HARMLESS FROM
ANY PENALTIES, LIABILITIES, OR LOSSES DUE TO VIOLATIONS OF THIS PARAGRAPH
BY VENDOR, VENDOR'S EMPLOYEES, CONTRACTORS, SUBCONTRACTORS, OR
AGENTS. City, upon written notice to Vendor, will have the right to immediately terminate this Agreement
for violations of this provision by Vendor.
26. Ownership of Work Product. City will be the sole and exclusive owner of all reports,
work papers, procedures, guides, and documentation that are created, published, displayed, or produced in
conjunction with the services provided under this Agreement (collectively, "Work Product"). Further, City
will be the sole and exclusive owner of all copyright, patent, trademark, trade secret and other proprietary
rights in and to the Work Product. Ownership of the Work Product will inure to the benefit of City from
the date of conception, creation or fixation of the Work Product in a tangible medium of expression
(whichever occurs first). Each copyrightable aspect of the Work Product will be considered a "work -made -
for -hire" within the meaning of the Copyright Act of 1976, as amended. If and to the extent such Work
Product, or any part thereof, is not considered a "work -made -for -hire" within the meaning of the Copyright
Act of 1976, as amended, Vendor hereby expressly assigns to City all exclusive right, title and interest in
and to the Work Product, and all copies thereof, and in and to the copyright, patent, trademark, trade secret,
and all other proprietary rights therein, that City may have or obtain, without further consideration, free
from any claim, lien for balance due, or rights of retention thereto on the part of City.
27. Signature Authority. The person signing this Agreement hereby warrants that they have
the legal authority to execute this Agreement on behalf of the respective party, and that such binding
authority has been granted by proper order, resolution, ordinance or other authorization of the entity. This
Agreement and any amendment hereto, may be executed by any authorized representative of Vendor. Each
party is fully entitled to rely on these warranties and representations in entering into this Agreement or any
amendment hereto.
28. Change in Company Name or Ownership. Vendor must notify City's Purchasing
Manager, in writing, of a company name, ownership, or address change for the purpose of maintaining
updated City records. The president of Vendor or authorized official must sign the letter. A letter indicating
changes in a company name or ownership must be accompanied with supporting legal documentation such
as an updated W-9, documents filed with the state indicating such change, copy of the board of director's
resolution approving the action, or an executed merger or acquisition agreement. Failure to provide the
specified documentation so may adversely impact future invoice payments.
29. No Boycott of Israel. If Vendor has fewer than 10 employees or this Agreement is for
less than $100,000, this section does not apply. Vendor acknowledges that in accordance with Chapter
2271 of the Texas Government Code, the City is prohibited from entering into a contract with a company
for goods or services unless the contract contains a written verification from the company that it: (1) does
not boycott Israel; and (2) will not boycott Israel during the term of the contract. The terms "boycott Israel"

and "company" has the meanings ascribed to those terms in Section 2271 of the Texas Government Code.
By signing this Agreement, Vendor certifies that Vendor's signature provides written verification to
the City that Vendor: (1) does not boycott Israel; and (2) will not boycott Israel during the term of
the Agreement.
30. Prohibition on Boycotting Energy Companies. Vendor acknowledges that, in
accordance with Chapter 2274 of the Texas Government Code, as added by Acts 2021, 87th Leg., R.S.,
S.B. 13, § 2, the City is prohibited from entering into a contract for goods or services that has a value of
$100,000 or more that is to be paid wholly or partly from public funds of the City with a company with 10
or more full-time employees unless the contract contains a written verification from the company that it:
(1) does not boycott energy companies; and (2) will not boycott energy companies during the term of the
contract. The terms "boycott energy company" and "company" have the meaning ascribed to those terms
by Chapter 2274 of the Texas Government Code, as added by Acts 2021, 87th Leg., R.S., S.B. 13, § 2. To
the extent that Chapter 2274 of the Government Code is applicable to this Agreement, by signing this
Agreement, Vendor certifies that Vendor's signature provides written verification to the City that Vendor:
(1) does not boycott energy companies; and (2) will not boycott energy companies during the term of this
Agreement.
31. Prohibition on Discrimination Against Firearm and Ammunition Industries. Vendor
acknowledges that except as otherwise provided by Chapter 2274 of the Texas Government Code, as added
by Acts 2021, 87th Leg., R.S., S.B. 19, § 1, the City is prohibited from entering into a contract for goods or
services that has a value of $100,000 or more that is to be paid wholly or partly from public funds of the
City with a company with 10 or more full-time employees unless the contract contains a written verification
from the company that it: (1) does not have a practice, policy, guidance, or directive that discriminates
against a firearm entity or firearm trade association; and (2) will not discriminate during the term of the
contract against a firearm entity or firearm trade association. The terms "discriminate," "firearm entity"
and "firearm trade association" have the meaning ascribed to those terms by Chapter 2274 of the Texas

of the Government Code is applicable to this Agreement, by signing this Agreement, Vendor certifies that
Vendor's signature provides written verification to the City that Vendor: (1) does not have a practice, policy,
guidance, or directive that discriminates against a firearm entity or firearm trade association; and (2) will
not discriminate against a firearm entity or firearm trade association during the term of this Agreement.
32. Electronic Signatures. This Agreement may be executed by electronic signature, which
will be considered as an original signature for all purposes and have the same force and effect as an original
signature. For these purposes, "electronic signature" means electronically scanned and transmitted versions
(e.g. via pdf file or facsimile transmission) of an original signature, or signatures electronically inserted via
software such as Adobe Sign.
33. Entirety of Agreement. This Agreement contains the entire understanding and agreement
between City and Vendor, their assigns and successors in interest, as to the matters contained herein. Any
prior or contemporaneous oral or written agreement is hereby declared null and void to the extent in conflict
with any provision of this Agreement.

An ordinance ordering an election by the qualified
voters of the city of Fort Worth, Texas, on May 2,
2026, on the question of the issuance of ad valorem
tax supported public securities for the 2026 general
obligation debt program
Be it ordained by the city council of the City of
Fort Worth, Texas:
Election Ordered
That the City Council hereby orders that an election be held
on Saturday, May 2, 2026. The City Council hereby finds that
the date at which said election shall be held is not less than
seventy-eight (78) days nor more than ninety (90) days from
the date this Ordinance is adopted.
PROPOSITIONS
That at said election, the following propositions shall be sub-
mitted in accordance with law:
FORT WORTH PROPOSITION A
Shall the City Council of the City of Fort Worth be authorized
to Issue the public securities of said City as authorized by
law at the time of issuance, In one or more series or issues,
in the aggregate principal amount of $511,480,700, with
said public securities of each such series or issue, respec-
tively, to mature at the date or dates specified in the issuing
instruments, with no Such date to exceed forty years from
the date of such issuance, and to be sold at such prices
and bear interest at such rates as shall be determined by
the City Council, for the following streets and mobility infra-
structure related purposes in said City, to -wit: designing and
constructing permanent street and drainage improvements;
designing, reconstructing, rehabilitating, restructuring, and
extending the streets, thoroughfares, intersections, park
roads and parking lots, sidewalks, bridges, pedestrian ways,
bicycle ways, streetscapes, collectors, signalization, signage,
other traffic and signal controls, street lighting, and median
improvements, and the acquisition of land therefor; and
improvements related to all of the foregoing; and/or contnhb
uting toward the funding of any or all of the foregoing; and
shall said City Council be authorized to levy and cause to be
assessed and collected annual ad valorem taxes in an amount
sufficient to pay the annual interest on said public securities

Shall the City Council of the City of Fort Worth be
authorized to issue the public securities of said City as
authorized by law at the time of issuance, in one or more
series or issues, in the aggregate principal amount of
$185,140,000, with said public securities of each such
series or issue, respectively, to mature at the date or dates
specified in the issuing instruments, with no such dateto
exceed forty years from the date of such issuance, and to
be sold at such prices: and bear interest at such rates as
shall be determined by the City Council, for the following
park, recreation, and open space purposes in said City,
to -wit: acquiring landor permanenteasements for park,
recreation, and/or open space purposes; planning, design-
ing, conducting site preparation work, constructing, and
installing improvements and facilities for park, recreation,
and community center facilities and for natural areas and
open space lands and improvements; enlarging existing
park, recreation, and community center facilities and lands
as well as natural areas and open space lands; comment-
ing new or replacement facilities; renovating existing
facilities; enlarging other such facilities; constructing,
renovating, or enlarging playgrounds, roadways, parking,
drainage, or other supportive infrastructure facilities at
or integrated into park, recreation, and community center
facilities or to natural areas and open space lands; and

tributing toward the funding of any or all of the foregoing;
and shall said City Council be authorized to levy and
cause to be assessed and collected annual ad valorem taxes
in an amount sufficient to pay the annual interest on said

ly, to mature at the date or dates specified in the issuing
instruments, with no such date to exceed forty years from

Council, for the purpose of providing funds for permanent
improvements, to wit: planning, designing, constructing,
improving, renovating, repairing, replacing and expanding the
City's affordable housing and funding. its neighborhood revi-
talization initiatives, including land acquisition, construction
of housing and neighborhood infrastructure to support afford-
able housing; funding affordable housing and home repair
programs as may be permitted by law; and funding loans and
grants for affordable housing purposes as may be permitted
by law; and shall said City Council be authorized to levy and
cause to be assessed and collected annual ad valorem taxes
in an amount sufficient to pay the annual Interest on said
public secumles and provide a sinking fund to pay said public
securities at maturity?
FORT WORTH PROPOSITION E
Shall the City Council of the City of Fort Worth be authorized
to issue the public securities of said City as authorized by
law at the time of issuance, in one or more series or issues,
In the aggregate principal amount of $63,919,300, with said
public securities of each such series or issue, respective-
ly, to mature at the date or dates specified in the issuing
Instruments, with no such date to exceed forty years from
the date of such issuance, and to be sold at such prices
and bear interest at such rates as shall be determined by the
City Council, for the following public safety purposes in said
City, to -wit: designing, constructing, and equipping new or
replacement police and/or fire stations and/or emergency
communications facilities; renovating and/or expanding exist-
ing facilities for police, fire,emergency communication, and
any combination thereof; and the acquisition of land therefor;
and improvements related to all of the foregoing; and/or con-
tributing toward the funding of any or all of the foregoing; and
shall said City Council be authorized to levy and cause to be
assessed and collected annual ad valorem taxes in an amount
sufficient to pay the annual interest on said public securities
and provide a sinking fund to pay said public securities at

FORT WORTH PROPOSITION F
Shall the City Council of the City of Fort Worth be authorized
to issue the public securities of said City as authorized by
law at the time of issuance, in one or more series or issues,
In the aggregate principal amount of $59,874,000, with said
public securities of each such series or issue, respective-
ly, to mature at the date or dates specified in the Issuing
instruments, with no such date to exceed forty years from
the date of such issuance, and to be sold at such prices
and bear interest at such rates as shall be determined by the
City Council, for the following animal control shelter facility
related purposes in said City, to -wit: designing, construct-
ing, and equipping a new animal control shelter facility;
renovating and/or expanding existing animal control shelter
facilities; and the acquisition of land therefor In said City; and

uting toward the funding of any or all of the foregoing; and

PUBLIC ART
(a) In respect to Fort Worth Proposition A (Streets and
Mobility Infrastructure) submitted to the voters, it shall
be a part of the contract with the voters that should the
proposition be approved at said electron, the City Council
may determine to expend up to 1% of the aggregate
proceeds of the public securities authorized and sold for
projects approved by the voters as described in such
proposition for public art/enhanced design specifically
related to transportation and mobility infrastructure, con-
sistent with the public art ordinance approved by the City
Council and in effect at the time of the expenditure, and to
the extent permitted by law.
(b) In respect to Fort Worth Propositions B (Park, Recreation,
and Open Space), C (Public Library Improvements), E
(Public Safety Improvements), and F (Animal Care and
Shatter Improvements) submitted to the voters, it shall
be a part of the contract with the voters that should any
of the propositions be approved at said election, the City
Council may determine to expend up to 2% of the aggre-
gate proceeds of the public securities authorized and sold
for projects approved by the voters as described in each
such proposition for public art/enhanced design specifi-
cally related to one or more of the projects described in
such proposition, consistent with the public art ordinance
approved by the City Council and in effect at the time of
the expenditure, and to the extent permitted by law.
(c) In respect to Fort Worth Proposition D (Affordable
Housing) submitted to the voters, it shall be a part of the
contract with the voters that should the proposition be
approved at said election, the City Council shall not use
any proceeds of the public securities authorized and sold
for the projects approved by the voters as described In
such proposition for public art/enhanced design.
ADDITIONAL TAX AND FINANCIAL INFORMATION
That the following statements are made in accordance with Section 3.009(b) Of the Texas
Election Code and provide the information required under that Section that is not otherwise
addressed in this ordinance:
(a) Taxes sufficient to pay the annual principal of and interest on the debt obligations may be
imposed.
(b) Based upon the bond market conditions on the date this Ordinance is approved, the
maximum Interest rate for any series of the debt obligations authorized to be sold by the
voters is estimated to be 6%, as calculated in accordance with applicable law. Such esti-
mate takes Into account a number of factors, Including the timing of the issuance of debt
obligations approved by the voters, the maturity schedule for debt obligations Issued by
the City, and the expected credit ratings of the proposed debt obligations. The estimated
maximum interest rate isprovided as a matter of information, but Is not a Iim0ation on the
interest rate at which the debt obligations, or any series thereof, may be sold.
(c) As of the date of this Ordinance, the aggregate amount of outstanding principal of the
City's ad valorem supported obligations is $1,044,335,O00.
(d) As of the date of this Ordinance, the aggregate amount of outstanding Interest on the
City's ad valorem supported obligations is $274,948,487,
(a) As of the date of this Ordinance, the ad valorem debt service tax rate of the City of Fort
Worth is $0.1475 per $100.00 valuation of taxable property.
VOTING SYSTEM AND JOINT ELECTION
An electronic voting system, as defined in Chapter 121 of the Texas Election Code, shall be
used for voting at the regular polling places for said election and for counting the ballots and
the tabulation of the results. The conduct of the election and the use of the electronic voting
system shall be in accordance with the Texas Election Code.
The election shall be held as a Joint Election pursuant to a Joint Election Agreements and
Contracts for Election Services by and between the City of Fort Worm and the Tarrant
County Elections Administrator; the City of Fort Worth and the Demon County Elections
Administrator; the City of Fort Worth and the Parker County Elections Administrator; the City
of Fort Worth and the Wise County Elections Administrator; and other political subdivisions
located in those counties. Pursuant to the above -mentioned Joint Election Agreements, the
Tarrant County Elections Administrator shall serve as the Elections Administrator for the
election held in Tarrant County, the Denton County Elections Administrator shall serve as the
Elections Administrator for the election held in Denton County, the Parker County Elections
Administrator shall serve as the Elections Administrator for the election held in Parker County,
and the Wise County Elections Administrator shall serve as the Elections Administrator for
the election held in Wise County. Presiding Election Judges and Alternate Presiding Election
Judges appointed to serve at said polling places listed in the Joint Election Agreements shall
be those election officials furnished by the Elections Administrators selected pursuant to the
terms of the Joint Election Agreements. An Early Voting Ballot Board is hereby created pursu-
ant to Section 87.001 of the Texas Election Code. The Early Voting Ballot Board shall be made
up of members appointed in the manner stated in the Joint Election Agreements, and the
Presiding. Judges and the Alternate Presiding Judges of the Early Voting Ballot Boards shall be
the elections officials listed in the Joint Election Agreements.

BALLOT
The City Secretary of the City of Fort Worth shall ensure that ballots are prepared to be used
In said election, on which ballots shall be primed the propositions to be voted on in the elec-
tion. The ballots shall be printed in English, Spanish, and Vietnamese for use in said election.
Each proposed charter amendment in Exhibit "A" shall be separate and distinct so that voters
shall pass upon each one separately and apart from another and so that each voter may voter
"For" or "Against" on each said amendment.
EFFECTIVE DATE OF AMENDMENTS

of Fort Worth and the Wise County Elections Administrator; and other political subdivisions
located in those counties. Pursuant to the above -mentioned Joint Election Agreements, the
Tarrant County Elections Administrator shall serve as the Elections Administrator for the
election held in Tarrant County, the Denton County Elections Administrator shall serve as the
Elections Administrator for the election held in Denton County, the Parker County Elections
Administrator shall serve as the Elections Administrator for the election held in Parker County,
and the Wise County Elections Administrator shall serve as the Elections Administrator for
the election held in Wise County. Presiding Election Judges and Alternate Presiding Election
Judges appointed to serve at said polling places listed in the Joint Election Agreements shall
be those election officials furnished by the Elections Administrators selected pursuant to the
terms of the Joint Election Agreements. An Early Voting Ballot Board is hereby created pursu-
ant to Section 87.001 of the Texas Election Code. The Early Voting Ballot Board shall be made
up of members appointed in the manner stated in the Joint Election Agreements, and the
Presiding Judges and the Alternate Presiding Judges of the Early Voting Ballot Boards shall be

STATEMENT OF FISCAL IMPACT
Pursuant to Section 9.004(c)(2) of the Texas Local Government Code, (requiring a statement
of the anticipated fiscal impact to the City if the proposed amendments are approved), the
City asserts it is difficult to accurately account for the fiscal Impact of the proposed amend-
ments in light of the particular unknown effect upon the actual operation of the City govem-
ment If the proposed amendments are approved. With that general statement in mind, an
overall analysis indicates that (i) there should be no immediate fiscal impact upon the proba-
ble economic cost to the City if any of Propositions H through 0 is approved and implemented
and (li) the Immediate fiscal impact upon the probable economic cost to the City If Proposition
G is approved and Implement would be approximately two hundred eigm-five thousand seven-
ty-five dollars ($285,075.00) per fiscal year beginning in Fiscal Year 2027 for the increase In
compensation for Mayor and Council Members.

Notice of said election shall be given by publishing a Notice of Election, in English, Spanish,
and Vietnamese, at least once, not earlier than the 30" day or later than the 1 O" day before
election day in a newspaper published in said City. A copy of the Notice of Election, in

of the meeting of the Fort Worth City Council not later than the 21" day before election day.

CHAPTER V: THE CITY MANAGER

The council shall appoint the city manager, who shall be the
chief administrative and executive officer of the city. He shall

CHAPTER X: THE BUDGET AND FINANCIAL PROCEDURE
RELATING THERETO
§ 2 ANNUAL BUDGET.
Public hearings on the manager's proposed budget shall be
held and notice of such hearings shall be provided in accor-
dance with applicable state law; however, no less than one
(1) public hearing shall be held on the budget following notice
of such hearing. The budget shall Rot be adopted at the same
meeting as the public hearing; The annual appropriations
ordinance providing funding for the proposed budget, along
with a corresponding ad valorem tax levy ordinance shall
be considered by the City Council at the same meeting the
City Council considers approving the budget. Upon approval
of the budget, the caption of the appropriations ordinance
shall be published once, and the caption and penalty of the
ad valorem tax levy ordinance shall be published twice in the
City's official newspaper. The final approved budget and the
full text of each ordinance shall be posted on the city's web -
site and filed in the city secretary's office and made available
for public inspection. The budget will become effective upon
approval by City Council. The appropriations ordinance and
ad valorem tax levy ordinance shall become effective upon
publication in accordance with this section.

surface of the same, to make the intended use thereof practi-
cable, shall be deemed and considered a "franchise," granting
of which shall be governed and controlled in the manner
herein provided.
The use of the said public streets, highways, alleys and thor-
oughfares of this city, which does not require the digging up
or similar interference with said streets, alleys or highways
for the installation of equipment, appliances or appurtenanc-
es, to make the intended use possible, shall be treated and
considered as a "privilege," subject to the control and dispo-
sition of the City Council, and such privilege over and upon
the said public streets, alleys, highways and thoroughfares
of the city shall not be granted to any person or corpora-
tion excepting when public necessity and convenience may
require such use and when given by ordinance passed by a

The directors of the departments appointed by the city man-
ager shall be immediately responsible to the city manager
for the administration of their departments, including the
preparation of reports and recommendations concerning their
departments as required by the city manager.

CHAPTER III: THE CITY COUNCIL
§ 4 VACANCIES IN THE CITY COUNCIL; HOW FILLED.
Vacancies in the City Council shall be filled by special elec-
tions from the districts whose places have been vacated.
Vacancies in the office of mayor shall be filled under the pro-
visions applicable to other council members except that the
district of the mayor shall be thecity as a whole. These spe-
cial elections shall be held on the first available election date
specified in the Texas Election Code unless the council shall
request, and receive, permission from the governor to call an
emergency special election. If vacancies should occur within-
th Fly (30) days of the special election date after the time far
orderinga special election on the next election date specified
in the Texas Election Coda, the council may set the election
for the next date following the impending special election date
or it may request permission for an emergency special elec-
tion from the governor.
In the event any candidate for a vacancy fails to receive
a majority of all votes cast for all the candidates for such
vacancy at such special election, the mayor shall on the
first day following the completion of the official count of the
ballots cast at said special election issue a call for a run-
off election pursuant to Chapter IV, section 2, to be held in
accordance with the Texas Election Code to determine who
shall be elected. Such new council members, when duly qual-
ified and elected, shall serve for the unexpired period of the
terms of the council members whose offices are being filled.
However, no such elections shall be held where said vacancy
shall occur afteL
the deadline for ordering a special election to fill a vacancy on

date as specified in Chapter IV, section 2. When a vacancy

Should a vacancy occur in the office of mayor, the mayor

under the rules pertaining to filling vacancies among the
other councilmembers. If members of the City Council seek
the office of mayor in such a special election, they shall first
resign from the City Council, and special elections, simulta-
neous to the mayoral election, shall be held in their districts
under the terms specified above.

CHAPTER X: THE BUDGET AND FINANCIAL
PROCEDURE RELATING THERETO
§ 7 PROPERTY SUBJECT TO TAXATION.
No claim against the city shall be paid, unless it is evidenced
by a pueehose ander appropriate written documentation
approved by the head of the department or office for which
the indebtedness was incurred; and each director or officer
and his surety shall be liable to the city for all loss or damage
sustained by the city by reason of his negligent or corrupt
approval of any such claim. The controller of accounts shall
examine all payrolls, bills and other claims and demands
against the city, and shall issue no warrant for payment
unless he finds that the claim is In proper form, correctly
computed and duly approved; that it Is justly and legally due
and payable; that an appropriation has been made therefor
which has not been exhausted, or that the payment has been
otherwise legally authorized; and that there is money in the
city treasury to make payment. He may investigate any claim
and for that purpose may summon before him any officer,
agent or person, and examine him upon oath or affirmation
relative thereto, which oath or affirmation he may administer.
If the controller of accounts issues a warrant on the treasury
authorizing payment of any item for which no appropriation
has been made, or for the payment of which there is not a
sufficient balance in the proper appropriation, or which is oth-
erwise contrary to law or ordinance, he and his sureties shall
be individually liable to the city for the amount thereof.

cian se imprini an ingles, espanol y vietnamita. Cada
moddicaci6n propuesta a Is carta constitucional que figura
an el Anexo "A" debe ester separada y ser clara para que los
votantes puedan pasar dada una de forma separada de las
demos y para que coda votame pueda voter "A favor" o "En
contra" de cada mod'dicaci6n.

SISTEMA DE VOTAC16N Y ELECC16N CONJUNTA
Se utilizara un sistema do votaci6n electr6nica, tat como
se define an el Capitulo 121 del C6digo Electoral de Texas,
pars emifir el voto on los lugares de votaci6n habituales para
dicha eleccion, asi como para contabilizar las boletas y tab-
ular Ina resultados. La realizaci6n de las elecclones y at use
del sistema de votaci6n electr6nica se haran de acuerdo con
el C6digo Electoral de Texas.
La elecci6n se celebrara coma una elecci6n conjunta de
conformidad con un acuerdo de elecci6n conjunto y un
contrato de servicios electorales entre la ciudad de Fort
Worth y al administrador electoral del condado de Tarrant;
la ciudad de Fort Worth y of administrador electoral del con-
dado de Denton; la Ciudad de Fort Worth y of administrador
electoral del condado de Parker, la ciudad de Fort Worth y
el Administrador de Elections del condado de Wise y obas
subdivisiones politicos de esos condados. De conformi-

el administrador electoral del condado de Tarrant actuara

DECLARAC16N DE IMPACTO FISCAL
De conformidad con la Secct6n 9.004(c)(2) del C6digo de
Gobierno Local de Texas (que exige una declaraci6n del
impacto fiscal previsto para to Ciudad si se aprueban las
modificaciones propuestas), la Ciudad afirma que as dificil
calcular con precision el impacto fiscal de las modificaciones
propuestas debido of efecto particular desconocido sabre el
funcionamiento real del goblemo municipal si se aprueban
dichas modificaciones Teniendo an cuenta esa declaraci6n
general, un analisis global indica que (i) no debeaa haber un
impacto fiscal inmediato an el probable costo econ6mtco
para Is Ciudad si cualquiera de las Propuestas de la H a Is 0
se aprueba a implements y (III of impacto fiscal inmediato an
el probable costo econ6mtco para la Ciudad si Is Propuesta G
se aprueba a implementa seria aproximadamente de dosclen-
tos ocho mil setenta y cinco dolares ($285,075.00) par ano
fiscal a partir del Ado Fiscal 2027 debido al aumento an Is

El aviso de dicha elecci6n se realizara mediane la publi-
caclon de un Aviso de Elecct6n an InglBs, espanol y vietna-
mite, al memos una vez entre los dfas 30 y 10 previos al die
de Is elecci6n, en un ped6dico publicado an Is ciudad de Fart
Worth. Una copia del Aviso de Election, an ingles, espanol
y vietrtamita, debera pubiicarse an el tali de anuncios que
ufillza la Ciudad para publicar avisos de las reuniones del
Ayuntamiento de Fort Worth, al manias 21 dlas antes del dia
de Is elecci6n.
AVISO
La manera de celebrar dicha elecci6n, el aviso correspon-
diente a la elecci6n, los lugares de votaci6n, el personal y
las funcionarios que cation organizarla y todos los detalles
relacionados con la celebraci6n de tal elecci6n seran propor-
cionados y organizados par el Secretario de Is Ciudad. El
aviso correspondiente y su publicaci6n, Ia promulgaci6n, Is
convocatoria y la ordenanza solo saran acumulativos y adi-
cionales al aviso de dicha elecci6n de conformidad con Is ley,
tal coma se establece an este documento. Cualquier omiskn
o imegularidad an este aviso o an la publicacibn o divulgaci6n
de este aviso, promulgaciOn, convocatoria y ordenanza, o on
las firmas correspondientes, no afectara ni invalidara de din-
guna manera dicha elecci6n.

Si los votantes calificados de la ciudad de Fort Worth
adoptan las Propuestas planteadas, las siguientes disposi-
canes de la Carta constitucional se modiftcardn agregando
las palabras subrayadas y eliminando las tachadas. El

ARTICULO 3 [ADMINISTRAC16N ADECUADA DE LOS
ASUNTOS BE LA CIUDAD, NOMBRAMIENTO, REMOCICN
DE DIRECTORIES Y EMPLEADOS, CUMPLIMIENTO DE LOS
REGLAMENTOS DE LA ADMINISTRAC16N PUBLICA].
El administrador de la ciudad sera responsable ante el ayun-
tamiento de Is correcta administraci6n de todos Ina asuntos
de la ciudad que forgo a su cargo, y, pars ello, nombrara y
contratara a todos las directores de departamentos y otros
empleados que no se contemplen an esta Carta constitucion-
al o mediante ordenanza. Los nombramientos que 61 realice
se haran con base an la experiencia y la capacidad ejecutiva
y administrative, as[ como on Ia capacitation, Is idoneidad y
la eficiencia de las personas nombradas respecto del trabajo
que deberan administrar. Todos estos directores de depar-
tamentos responderan de forma directa al administrador de

Al ocupar los cargos que estan dentro de to Iista de servicio
clasificado, debera hacerlo de acuerdo con las normas y
los reglamentas que la junta de la administraciOn p6blica

empleados subordmados de sus departamentos de acuerdo
con las dispositions de his articulos sabre administraci6n
p6blica de esta Carta constitucional.

CAPITULO V: EL ADMINISTRADOR BE LA CIUDAD
ARTICULO 1 [NOMBRAMIENTO, CALIFICACIONES,
REMOCION, AUSENCIA 0 DISCAPACIDAD, REMUNERAC16N,
RESIDENCIA].
El ayuntamiento nombrara al administrador de is ciudad,
quien sera of principal functonario administrativo y ejecutivo
de la ciudad. Se elegira 6nicamente con base an su capac-
itaci6n, experiencia y capacidad ejecutiva y administrative, e
independientemente de la consideraci6n politica. Si ambos
perfiles benen las mismas aptitudes, se darn prioridad a
Is selecci6n de un ciudadano residente de Fort Worth pars
este cargo. Ningfin miembro del ayuntamiento sera elegido
administrador de la ciudad. No se nombrara al administrador
tle la ciudad par un periodo fijo definido, sino que podra ser

§ 4 FRANQUICIAS Y PRIVILEGIOS; DEFINICII)N SEGUN
SE APLICA A LAS CALLES Y CARREFERAS PI)BLICAS;
FACULTAD DEL AYUNTAMIENTO PARA REGULAR.
El derecho a utilizer las calles, carreteras, callejones y vies
pdblicas de esta ciudad, qua requiera la excavaci6n o alter-
aci6n de las mismas pars to instalacJ6n deequipos, aparatos
o accesorios, ya sea sobre, encima o debajo de su superfi-
cie, pare hacer posible at use previsto, se considerara una
"franquicla", cuya concesidn se regira y comrolara de la
manera aqul prevista.
El use de dichas calles, carreteras, callejones y Was p6blicas
de esta ciudad, quo no requiera la excavaci6n ni interferen-
cia similar con dichas calles, callejones o carreteras para Is
instalacion tle equipos, aparatos o accesorios a fin de hacer
posible el use previsto, se tratar6 y considemra coma un
"privilegio", sujeto al control y disposici6n del Ayuntamiento,
y dicho privilegio an las mencionadas calles y sobre estas,

conceder6 a ninguna persona o corporaci6n, excepto cuando

CAPITULO Vill: DEPARTAMENTOS ADMINISTRATIVOS
DUE SERAN CONTROLADOS Y ADMINISTRADOS POR EL
ADMINISTRADOR DE LA CIUDAD
§ 1 NOMERO DE DEPARTAMENTOS ADMINISTRATIVOS
DUE SERAN CONTROLADOSY ADMINISTRADOS POR EL
ADMINISTRADOR DE LA CIUDAD.
Par la presente se cream y as colocan bajo el control del
administrador de la ciudad seis (6) departamentos adminis-
trafivos del gobierno municipal, Como sigue:
(1) Departamento de Finanzas.
(2) Departamento de Policia.
(3) Departamento de Bomberos.
(4) Departamento de Obras P6blicas.
(5) Departamento de Salud P61blica.
(6) Departamento de Obras Hidraulicas.
El Ayuntamiento o el Administmdor de la Ciudad tendran Is
facultad de establecer, mediente-erdeuenza, mros departa-
mentos, divisiones y oficinas quo consideren necesarios pare
el funcionamiento eficiente del gobierno municipal. El Concejo
Municipal o el Administrador de la Ciudad podran descontin-
uar cualquier departamento u oficina, estableeide-medienta
ordenanza, y podra establecer, combinar, consolidar, distribuir
o abolir las funciones y deberes de departamentos, divisiones
u oficinas.
Los directores de Jos departamentos nombrados por el
administrador de la ciudad seran inmediatamente respons-
ables ante at administrador de la ciudad por la administration
de sus departamentos, incluicas la preparaci6n de informes y
las recomendacJones relatves a sus departamentos seg6n to
requiera el administrador de la ciudad.
Enmienda Numero 8 (Propuesta N).
CAPITULO III: EL AYUNTAMIENTO
ARTICULO 4 VACANTES. EN EL AYUNTAMIENTO; COMO SE
CUBREN.
Las vacantes an el Ayuntamiento se cubriran mediante
elecciones especiales an los distritos cuyos cargos hayan
quedado vacantes. Las vacantes an el cargo de alcalde se
cubrimn conforme a Jos disposiciones aplicables a los demos
miembros del ayuntamiento, excepto qua el distrito del
alcalde sera la ciudad an su conjunto. Estes elecciones espe-
ciales se celebraran an Is primers fecha electoral disponible
especificada an el C6digo Electoral de Texas, a menos quo of
Concejo sollcite y raciba permiso del gobernador pare con-
vocar una elecci6n especial de emergencia. Si se producers
vacantes
cidn especial an la siguiente fecha electoral especificada an
el C6digo Electoral de Texas, el Concejo podra fijar la elecc16n
para la fecha siguiente posterior a Is inminente fecha de elec-
ci6n especial o podra solicitor permiso al gobemador para
una elecci6n especial de emergencia.
En caso de qua algbn candidate para una vacante no reciba
la mayorfa de todos los votos emifidos para todas los candl-
datos a dicha vacante an esa elecci6n especial, el alcalde, el
primer dia siguiente a to finalization del conteo oficial de las
boletasemifidas an dicha elecci6n especial, convocara una
elecci6n de segunda vuelta conforme of Capltulo IV, secci6n
2, qua se celebrara de acuerdo con el C6digo. Electoral tle
Texas para determiner quien resultara electo. Dichos miem-
bros nuevos del ayuntamlento, una vez debidamentecalifica-
dos y electos, ejerceran of cargo correspondiente al periodo
restante de los mandator de los miembros del Ayuntamiento
cuyos cargos se est6n cubriendo. Sin embargo, no se cele-
braran tales elecciones cuando dicha vacante ocurra contra

tem ejercera at cargo haste qua se convoque una elecci6n
especial conforme a las normas relatives a cubdr vacantes
entre los demos mlembros del ayuntamiento. Si los miem-
bros del ayuntamiento buscan el cargo de alcalde an dicha
elecci6n especial, primero deberan renunciar al Ayuntamiento,
y se celebraran elecciones especiales simultaneas a la elec-
66n de alcalde on sus distrilos conforme a los terminos
especificados anteriormente.

FINANCIERO RELACIONADO
ARTICULO 7 BIENES SUJETOS A IMPUESTOS.
Ninguna reclamacibn contra la ciudad se pagan, a menos
qua est6 respaldada por anecrden deeampra docu-
mentaci6n escma aorooiada aprobada por el jefe del departa-
memo u oficina an at qua se hays contraido la deuda; y coda
director o tuncionario y su garante saran responsables ante la
ciudad portoda p6rdida o dwo qua la ciudad sutra debido a
su aprobaci6n negligente o corrupts de dicha reclamacl6n. El
Interventor de cuentas examinara todas las n6minas, facturas
y otras reclamaciones y demandas contra to ciudad, y no
emitira ninguna orden de pago, a menus qua determine qua la
reclamacibn said an forma adecuada, correctamente calcula-
do y debidamente aprobada; qua as justa y legalmente debida
y pagadera; quo se hays hecho una asignaci6n para tal fin
qua no se hays agotado, o qua el pago haya sido autorizado
legalmente de otro modo; y qua haya fondos an Is tesorerla
de Is ciudad para efectuar el pago. Podra investigar cualquier
reclamaci6n y, para tal fin, podra hacer comparecer ante
61 a cualquier tuncionario, agente a persona, y exammarlo
bajo juramento o declaracl6n an relacJ6n con ello, juramento
o declaraci6n quo podra administrar. Si el interventor de
cuentas emite una orden contra Is tesorerla qua autorice
