AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF EAST 4TH STREET, A SIXTY-FOUR-FOOT WIDE PUBLIC RIGHT-OF- WAY, AND A PORTION OF ELLIOT AVENUE, A SIXTY-ONE-FOOT WIDE PUBLIC RIGHT-OF-WAY, SITUATED IN THE R. CROSS SURVEY, ABSTRACT NUMBER 304, CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, ACCORDING TO THE FINAL PLAT OF THE PAGE ’COMPANY S EAST SIDE ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, RECORDED IN VOLUME 309, PAGE 3, COUNTY RECORDS, TARRANT COUNTY, TEXAS, AND TOGETHER CONTAINING APPROXIMATELY 0.698 ACRES OF LAND, MORE OR LESS; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of East 4th Street, a sixty-four-foot wide public right-of-way, and a portion Elliot Avenue, a sixty-one-foot wide public right of way, situated in the R. Cross Survey, Abstract Number 304, Tarrant County, Texas, according to the final plat of The Page Company’s East Side Addition, an addition to the City of Fort Worth, Tarrant County, Texas, recorded in Volume 309, Page 3, County Records, Tarrant County, Texas, and together containing 0.698 acres of land, as more specifically described in Exhibit “A” attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the easements to the land in the above-described vacated portions of rights-of-way are hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing utility easements shall be retained by the City until such time all utilities located in the easements are relocated at the owner's expense. Adopt the attached ordinance vacating a portion of Elliott Avenue and a portion of East 4th Street, to be replatted with the adjoining property for a single-family development; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. DISCUSSION: Westwood Professional Services, on behalf of Nextmetro Communities LLC, has requested a vacation of these unimproved rights -of -way to be replatted with the adjoining property for a future single-family development. The City Plan Commission recommended approval of this request at its meeting on April 30, 2025. An acceptable final plat (FS-25-093) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned rights -of -way through plat dedication. The City does not own any fee interest in the right-of-way or own any property adjacent to the rights -of -way and did not expend any City funds to obtain the right-of-way. In accordance with the City's policy regarding street and alley vacation transactions Mayor and Council Communication (M&C) G-15624, staff recommends waiving the purchase price of this right-of-way. This project is located in COUNCIL DISTRICT 11. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
