ORDINANCE NO.
AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
KELLER HASLET ROAD, A PRESCRIPTIVE RIGHT-OF-WAY
LOCATED BETWEEN WESTPORT PARKWAY AND ALTA VISTA
ROAD; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT:
SECTION 1.
A portion of Keller Haslet Road, a prescriptive right-of-way located between Westport
Parkway and Alta Vista Road, situated in the Z.D. Davis Survey, Abstract No. 1888, the T.T.
Willis Survey, Abstract No. 1682, and S.T. Rhodes Survey, Abstract No. 1868, City of Fort Worth,
Tarrant County, Texas, being a portion of the remainder tract of land described by deed to AIL
Investment, L.P., recorded in Instrument No. D205016661, and a portion of the tract of land
described by deed to Joseph P. Delany, Bishop at the Catholic Diocese of Fort Worth, recorded in
Instrument Number D204380251, both of County Records, Tarrant County, Texas, and containing
approximately 1.581 acres of land more or less, as more specifically described in Exhibit “A”
which is attached hereto and incorporated herein by reference, be and the same is vacated and
extinguished.
SECTION 2.
Easements to the land in the above-described vacated portions of right-of-way are hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easements shall be retained by the City until such time all utilities
located in the easements are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.

Right -of -Way Abandonment
BEING a tract of land situated in the Z. D. Davis Survey, Abstract Number 1888, the T. T.
Willis Survey, abstract Number 1682, and the S. T. Rhodes Survey, Abstract Number 1868, City
of Fort Worth, Tarrant County, Texas, being a portion of Keller Haslet Road (a paved and
traveled road, open to the public, no record found), being a portion of that remainder tract of land
described by deed to AIL Investment, L.P., recorded in Instrument Number D205016661, and a
portion of that tract of land described by deed to Joseph P. Delany, Bishop at the Catholic
Diocese of Fort Worth, recorded in Instrument Number D204380251, both of County Records,
Tarrant County, Texas, and being more particularly described by metes and bounds as follows:
BEGINNING at a 5/8 inch iron rod with cap stamped "Gorrondona", found in the west line of
said Joseph P. Delany tract, being the southeast corner of that remainder tract of land described
by deed to The William Blake and Ina Bea Jameson Revocable Living Trust recorded in Volume
12385, Page 1941 and Page 1945, and being an ell corner in the east line of Westport Parkway
(a variable width right-of-way) recorded in Instrument Number D221308512, both of said
County Records;
THENCE N 89°36'43"E, 1416.57 feet, departing said west line, over and across said Joseph P.
Delany tract, to the east line of said Joseph P. Delany tract, being the west right-of-way line of
Alta Vista Road (a variable width right-of-way) recorded in Cabinet A, Slide 5742, Plat Records,
Tarrant County, Texas;
THENCE S 00016'57"E, with said west right-of-way line and the east line of said Joseph P.
Delany tract, at 22.32 feet passing the southeast corner of said Joseph P. Delany tract, being the
northeast corner of said AIL Investment tract, in all 49.20 feet, to a 5/8 inch iron rod with cap

to be Replatted for Proposed Multi -Family Development and Waive Any and All Purchase Fee Value of the Vacated Land in Accordance with City
Policy
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt an ordinance vacating a portion of prescriptive right-of-way for Keller Haslet Road between Westport Parkway and Alta Vista Road to
be replatted for proposed multi -family development; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to: (1) adopt an ordinance vacating a portion of the prescriptive right-of-way for
Keller Haslet Road between Westport Parkway and Alta Vista Road and (2) waive any and all purchase fee value of the vacated land in
accordance with City policy. The right-of-way will be replatted as an Homeowners Association (HOA) lot for the proposed multi -family development
to the south along Alliance Gateway Freeway.
Westwood Professional Services, on behalf of AIL Investments, LP, submitted the request. The City Plan Commission recommended approval of
this request at its July 9, 2025 meeting.
The Subdivision Ordinance requires that an acceptable plat of the property incorporating the vacated right-of-way be submitted within 180 days of
the Plan Commission's recommendation approving a right-of-way vacation. The applicant has submitted an acceptable final plat incorporating the
southern half of the road (FS-25-236). The property owner to the north is not ready to plat their property at this time to incorporate the norther half of
the road. Therefore, at the February 12, 2026 meeting, the City Plan Commission approved a waiver to the requirement that a plat of the north half
of the road be submitted within 180 days. The northern half off the road will be platted whenever the property to the north is platted.
The City of Fort Worth (City) originally obtained the identified right-of-way through prescription. The City does not own any fee interest in the right-
of-way or own any property adjacent to the right-of-way and did not expend any City funds to obtain the right-of-way. In accordance with the City's
policy regarding street and alley vacation transactions (Mayor and Council Communication (M&C) G-15624), staff recommends waiving the
purchase price of this right-of-way.
This project is located in COUNCIL DISTRICT 10.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
