HomeMy WebLinkAbout28384-03-2026 - City Council - OrdinanceOrdinance No. 28384-03-2026 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $991,372.00, TRANSFERRED FROM AVAILABLE PAYGO FUNDS IN THE WATER AND SEWER FUND, FOR THE PURPOSE OF FUNDING THE BIG FOSSIL CREEK COLLECTOR PARALLEL, PHASE IV A PROJECT (CITY PROJECT NO. 103289); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2025-2026 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $991,372.00, transferred from available PayGO funds in the Water and Sewer Fund, for the purpose of funding the Big Fossil Creek Collector Parallel, Phase IV A project (City Project No. 103289). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize execution of a contract with R & D Burns Brothers, Inc. in the amount of $788,973.00 for Big Fossil Creek Collector Parallel, Phase IV A project Part 1 — Austin Road Sanitary Sewer Installation; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $991,372.00, transferred from available PayGo funds in the Water and Sewer Fund, for the purpose of funding the Big Fossil Creek Collector Parallel, Phase IV A project (City Project No. 103289) and to effect a portion of Water's contribution to the Fiscal Years 2026-2030 Capital Improvement Program. DISCUSSION: This Mayor & Council Communication (M&C) is to authorize execution of a construction contract with R & D Brothers, Inc., in the amount of $788,973.00 for the installation of an 8-inch sanitary sewer extension on Austin Road to provide and maintain sewer service to existing and future customers in the immediate vicinity. Additionally, asphalt pavement rehabilitation will be conducted on roadway subsequent to the sanitary sewer main installation. The project was advertised for bids on January 21, 2026 and February 4, 2026, in the Fort Worth Star -Telegram. On February 19, 2026, the following bids were received: Bidder R & D Burns Brothers, Inc. Fort Worth Civil Constructors William J Schultz Inc. dba Circle C Construction Company Amount Time of Completion 120 $788,973.00 Calendar Days $918,997.00 $1,029,045.00 In addition to the contract amount, $123,502.00 is required for project management, material testing, and inspection. Project contingencies are provided in the amount of $78,897.00. It is the practice of the Water Department to appropriate its Capital Improvement Plan (CIP) plan throughout the Fiscal Year (FY), instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants. Funding is budgeted in the Transfer to Water/Sewer account within the Water & Sewer Fund for the purpose of funding the Big Fossil Creek Collector Parallel, Phase IV A project. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are available in the Water & Sewer Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the W&S Capital Projects Fund for the Big Fossil Creek Sewer PHIV A project to support the above recommendations and execution of the construction contract. Prior to any expenditures being incurred, the Water Department has the responsibility of verifying the availability of funds.
