AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
STORMWATER CAPITAL PROJECTS FUND, IN THE AMOUNT OF $103,882.95, FROM AVAILABLE
TRANSFER FROM GRANTS OPERATING FUND WITHIN STORMWATER HAZARDOUS ROAD
OVERTOPPING PROGRAMMABLE PROJECT (CITY PROJECT
NO. P00120), FOR THE PURPOSE OF FUNDING VARIOUS STORMWATER HAZARDOUS
ROAD OVERTOPPING MITIGATION PROJECTS; PROVIDING FOR A SEVERABILITY CLAUSE;
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2025-2026 in
the Budget of the City Manager, there shall also be increased estimated receipts and appropriations
in the Stormwater Capital Projects Fund, in the amount of $103,882.95, from available Transfer
from Grants Operating Fund within Stormwater Hazardous Road Overtopping programmable project
(City Project No. P00120), for the purpose of funding various Stormwater Hazardous Road Overtopping
Mitigation projects.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Improvement Program
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Stormwater Capital Projects Fund, in
the amount of $103,882.95, from available Transfer from Grants Operating Fund within Stormwater Hazardous Road Overtopping
programmable project (City Project No. P00120), for the purpose of funding various Stormwater Hazardous Road Overtopping Mitigation
projects; and
2. Amend the Fiscal Years 2026-2030 Capital Improvement Program.
DISCUSSION:
The purpose of this Mayor and Council Communication is to adopt an appropriation ordinance increasing estimated receipts and appropriations
in the Stormwater Capital Projects Fund for the Stormwater (SW) Hazardous Road Overtopping Programmable project (City Project No. P00120)
and amend the fiscal years 2026-2030 Capital Improvement Program.
On June 11, 2015, Governor Greg Abbott issued a disaster declaration for Tarrant County due to the flooding and severe weather that affected the
area from May 4, 2015 through June 22, 2015. During the floods, which affected City infrastructure and facilities, several departments incurred
damages and executed emergency measures to assist residents. City departments applied for Public Assistance and submitted projects that
included categories such as emergency protective measures, debris removal, stormwater infrastructure improvements, and parks and recreation
facilities. The City of Fort Worth received reimbursement from FEMA for cost and expenses related to the floods in the amount of $1,536,234.85.
The appropriation of the grant funds was approved on September 27, 2016, under M&C G-18837, with the grant funding allocated to the Disaster
Recovery Grant 4223-1 (City Project No. 100904).
Although the funds were originally used for disaster -related activities, the expenditures were never formally transferred to the designated disaster
project. Due to the age of the expenditures and the difficulty in verifying details, the Department of Financial Management Services approved
transferring the funds out of the project and reallocating them to the departments that originally reported the costs. The recommended amount
above reflects the Stormwater share. Since a portion of the grant funding went toward the Butler/McClure stormwater project to mitigate roadway
flooding, the Stormwater Program is recommending appropriation to the Stormwater Hazardous Road Overtopping Programmable project. The
Hazardous Road Overtopping Mitigation Program is aimed at reducing dangerous road flooding and improving road safety during rain events.
Funding is available within the Stormwater Hazardous Road Overtopping programmable project within the Stormwater Capital Projects Fund for
the Transportation and Public Works Department for the purpose of funding various Stormwater Hazardous Road Overtopping Mitigation projects.
Funding for this project was not included in the FY2026-2030 Capital Improvement Program due to funding needs being unknown at the time of its
development. The action in this M&C will amend the FY2026-2030 Capital Improvement Program as approved in connection with Ordinance
27979-09-2025.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are currently available in the SW Hazardous Rd Overtopping programmable project within the
Stormwater Capital Projects Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds
will be available in the Stormwater Capital Projects Fund for the SW Hazardous Road Overtopping Programmable project. Prior to an expenditure
being incurred, the Transportation & Public Works Department has the responsibility of verifying the availability of funds.
