HomeMy WebLinkAbout28309-02-2026 - City Council - OrdinanceOrdinance No. 28309-02-2026 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $8,998,754.00, FROM AVAILABLE PAYGO RESIDUALS IN THE WATER AND SEWER CAPITAL PROJECTS FUND, FOR THE PURPOSE OF FUNDING THE WATER AND SANITARY SEWER REPLACEMENT CONTRACT 2020, WSM-H PROJECT (CITY PROJECT NO. 103412); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2025-2026, as enacted by Ordinance 27979-09-2025, as amended, is hereby further amended to make the following adjustments by increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $8,998,754.00, from available PayGo Residuals in the Water and Sewer Capital Projects Fund, for the purpose of funding the Water and Sanitary Sewer Replacement Contract 2020, WSM-H project (City Project No. 103412). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize execution of a contract with Woody Contractors, Inc., in the amount of $8,227,654.00 for Water and Sanitary Sewer Replacement Contract 2020, WSM-H project; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $8,998,754.00, from available PayGo residuals within the Water and Sewer Capital Projects Fund, for the purpose of funding the Water and Sanitary Sewer Replacement Contract 2020, WSM-H project (City Project No. 103412) and to effect a portion of Water's contribution to the Fiscal Years 2026-2030 Capital Improvement Program. The project was advertised for bids on November 5, 2025 and November 12, 2025, in the Fort Worth Star -Telegram. Small Business (SB) Goal - Woody Contractors, Inc. has met the City's small business goal. In addition to the contract amount, $483,132.00 (Water: $324,767.00; Sewer: $158,365.00) is required for project management, material testing, and inspection. Project contingencies are provided in the amount of $287,968.00 (Water: $193,183.00; Sewer: $94,785.00). This project will have no impact on the Water Department's operating budget when completed. The sanitary sewer component of this project is part of the Sanitary Sewer Overflow Initiative Program of the Water Department. Approximately 11,776 linear feet of cast iron water and 3,718 linear feet of sanitary sewer pipe will be removed and replaced as part of this project. It is the practice of the Water Department to appropriate its Capital Improvement Program (CIP) plan throughout the Fiscal Year, instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants. Funding is currently available in the Unspecified All -Funds project within the Water and Sewer Capital Projects Fund for the purpose of funding the W&SS Repl Contract 2020 WSM-H project. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are available in the Unspecified All -Funds project within the W&S Capital Projects Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the W&S Capital Projects Fund for the W&SS REPL CONTRACT 2020 WSM-H project to support the execution of the construction contract.
