HomeMy WebLinkAbout063234-A1 - General - Contract - Chisholm Trail Center, LPDate Received: 4/27/2026 Time Received: 4:26 p.m. Record Number: PN25-00208 City Secretary No.: FIRST AMENDMENT 63234-Al TO CITY SECRETARY CONTRACT NO. 63234, EASEMENT ENCROACHMENT LICENSE AGREEMENT This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 63234, EASEMENT ENCROACHMENT LICENSE AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a home rule municipal corporation of Tarrant County, Texas ("City"), acting herein by and through its duly authorized City Manager, Assistant City Manager, or Development Services Department Director, and Chisholm Trail Center, LP, a Texas limited partnership ("Licensee"), acting herein by and through its duly authorized representative. RECITALS WHEREAS, City and Licensee made and entered into City Secretary Contract No. 63234 on May 7, 2025 (the "Agreement"), to authorize the use of the City's easement for the purposes of constructing, installing, and maintaining private storm drain as part of the development on the property; and WHEREAS, the parties wish to amend the Agreement to include private underground electric, gas and telecom lines, and a light fixture; and WHEREAS, it is the mutual desire of City and Licensee to execute this Amendment to the Agreement to revise "Exhibit A" in the Agreement to depict the revised encroachment area. NOW, THEREFORE, City and Licensee, acting herein by and through their duly authorized representatives, enter into the following that amends the Agreement: 1. Page 1 of 6 Updated 2024 OFFICIAL RECORD CITY SECRETARY FT. WORTH, TX "Exhibit A" in the Agreement is hereby replaced with the attached revised description of the encroachment area, labeled as "Revised Exhibit A." F1 The effective date of this Amendment shall be the date of its execution by the City. 3. All other provisions of the Agreement which are not expressly amended herein shall remain in full force and effect.
