HomeMy WebLinkAbout065117 - General - Contract - Naval Air Station Joint Reserve Base Fort Worth (NASJRB)CSC No. 65117 MOU: N83447-26-16369 NAS JRB FTW 11000 Ser N00/091 19 Aug 24 MEMORANDUM OF UNDERSTANDING BETWEEN COMMANDING OFFICER NAVAL AIR STATION JOINT RESERVE BASE FORT WORTH AND CITY OF FORT WORTH, TEXAS, USA REGARDING POLICE AND SECURITY SERVICES This is a Memorandum of Understanding (MOU) between Naval Air Station Joint Reserve Base, Fort Worth (NASJRBFTW) and the City of Fort Worth. When referred to collectively, NASJRBFTW and the City of Fort Worth are referred to as the "Parties". 1. BACKGROUND: It is the policy of the Department of the Navy (DON) and Naval Air Station Joint Reserve Base, Fort Worth to cooperate with civilian law enforcement officials to the maximum extent practicable, consistent with the needs of national security and military preparedness, the historic tradition of limiting direct military involvement in civilian law enforcement activities, and the requirements of applicable law. DOD instructions 4000.19 and 6055.6 provide guidance for support provided to civilian law enforcement agencies. Historically, the City of Fort Worth has provided police and law enforcement support in emergency and special events onboard the installation. 2. PURPOSE: This Memorandum of Understanding is entered into for the purpose of outlining the understandings related to aid in the areas of Police and Security Services. Fire Protection, Emergency Medical Services and use of the Small Arms Range are addressed in separate agreements. The Parties enter into this MOU to provide for mutual response to emergencies when requested and within the scope of services provided by each Party. 3. UNDERSTANDINGS OF THE PARTIES: a. NASJRBFTW intends to: (1) Provide speed and traffic control devices as needed for emergencies or special events onboard NASJRBFTW. (2) Provide law enforcement equipment to supporting agencies as needed to support NASJRBFTW when requested from the installation. (3) Provide assistance for major emergency traffic or perimeter control within NASJRBFTW jurisdiction when requested by the installation. OFFICIAL RECORD CITY SECRETARY FT. WORTH, TX (4) Establish primary point of contact for all emergency law enforcement response and planning efforts. b. The City of Fort Worth intends to: (1) When requested by the installation, assist in law enforcement and traffic management driving on or off base as needed in emergencies and special events. (2) Assist with fence line perimeter security when requested by the installation. (3) Serve as a source for breath alcohol testing for suspected DUIs involving military and/or civilian personnel when requested by the installation. (4) Establish primary point of contact for all emergency law enforcement response and planning efforts. 4. PERSONNEL: Each Party is responsible for all costs of its personnel, including pay and benefits, support, and travel. Each Party is responsible for supervision and management of its personnel. 5. GENERAL PROVISIONS: a. POINTS OF CONTACT: The following points of contact (POC) will be used by the Parties to communicate in the implementation of this MOU. CORRESPONDENCE: All correspondence to be sent and notices to be given pursuant to this MOU will be addressed to the parties: (1) Naval Air Station Joint Reserve Base, Fort Worth 1510 Chennault Avenue Fort Worth, TX 76127-5001 (2) City of Fort Worth Police Department Fiscal Command - Contracts 505 West Felix Street Fort Worth, TX 76115 c. FUNDS AND MANPOWER: This MOU does not document nor provide for the exchange of funds or manpower between the Parties, nor does it make any commitment of funds or resources. d. MODIFICATION OF MOU: This MOU may only be modified by the written agreement of the Parties, duly signed by their authorized representatives. This MOU will be reviewed annually on or around the anniversary of its effective date, and triennially in its entirety. e. DISPUTES: Any disputes relating to this MOU will, subject to any applicable law, Executive Order, Directive, or Instruction, be resolved by consultation between the Parties or in accordance with DoDI 4000.19. This agreement does not constitute a federal contract, and does not obligate any appropriated or non -appropriated funds of the federal government, or and agency, department, bureau, division, office, or either entity or instrumentality of the U.S. Government, the Department of Defense, or the U.S. Navy. This agreement is not subject to the Tucker Act, the Contract Disputes Act, the Competition in Contracting Act, or the Federal Acquisition Regulation. No claim or demand may be submitted to the government or cause of action pursued before the courts or administrative boards, or any other tribunal, for any monetary or equitable relief, or to otherwise enforce the provisions of this agreement. f. JURISDICTION: NASJRBFTW is a federal military installation with exclusive federal jurisdiction. Nothing in this agreement cedes or relinquishes, or is intended to cede or relinquish, exclusive federal jurisdiction of lands or property under exclusive federal jurisdiction occupied by NASJRBFTW, nor does this agreement grant any license, casement or property right or entitlement to the City of Fort Worth or the State of Texas. g. TERMINATION OF MOU: This MOU may be terminated in writing, at anytime, by either Party. h. TRANSFERABILITY: This MOU is not transferable except with the written consent of the Parties. i. ENTIRE UNDERSTANDING: It is expressly understood and agreed that this MOU embodies the entire understanding between the Parties regarding the MOU's subject matter. This MOU is executed by NAS JRB Fort Worth and the City of Fort Worth, Texas, each respective governmental entity acting by and through its City Mayor and authorized U.S. Navy personnel in the manner required by each respective Charter or Federal Regulation and/or instruction as required by law. j. EFFECTIVE DATE: This MOU takes effect beginning on the day after the last Party signs. k. EXPIRATION DATE: This MOU expires ten years from the date of signature of the last party to sign this document, and shall remain in force until modified or terminated. 1.
