This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 62852 ("First Amendment") is made and entered into by and between the City of Fort Worth ("City"), a home -rule municipal corporation of the state of Texas, and Ashton Dallas Residential L.L.C. ("Developer"), a Texas limited liability company. WHEREAS, the City and Developer entered into a Community Facilities Agreement for the construction of public infrastructure improvements for a Project known as Cattleman's Crossing Phase 2, City Project Number 105042, City Secretary Contract Number 62852 ("CFA"); and WHEREAS, the sanitary sewer Improvements being constructed pursuant to the CFA will connect to Cattleman's Crossing Phase 1, City Project Number 104562, that has been constructed by Developer, and will be served by an existing lift station that is being expanded by Developer through the Cattleman's Crossing Force Main & Lift Station Project, City Project Number 105377, collectively referred to as the "Parent Projects" in the CFA; and WHEREAS, City has determined that the existing lift station that is being expanded by Developer has the capacity to serve 30 of the 101 residential lots in the development (`Existing Lift Station Lots"); and WHEREAS, City and Developer desire to amend the CFA to reflect the timing of the provision of sanitary sewer service to the Existing Lift Station Lots and the remaining lots; NOW THEREFORE, City and Developer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends City Secretary Contract No. 62852: 1. The CFA is amended to add Section 38 which shall be and read as follows: 38. Sanitary Sewer Service The Improvements being constructed pursuant to this Agreement are being constructed in City of Fort Worth, Texas Amendment No. 1 to City Secretary Contract No. 62852 Page 1 of 4 OFFICIAL RECORD CITY SECRETARY FT. WORTH, TX connection with the Cattleman's Crossing final plat FP-24-194 ("Final Plat"), which consists of 101 residential lots. Of the 101 lots, 30 of the lots will be served by an existing lift station ("Existing Lift Station Lots"). The remaining 71 lots will be served by an expansion to the lift station being constructed by Developer ("Expanded Lift Station Lots"). The Lift Station Lots and Expanded Lift Station lots are more specifically identified in Exhibit D which is attached hereto and incorporated herein by reference. After the City has accepted the improvements in this CFA, and the Final Plat is recorded, City will allow sanitary sewer service to be provided to the Lift Station Lots. The City shall not provide sanitary sewer service to the Expanded Lift Station Lots, and the City shall not issue any building permits for the Expanded Lift Station Lots until construction of the expansion to the lift station is completed and accepted by the City. 2. The CFA is amended to add Exhibit D, which is attached hereto and incorporated herein by reference. 3. a. All other provisions of City Secretary Contract Number 62852 which are not expressly amended herein, shall remain in full force and effect. b. All terms in this First Amendment that are capitalized, but not defined, shall have the meanings ascribed to those terms in City Secretary Contract Number 62852.
