HomeMy WebLinkAbout060383-A2 - Construction-Related - Contract - Teague Nall and Perkins, Inc.CSC No. 60383-A2 AMENDMENT No. 2 TO CITY SECRETARY CONTRACT No. 60383 WHEREAS, the City of Fort Worth (CITY) and Teague Nall and Perkins, Inc., (ENGINEER) made and entered into City Secretary Contract No.60383,(the CONTRACT) which was authorized by M&C 23-0840 on the 26th day of September, 2023 in the amount of $523,000.00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment No.l in the amount of $99,100.00 which was administratively authorized on July 22, 2024: and WHEREAS, the CONTRACT involves engineering services for the following project: Sycamore Park Design Phase II, CPN 104193; and WHEREAS, it has become necessary to execute Amendment No. 2 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $14,200.00. This amendment is for additional services related to the pavilion relocation and migratory bird nest survey. The additional scope of work and professional fees are as follows: PAVILION RELOCATION: Consultant will provide updated design plans and specifications for the relocation of the pavilion on the southeast side of the park near Sycamore Creek and Vickery to the southwest side of the park, near the parking lot located by Vickery Blvd and Sycamore St. Included in this item: ■ One (1) Plan showing the updated pavilion location and layout. ■ One (1) Plan showing the revised grading for the new location and the previous location. ■ One (1) Plan showing the revised electrical plan incorporating the new location. Consultant will coordinate with a subconsultant to provide a migratory bird survey as associated with the TPWD grant. Included in this item: ■ A migratory bird nest survey o A series of 20-30 meter (m) transects to provide a comprehensive visual assessment of all possible nesting habitats within the entire project area. o Identify and remove old unoccupied nests to discourage nesting in the project area. o Active nests will be located and recorded with a sub -meter accurate Global Positioning System (GPS) unit. ■ Marked active nests shall have an exclusion limit placed on them 30 m from the nest per strict conservation guidance. ■ Once fledglings have left the nest and the nest is confirmed abandoned for the season, work will be permitted to resume in the area. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize execution of Amendment No. 2 to the Engineering Agreement with Teague Nall and Perkins, Inc., (TNP) to provide additional design services in an amount up to $14,200.00, for a revised contract amount of $636,300.00 for the 2022 Bond Sycamore Park project (City Project No. 104193). On September 26, 2023, the City Council authorized execution of an Engineering Services Agreement with TNP to provide design and construction documents for the park improvements associated with Phase II at Sycamore Park for a contract amount of $523,000.00 (M&C 23-0840). Amendment No. 1, in the amount of $99,100.00, was administratively approved on July 22, 2024, to provide construction documents for a pavilion located in the north side of Sycamore Park. Amendment No. 2 is for TNP to provide additional design and construction documents for a second pavilion located in Sycamore Park. The City's Extendable Commercial Paper (ECP) (M&C 22-0607; Ordinance 25675-08-2022) provides liquidity to support the appropriation. Available resources will be used to actually make any interim progress payments until debt is issued. Once debt associated with a project is sold, debt proceeds will reimburse the interim financing source in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance 25515-05-2022). Funding is budgeted in the 2022 Bond Program Fund for the Parks & Recreation Department for the purpose of funding the 2022 Bond Sycamore project, as appropriated.
