WHEREAS, the City of Fort Worth (City) and Wade & Associates,
Inc., (Engineer) made and entered into City Secretary Contract No.
22266, (the Contract) which was authorized by the City Council by
M&C C-15708 on the 15th day of October, 1996; and
WHEREAS, the Contract involves engineering services for the
following project:
Engineering contract for the design of Sanitary Sewer
Main C1C4B Drainage Area Sanitary Sewer Evaluation
Study and Improvements (Group 6, Contract 2).
WHEREAS, it has become necessary to execute Amendment No. 1
to said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:
1.
Article I of the Contract is amended to include the
additional engineering services specified in a proposal letter
dated July 13, 1999 a copy of which is attached hereto and
incorporated herein. The cost to City for the additional services
to be performed by Engineer total $11,976.07.
2.
Article III, Section D of the Contract is amended to provide
for an increase in the maximum fee to be paid to Engineer for all
work and services performed under the Contract, as amended, so
that the total fee paid by the City for all work and services
shall not exceed the sum of $1,193,953.07.

herein shall remain in full force and effect.

Dear Mr. Boyer:
We have addressed the City comments concerning the previously submitted contract amendment and
we are pleased to submit the revised contract amendment for your consideration and approval. The
revised amendment will constitute the first formal contract amendment under the aforementioned
agreement. Specifically, we are seeking the approval of the following additional work items in this
amendment as described below:
Contract Reference: Attachment A-3 to the Contract, Phase III — Design Services: Supplemental
Field Operations Lines
• Design Impacts Resulting from the Removal of L-563 from the Part 3 Construction
Documents:
Under the above referenced contract element, WADE's sub -consultant, Garcia & Associates,
recently submitted a request for a contract amendment to recover costs associated with the
removal of L-563 from the construction documents for the Part 3 project plans as directed by the
City. An easement needed to be acquired for this sewer lateral and the property owner refused to
cooperate as the attached Garcia's letter explains. This created an extensive delay in bidding this
project and it was decided to pull this lateral from the plans in order to finalize the contract
documents for bidding. We have included a copy of Garcia's amendment request letter for your
review and approval. WADE has not endorsed the fee amount requested, but we believe that
their amendment request is justified. We have also included our costs associated with this
amendment item, including a 10% administrative fee. Please advise us immediately if there is a
problem with this request.

• Design Impacts Associated with the Issuance of Addendum Nos. 1, 2, & 3. to the Part 5
Project:
WADE was asked to issue 3 Addenda on the Part 5 project that rescheduled the bid opening date,
incorporated "Fig. B" as the new backfill and embedment specification, and issued 3 revised plan
sheets for L-556 to respond to City Staff's design revision requests for trenchless methods in an
alley. Additionally, WADE was also asked to design a short (115 LF) sewer line extension of
M32R in Cantey Street. The information below reflect costs incurred for this work:

• Design Impacts Associated with the Final Review of the Part 8 Project:
During the final review for the Part 8 project, several additional work items arose that are
presently being addressed by WADE during final edits to the contract documents. Specifically,
WADE was asked to re -incorporate the rehabilitation of a portion of L-510 that was eliminated
previously from the project. We are rehabilitating the portion of L-510 located on the Lilly B.
Clayton Elementary School property that will now become a private sewer line. Overall, WADE
is designing the trenchless rehabilitation of about 420 LF of L-5 10.

WADE was also asked to re-examine the design for approximately 1,050 LF of M-32 in 8`s Ave.
from W. Arlington Street to south of Mitchell Ave. to existing Sta. 15+00 due to contradictions
in as -built information being represented by TCB -and Halff for the existing 20 -inch waterline
along this portion of 80' Ave. Additionally, WADE was asked to delete the proposed storm
sewer junction box at the crossing of M-32 and the 84 -inch storm sewer near W. Arlington Street
in order to reduce project costs.
Lastly, WADE also incorporated the appropriate changes to the contract documents associated
with the utilization of the latest version of City's Standard Specifications, including the inclusion
of Fig. B as the new backfill and embedment specification for sanitary sewer pipes that required
multiple edits on 18 plan sheets. The information below reflect costs incurred for all of this
work:

Therefore, we are requesting revised Contract Amendment No. 1 in the amount of $ 11,976.07 to the
M-C1C4B Agreement. This amendment would increase the total contract amount from
$1,181,977.00 to $1,193,953.07, representing an increase of approximately one percent (1.01%).

Garcia and Associates Engineering, Inc. is pleased to present the following Amendment No. 1 to our
existing Sub -consultant Services Agreement for additional services requested by the City of Fort
Worth for the above referenced project.
The requested changes are as follows:
1. Remove L-563 from the project due to lack of authorized right of entry and easement documents.
This line segment requires re -alignment and modifications to an existing packaged lift station.
Unfortunately, the property owner will not cooperate with City staff or Sub -consultant for right
of entry and easement documents required for construction.

C1C4B DRAINAGE AREA SANITARY SEWER EVALUATION
STUDY AND IMPROVEMENTS (GROUP 6, CONTRACT 2), DOE
NO. 1805, PROJECT NO. PS46-070460410230
The proposed amendment will reimburse Wade & Associates, Inc. (WAI), for the addi-
tional survey and design services they provided on the project as requested by the City.
In order to advertise the Part 3 plans on schedule, staff directed WAI to remove Lateral
L-563 from the project plans. Staff has not been able to obtain a permanent easement
necessary to construct the lateral. It was also necessary to revise the project plans and
specifications to reflect the latest City details and specifications which were developed
after the project was advertised for bid. In addition, the Water Department requested that
WAI prepare plans for Lateral L-5 10 which had been previously eliminated from the
project.
Wade & Associates, Inc., has requested reimbursement in the amount of $11,976.07 for
the additional survey and design services thereby increasing the contract fee from
$1,181,977.00 to $1,193,953.07. I believe this fee is fair and reasonable for additional
services that were provided.
Please authorize this additional design fee by your signatures on the attached contract
amendment form.
