WHEREAS, the City of Fort Worth (City) and Wade & Associates,
Inc., (Engineer) made and entered into City Secretary Contract No.
23763, (the Contract) which was authorized by the City Council by
M&C C-16691 on the 24th day of March, 1998; and
WHEREAS, the Contract involves engineering services for the
following project:
Engineering contract for the design of Main M-390 Drainage
Area, Sanitary Sewer Rehabilitation and Improvements (Group
6, Contract 1), Part 5 and M -106R Drainage Area Sanitary
Sewer System Rehabilitation and Improvements (Group 4,
Contract 2), Part 7
WHEREAS, it has become necessary to execute Amendment
No. 1 to said Contract to include an increased scope of work
and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:
1.
Article I of the Contract is amended to include the
additional engineering services specified in a proposal letter
dated July 13, 1999 a copy of which is attached hereto and
incorporated herein. The cost to City for the additional services
to be performed by Engineer total $7,630.08.
2.
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $317,630.08.

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Dear Mr. Domenech:
We have evaluated the City's comments on the first contract amendment submission and we
have addressed those concerns in the revised contract amendment document being submitted.
The revised amendment will constitute the first formal contract amendment under the
aforementioned agreement. Specifically, we are seeking approval of the following additional
work items in this amendment request as described below:
Phases la & lb — Design Services: Sewer Pipeline Rehabilitation for M-390 (Basin E &
misc. locations) Drainage Areas
• Design Impacts from the Incorporation of the Revised Backfill and Embedment
Detail (Fig. B) into the Part 5 Plans.
Under the above referenced contract element, WADE had to incorporate changes on 29
sheets of M-390, Part 5 project plans that revised the backfill and embedment detail to
"Fig. B". Activities associated with this amendment item included revising plan/profile
sheets (CAD edits), plotting plan sheets, and revising specifications/contract documents.
The table below reflects the staff hours and miscellaneous costs associated with this
work item.

• Design Impacts Associated with the Incorporation of Short Bores and Relative
Specification Changes into the M-390 Project Plans:
During the final review of the above referenced project plans, it was approved by City
staff to reinstate the use of short bores for sewer replacements/extensions through tree
roots and for limited utility crossings. This change forced significant modifications to
the plan sheets in order to incorporate the short bores and reduce the footage of the
construction method "By Other Than Open Cut". Additionally, the amendment
addresses the City's requirement to specifically note DIP when utilizing construction
methods "By Other than Open Cut" as well as numerous specification revision
'discovered after the release of the May 1999 version of the City of Fort Worth Standard
Specifications D and DA. This resulted in nearly 60 specific plan edits on 15 plan
sheets. Activities in this amendment item include revising plan/profile sheets (CAD
edits), revising specifications/contract documents and revising the engineer's
construction cost estimate. The table below reflects the staff hours and miscellaneous
costs associated with this work item.

• Easement Instrument Revisions:
During the design of this project, we received 5 requests from Real Property for revisions
to permanent and temporary construction easement instruments to reflect changes in
ownership and address property owner conditions to acquiring the easement from the
Wade & Associates, Inc.

property owner. This resulted in numerous design changes and edits on several plan
sheets. At this time, our surveyor, Gorrondona & Associates, Inc. have not requested
additional fees for making these instrument revisions. We will submit their request as
part of another contract amendment as they occur. Activities in this amendment item
include revising plan/profile sheets (CAD edits), revising easement instruments and
easement table/exhibit in the plans. The table below reflects the staff hours and
miscellaneous costs associated with this work item.

In summary, WADE seeks to recover actual expenses that either have been or are currently
being incurred for all of the work items addressed and itemized in the table below.

Therefore, we are requesting Contract Amendment No. 1 in the amount of $7,630.08 to the
original M-390 Agreement. This amendment would increase the total contract amount from
$310,000.00 to $317,630.08, representing an increase of nearly 2.5 percent (2.46%). As is
indicated throughout the above narrative work descriptions, WADE received verbal
authorization prior to performing the services discussed above.

The proposed amendment will reimburse Wade & Associates, Inc. (WAI), for the addi-
tional services they provided on the project as requested by the City.
After design was substantially completed, staff directed WAI to revise the project plans
to reflect the latest City details and specifications. It was also necessary to revise the in-
struments for five rights of entry to reflect the latest owners.
Wade & Associates, Inc., has requested reimbursement in the amount of $7,630.08 for
the additional design services thereby increasing the contract fee from $310,000.00 to
$317,630.08. I believe this fee is fair and reasonable for additional services that were
provided.
Please authorize this additional design fee by your signatures on the attached contract
amendment form.
