(Li I1 (No M&C Needed) COUNTY OF TARRANT b WHEREAS, the City of Fort Worth (City) and Wade & Associates, Inc., (Engineer) made and entered into City Secretary Contract No. 21834, (the Contract) which was authorized by the City Council by M&C C-15412 on the 23rd day of April, 1996; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of Sanitary Sewer Main 189R Parallel Relief and Sanitary Sewer Main 129 Replacement. WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated July 21, 1999, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $10,249.50. 2. Article III, Section A of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee p%,.id by the City for all work and services shall not exceed the sum of $60,421.50. 0 % F1OCRMd CO1 L �i �7V�1U:'�UU9 �LSWe 3. We have addressed your concerns; therefore, please review this amendment request at your earliest convenience. As you are aware since this project began, numerous issues have arisen that have significantly complicated the design process. Please be advised that we only seeking the cost recovery of those design -related tasks that we have performed that exceeded our current scope of work. Specifically, we are seeking the approval of the following items as described below: • . Design Impacts Resulting from Sub -Consultant Cost Overruns: During the design process WADE's sub -consultant for surveying, McDonald & Associates, Inc. exceeded their contract budget by nearly $800 due to preparation numerous easements for the project. As you are aware, McDonald & Associates went out of business prior to completing their easement work for us. We brought in Gorrondona & Associates, Inc. to finish their work on this project. Also due to sewer alignment and other design changes (discussed in greater detail in sections below), we had Gorrondona prepare 3 additional permanent easements for acquisition as well as prepare several new temporary construction easements for this project. Gorrondona has invoiced us for more than $2,550 for supplemental surveying and instrument preparation. WADE has also incurred significant printing/reproduction cost overruns from Jim's Reproduction Service, Inc. since this project was bid in two project parts. Jim's has been paid over $1,350 above their contract budget. The table below reflects the true sub -consultant cost overruns, including a 10% administrative fee on this project to date. Fee Total Expenses McDonald & Associates, Inc. $ 796.00 $ 79.60 $ 875.60 Gorrondona & Associates, Inc. $ 2,562.00 $ 256.20 $ 2,818.20 Jim's Reproduction Services, Inc. $ 1,368.46 $ 136.84 $ 1,505.30 TOTAL: $ 4,726.46 $ 472.64 $ 5,199.10 • Design Impacts Associated with Part 1 and 2 Plan/Contract Document Revisions Resulting from the coordination of M-390 consultant projects, Real Property requests and comments from the Parks and Recreation Department: In the Part 1 project, WADE had to redesign the upper portion of the M-129 project along Mitchell Street and Hwy 287 in order to address TxDOT permit impacts to the RJN/Garcia & Associates and J.B. Davies sewer designs in this area. As a result, WADE had to revise 3 plan sheets. Additionally, WADE had to modify portions of the plans related to L-6342 and L-2534 that also required the revision of one plan sheet and the deletion of another. WADE had to redesign the creek crossing location of M-238 due to property owner (Dr. Naus) opposition to an easement acquisition. The resulted in the preparation of an "in -place" design that included piers and extensive erosion and pollution control elements. WADE was also active in the negotiation process for construction access to this property. Another set of design impacts included responding to the City of Fort Worth Recreation Department's request for incorporating gabion-lined channel improvements into this project. This resulted in the preparation of a cost estimate and preliminary plans, numerous meetings of the subject and ultimately some minor design revisions to the project plans for M -189R along Overton Park Drive East. The true costs incurred associated with the project changes outlined above far exceed the legal cost limitations of a twenty-five (25%) increase in contract value. Subsequently, we have evaluated our expenses and modified them per your recent comments. Consulting Engineers Page 3 of 3 Ms. Dena Johnson, P.E. 7/21/99 Therefore, WADE is requesting Contract Amendment No. 1 in the amount of $ 10,249.50 to the M- 189 and M-129 Agreement. The inclusion of this amendment would increase the total contract amount from $ 50,172.00 to $ 60,421.50, representing an increase of slightly more than twenty percent (20.43%). Since this project is essentially complete, WADE intends to invoice to the contract limit, including this amendment, once the City approves it. SEWER PROJECT NO. PS58-070580173510, DOE NO. 1330 The proposed amendment will reimburse Wade & Associates, Inc. (WADE), for the ad- ditional survey and design services they provided on the project as requested by the City. After design was substantially completed, the Parks and Community Service Department requested that the plans be revised to allow for gabion lining along Overton Park Drive East. It was also necessary to redesign the creek crossing location of M-238 due to objec- tion of a property owner from whom a permanent easement was needed. WADE also had to redesign a portion of M-129 in order to address TxDOT comments and incorporate into this project, the plans of other consultants with design work in the area. It was also necessary to prepare additional easement documents due to alignment changes on the project. These alignment changes were requested by staff. Wade & Associates, Inc., has requested reimbursement in the amount of $10,249.50 for the additional survey and design services thereby increasing the contract fee from $50,172.00 to $60,421.50. I believe this fee is fair and reasonable for additional services that were provided.
