WITNESSETH WHEREAS, the State and the Local Government executed a contract on August 23rd of 2022 to effectuate their agreement for safety improvements at the crossing of North Beach Street and the Trinity Railway Express (TRE)'s track; from 250 feet South of the Railroad (TRE) Crossing to 400 feet North of the Railroad (TRE) Crossing. The scope also includes pedestrian improvements; and, WHEREAS, it has become necessary to amend that contract to increase Federal funding to 100% from 80% due to project meeting fully funded eligibility federal requirements and decreasing indirect state cost by $257.00 due to fiscal year 2023 new rate of indirect state cost. NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties, the State and the Local Government do agree as follows: AGREEMENT 1. Description of Amended Items A. Attachment B, Project Budget, is deleted in its entirety and replaced with Attachment B-1, Project Budget, which is attached to this Amendment. The total estimated cost of Project is decreased by $257.00, from $715,067.00 to $714,810.00. B. Attachment C, Resolution, Ordinance, or Commissioners Court Order, is amended by adding Attachment C-1, Resolution, Ordinance, or Commissioners Court Order, which is attached to this Amendment. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, THAT: The City Manager is authorized to execute Amendment No. I to the Advance Funding Agreement with the Texas Department of Transportation (City Secretary No. 59040) to increase Federal participation to 100% from 90% and decrease indirect state cost by $257.00 for the construction of the 2019 Railroad Trinity Railway Express (TRE) at North Beach Street Project.
