HomeMy WebLinkAbout28367-03-2026 - City Council - OrdinanceOrdinance No. 28367-03-2026 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE MUNI AIRPORT GRANTS FEDERAL FUND, IN AN AMOUNT UP TO $1,725,895.00, SUBJECT TO THE RECEIPT OF THE GRANT, FOR THE PURPOSE OF FUNDING AIRPORT JOINT RESEAL AND PAVEMENT IMPROVEMENTS, AIRFIELD SHOULDER PRESERVATION, A PAVEMENT MANAGEMENT REPORT, RELOCATION OF THE TAXIWAY PAPA FENCE AND ROAD, AND THE EXTENSION OF TAXIWAY PAPA AT PEROT FIELD FORT WORTH ALLIANCE AIRPORT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2025-2026 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Muni Airport Grants Federal Fund, in an amount up to $1,725,895.00, subject to the receipt of the grant, for the purpose of funding airport joint reseal and pavement improvements, airfield shoulder preservation, a pavement management report, relocation of the Taxiway Papa fence and road, and the extension of Taxiway Papa at Perot Field Fort Worth Alliance Airport. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the application for and acceptance of the Bipartisan Infrastructure Investment and Jobs Act Fiscal Year 2026 Airport Infrastructure Grant, if awarded, from the Federal Aviation Administration in an amount up to $1,553,305.00 for airport joint reseal and pavement improvements, airfield shoulder preservation, a pavement management report, relocation of the Taxiway Papa fence and road, and the extension of Taxiway Papa at Perot Field Fort Worth Alliance Airport; 2. Authorize the use of land credits in an amount up to $172,590.00 for the City's in -kind local match of the project costs; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Muni Airport Grants Federal Fund, in an amount up to $1,725,895.00, subject to the receipt of the grant, for the purpose of funding airport joint reseal and pavement improvements, airfield shoulder preservation, a pavement management report, relocation of the Taxiway Papa fence and road, and the extension of Taxiway Papa at Perot Field Fort Worth Alliance Airport. DISCUSSION: On November 15, 2021, the Infrastructure Investment and Jobs Act of 2021 (IIJA), also known as the Bipartisan Infrastructure Law (BIL), was signed into law, allocating $1.2 trillion in new spending of which $550 billion will go towards investment in our nation's core infrastructure priorities including roads and bridges, rail, transit, ports, airports, the electric grid, water systems and broadband. The infrastructure bill includes $15 billion for airport infrastructure grants over five years with $3 billion to be distributed annually. Of this amount, $12.4 billion would go to commercial service airports and $2.5 billion for nonprimary commercial service and general aviation airports. These funds will be available for: • Airport Improvement Program (AIP) Grants for runways, gates and taxiways that increase safety and expand capacity; • Airport Terminal Improvement program for terminals, concessions and multimodal connections for increased terminal energy efficiency and accessibility; and • Air Traffic Control infrastructure to replace facilities and equipment and improve safety, security and environmental standards. Based on the classification provided by the Federal Aviation Administration (FAA), Perot Field Fort Worth Alliance Airport (Airport) is eligible to receive up to $1,553,305.00 under the program for this Fiscal Year 2026 (FY26). Per the FAA, the IIJA will provide "funding to modernize infrastructure, increase equity in transportation, help fight climate change, strengthen the supply chain and create jobs." Additionally, these grants will operate under the same guidelines as the FAA's AIP which requires specific projects to be identified on the sponsor's application. FY26 is anticipated to be the final year of IIJA-supported allocations. Funding from this FY26 IIJA grant will be used for, but not limited to, the following projects: • Joint Reseal and Pavement Improvements • Airfield Shoulder Preservation • Pavement Management Report • Taxiway Papa Fence and Road Relocation • Taxiway Papa Extension Joint Reseal & Pavement Improvements This will consist of resealing joints, miscellaneous pavement repairs, and application of new pavement markings on Runway 16R-34L at the Airport. The concrete pavement joints have reached the end of their service life and are in need of replacement. The improvements to the joints and repairs to the concrete will mitigate stormwater run-off from entering the pavement, prolonging the life of the concrete. The application of new pavement markings will ensure uniformity of the markings across the entire runway. Airfield Shoulder Preservation This will consist of restoring the deteriorated asphalt shoulders on the Airport through seal coat surface treatment and surface grinding for proper water drainage. It will also include clearing and reseeding the turf built up to the pavement edges. Pavement Manaaement Resort This will consist of performing a pavement condition evaluation to assess the current condition of the pavement at the Airport, helping to prioritize maintenance and rehabilitation needs to extend the pavement service life. It will also include a Pavement Condition Index (PCI) inspection and update, pavement data analysis, a final report with summary of findings and recommendations, and the estimated costs for repairs. Taxiwav Paaa Fence and Road Relocation This will consist of relocating the vehicle service road and perimeter security fence on the west side of the Airport. Both the vehicle service road and perimeter security fence currently reside in the Runway Safety Area (RSA) of Runway 16R-34L, which poses an operational safety issue. It will also include the mass grading and other earthwork needed for future Phase IV and Phase V of the Taxiway Papa Extension project, as well as evaluating potential impacts of existing Remote Transmitter Receiver (RTR) power and fiber optic communications infrastructure. Taxiwav Paaa Extension This will consist of designing and constructing Phase IV of the Taxiway Papa Extension project, which will extend Taxiway Papa north by approximately 1,340 feet from Taxiway Foxtrot to Taxiway Golf on the west side of the Airport. Components will include grading and other earthwork, concrete pavement and asphalt shoulder installation, new airfield markings, new lighting, and new signage. While IIJA funding is anticipated to require a 95/5 cost -share, the FAA retains discretion to award eligible projects under alternate Airport Improvement Program (AIP) funding categories, which may require a 90/10 cost -share. To ensure timely acceptance of the grant award and avoid project delays, approval of City participation of up to a 10% local match is requested, should the FAA determine a higher match is required at the time of award. Existing land credits remaining from land donations at the Airport will be used for the City's in -kind match of $172,590.00. ADVISORY BOARD APPROVAL - On January 29, 2026, the Aviation Advisory Board voted to recommend that the City Council approve the application for and acceptance of this grant. Perot Field Fort Worth Alliance Airport is located in COUNCIL DISTRICT 10. A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: Department of Transportation FAA FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, in the Muni Airport Grants Federal Fund for the Bipartisan Infrastructure Investment and Jobs Act Fiscal Year 2026 Airport Infrastructure Grant project. The Aviation Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred, the Aviation Department has the responsibility to validate the availability of funds. This is a reimbursement grant.
