AMENDMENT No . 1
TO CITY SECRETARY CONTRACT No. 58759
WHEREAS, the City of Fort Worth (CITY) and Teague Nall and Perkins,
Inc., (ENGINEER) made and entered into City Secretary Contract No. 58759,
(the CONTRACT) which was authorized by M&C 23-0055 on the loth day of
January, 2023 in the amount of $ 573,536.00; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Water Line Extension Wichita Deduct Meter, CPN 104021; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement, which
amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and incorporated
herein. The cost to City for the additional design services to be performed
by Engineer totals $734,975.00. (Water: $521,571.00; Sewer: $213,404.00)
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $1,308,511.00.

Teague Nall and Perkins, Inc. is submitting this fee Amendment for the above -referenced contract based on
additional services required. The following is a brief description and cost for the additional services to be
provided on this project:
Credit for Final Design and Construction Phase Services — Forest Hill Drive Water Line:
The original scope of the project included the design of approximately 1,056 LF of 12" water line
extension on Forest Hill Drive. TNP reached out to the City staff after completing QAQC on the 60%
Forest Hill Design Package design package to inquire whether the water line was already constructed,
because when performing QAQC of the WL sequencing plan, TNP discovered new valves were captured
by survey that were not in the Water Department as -built records. TNP asked the Water Planning
Department to confirm with developer installing CPN 102443 if the line was installed. And the line was
installed, but they were waiting for other improvements as part of the same CFA to get final acceptance.
TNP has included a credit to the design fee for the 90%, 100% and the Construction Phase services
included in the original LOE for Forest Hill Drive.
II. Additional Design - Added Water and Sewer Lines:
This Amendment No. 1 will add the design of the following replacements, relocations and/or lowering
of the following water and sewer lines. Please refer to the Attachment E1 and Attachment E2 in this
amendment package for were added to the scope for the reasons outlined in the table below

- TNP identified the conflict with both the proposed NB storm sewer
and SB storm sewer to be installed as part of the Wichita Street

Part I & 2 - Additional ES2 and SS2 water lines in Wichita
Street - Extend to added ETV site & Conflicts w/ Wichita Street

- City desires to install an emergency transfer valve and meter
station to feed the one-way ES2 system from the SS2 main. These

line in the future and repair the street at a future date.
Misc Length Adjustments from Original Scope
- These lengths are associated with line segments that were
included in the original scope. Due to the sanitary sewer line
lowering, some additional length was added to re-route the flow in

back lots. The water adjustment is simply the difference in as-
built/surveyed lengths of the water line and the lengths in the
original table included in Attachment A of the original contract.

III. Additional Design Services — Emergency Transfer Valve and Meter Station Design:
Over the past several months, TNP has coordinated with the City PM's, Water Planning Department and
Plant Operations staff to scope out the need for the City to add a feed to the City's eastside 2 (ES2)
one-way water system from the southside 2 (SS2) pressure plane. The scope added in this Addendum
No. 1 will include the design of an emergency transfer valve and meter station (ETV) to provide an
emergency feed from the SS2 system into the ES2 system.
The scope added includes additional coordination meetings with the City PM and Plant Operations
during the design, a site layout, mechanical/material list, and a structural design of the proposed vault.

will be standard foundation details selected based on soil characteristics.
The design services included in this amendment also include the electrical distribution and controls (ED&C)
and the instrumentation and controls (I&C) designs for the ETV site. An additional service is included in
the subconsultant fee for the cost to perform a physical path study from the vault to the Randol Mill
Repeater site during the design phase. The ID&C and ED&C design services will be completed by a sub -
consultant through TNP.
The scope of this ETV design includes two (2) soil borings for the soil characteristics needed for structural
design of the ETV vault and foundations for the panel and antenna. The geotechnical services will be
performed by a sub -consultant through TNP.
IV. Addition to Scope of Design Services — Miscellaneous Items:
A. Addition of a Project Specific Traffic Control Plan Design:
The design scope in the current contract assumed TCP typical details would be utilized for the project
and did not include a project specific traffic control plan (TCP) design. The scope of services included
in this Amendment No. 1 include the effort to TNP to develop a project -specific detailed TCP at two
(2) intersections, which TCP's need to be incorporated in the Tarrant County's roadway project
drawings as a separate phase to their TCP sequencing. This effort included substantial additional
coordination efforts between the Tarrant County roadway project and the scope included with this
project, obtaining approvals by both Tarrant County and the City of Fort Worth, and
coordination/reviews during bidding and construction. The fee for this service includes detailed TCPs
at two (2) intersections. The first intersection, Joel East Rd. and Wichita St. will require two phases
for (i) for the construction of one (1) sanitary sewer crossing to lower the existing line out of conflict
with the proposed storm sewer, then (ii) two (2) proposed 12" water line crossings to be extended
to the future ETV valve in a separate construction contract. The second intersection is at Wichita and
Altamesa Blvd. for the construction of the 24" water line relocation prior to the Roadway widening
project being able to install the proposed storm drain in the area where in -conflict.
B. Sanitary Sewer By-pass Pumping Plan:
The lowering of the existing sanitary sewer line will require a by-pass pumping and construction
sequencing plan for this project. The original scope only included the removal/replacement of
existing sanitary sewers at grade. The sanitary sewer lowering will require a by-pass pumping plan,
and it will require sequencing to coordinate the handling of the sewer by the portions of this lowering
to be included in the two separate construction contracts, one of which will be included in the County's
roadway reconstruction contract.
C. Water Line Sequencing Plan:
The original contract did not include any design associated with the 24" ES2 one-way system, nor
the design of any shut -downs on the existing 24" E52 system, as it would have originally required
tapping the existing 24" line. This 24" ES2 water line will now require to be shut-in due to the need
to relocate a valve that is in -conflict with the Wichita Street Widening proposed storm sewer system.
TNP's design also added the replacement of two additional lines tying into this 24", which will require
the replacement of the old gate valves on the branches at Tiffany Meadows and Marrs drive. This
is the effort to develop a sequencing plan to be included in the drawings that are to be incorporated
into the County's construction package via a separate ILA with City and Tarrant County.
D. Additional Topo and Boundary — 15' Wide Swath Additional Topo:
The City selected the recommended route for the southern portion of the 12" water line extension
south towards Everman, which will be located outside the limits of the existing Wichita Street ROW
for the southern -most approximate 2,200 feet of the water line extension. The original scope only
included topographic and boundary survey from ROW to ROW. The scope added via this
amendment is for the additional effort to obtain an additional 15' wide swath for the topo survey
needed to finalize the design of the southern portion of this water line extension, which is also needed
for the proposed easement exhibits that will be required.

E. SUE & Design Team Support — QL-A Test Holes and QL-B on Joel East:
City staff has reviewed and approved QL-A test holes and QL-B through D utility designation on
this project. TNP identified the need for a total of six (6) QL-A testholes be obtained to finalize
design on ATT duct bank, Atmos gas lines, Williams pipeline, 24" water line, existing storm drain
crossing for downstream end of neighborhood replacementsand tie-in points to existing water lines
for this project. The scope added via this amendment along Joel East Road is along a congested,
narrow segment of roadway ROW. There are existing overhead and underground electric lines,
fiber optic, and water and sanitary sewer lines along this segment. City has agreed that it be best
to designate the locations of these facilities prior to finalizing the proposed alignment of the 16"
SS2 extension along Joel East Rd to the proposed ETV.
F. Conflict Analysis - Markups to Wichita Street Widening project plans and Utility Coordination:
When TNP was working on the design of the scope included in the original contract, TNP coordinated
with Tarrant County to obtain the 100% design drawings for the Wichita Street Widening project.
TNP performed a conflict analysis to identify five major conflicts with the proposed
roadway/drainage improvements and the existing City of Fort Worth water and sewer facilities.
This effort also includes the preparation of exhibits and markups to the proposed roadway drawings
to be used during additional coordination meetings between TNP, City and County, which meetings
are captured elsewhere in this amendment.
G. Additional Plan Set — Four Additional Reviews, Additional Layouts & P&P's to reference scope
of Adjoining projects being performed by Others, and Meetings with City:
The additional water and sewer line design scope added via this amendment will be broken up
much differently than that was defined in the original scope. There has been substantial coordination
efforts with the City and County representatives to figure out how the projects would be broken up
and constructed, with the additions of the ETV design, water line extension on Joel East, the sanitary
sewer lowering and additional water relocations due to conflicts with the County's roadway plans
and the lines that were not captured in the neighborhood replacements portion of the original scope.
The project has been decided to be divided into three (3) separate plan sets that are being
reviewed:
• Part 1A — Improvements within/immediately adjacent to Wichita Street Widening project,
which are to be incorporated into County's roadway plans.
• Part 1 B — Sanitary sewer lowering and water line replacements along Rustic Forest, Tiffany
Meadows, Altamesa Blvd and Marrs north of Altamesa Blvd.
• Part 2 — ETV, Joel East 16" WL Extension, Wichita 12" remaining extension to south, all
remaining Alta Mesa Neighborhood replacements.
The overlapping projects will require additional layouts, plan and profile sheets, sequencing plans
and notes to reference the scope to be performed in each drawings set. The efforts also include
several additional meetings with City staff to come up with a final scope for the amendment.
H. Additional Meetings — Coordination with Tarrant County and Water Department:
These are the additional meetings with the County, County's utility coordinator, County's design
engineer and City PM to coordinate the scope of work and design to be broken out and incorporated
into the County's bid package. The fee included in this Amendment No. 1 includes all the past
meetings, along with eight (8) additional coordination meetings up to the advertisement phase.

Water Line Extension Wichita Street Deduct Meter Contract

Lump Sum Project
I. Compensation
A. The ENGINEER shall be compensated a total lump sum fee of $734,975.00 as
summarized in Exhibit B-1 — Engineer Invoice and Section IV — Summary of Total
Project Fees. The total lump sum fee shall be considered full compensation for the
services described in Attachment A, including all labor materials, supplies, and
equipment necessary to deliver the services.
B. The ENGINEER shall be paid monthly payments as described in Section II -
Method of Payment.
II. Method of Payment
A. Partial payment shall be made to the ENGINEER monthly upon City's approval of
an invoice prepared and submitted by the ENGINEER in the format and including
content as presented in Exhibit B-1, Progress Reports as required in item III. of
this Attachment B, and Schedule as required in Attachment D to this Agreement.
B. The estimated current physical percent complete as required on the invoice shall
be calculated from the progress schedule as required in Attachment D to this
Standard Agreement and according to the current version of the City of Fort
Worth's Schedule Guidance Document.
C. The cumulative sum of such monthly partial fee payments shall not exceed the
total current project budget including all approved Amendments.
D. Each invoice shall be verified as to its accuracy and compliance with the terms of
this Agreement by an officer of the ENGINEER.
III. Progress Reports
A. The ENGINEER shall prepare and submit to the designated representative of the
Water Department monthly progress reports and schedules in the format required
by the City.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of Amendment No. 1 in the amount of $734,975.00, to City Secretary Contract
No. 58759, an engineering agreement with Teague Nall and Perkins, Inc. for the Water Line
Extension Wichita Street Deduct Meter project for a revised contract amount of $1,308,511.00; and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water and Sewer Capital Projects Fund in the amount of $734,975.00, transferred from available
PayGo funds within the Water and Sewer Fund, for the purpose of funding the Water Line Extension
Wichita Street Deduct Meter project (City Project No. 104021) and to effect a portion of Water's
contribution to the Fiscal Years 2026-2030 Capital Improvement Program.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to authorize execution of Amendment
No. 1 in the amount of $734,975.00 to an engineering contract with Teague, Nall and Perkins for the Water
Line Extension Wichita Street Deduct Meter project (City Project No. 104021).
On January 10, 2023, M&C 23-0055, the City Council authorized an engineering agreement in the amount
of $573,536.00 with Teague Nall and Perkins, Inc. (City Secretary Contract No. 58759) for the Water Line
Extension Wichita Street Deduct Meter project.
Amendment No. 1 will provide for additional plans, specifications and easement preparation for water
main and sanitary sewer replacements on the following streets:

Additionally, Amendment No. 1 will provide for the following: design of an Emergency Transfer Valve (ETV)
and meter station to provide an emergency feed from the Southside II pressure plane into the Eastside II
pressure plane; additional traffic control plan; water sequencing plan; additional topographic and boundary
survey; and additional coordination with various stakeholders on the project.
It is the practice of the Water Department to appropriate its Capital Improvement Program (CIP) plan
throughout the Fiscal Year (FY), instead of within the annual budget ordinance, as projects commence,
additional funding needs are identified, and to comply with bond covenants.
Funding is budgeted in the Transfer to Water/Sewer account of the Water and Sewer operating budget for
the purpose of funding the Water Line Extension Wichita Street Deduct Meter project.

The Director of Finance certifies that funds are currently available in the Water & Sewer Fund and upon
approval of the above recommendations and adoption of the attached appropriation ordinance, funds will
be available in the W&S Capital Projects Fund for the WL EXT.WICHITA ST DEDUCT METER project to
support the execution of the amendment. Prior to any expenditure being incurred, the Water Department
has the responsibility to validate the availability of funds.
