HomeMy WebLinkAbout064467-A1 - General - Contract - Tarrant CountyCSC No. 64467-A1 STATE OF TEXAS § COUNTY OF TARRANT § FIRST AMENDMENT TO THE INTERLOCAL AGREEMENT BETWEEN TARRANT COUNTY, TEXAS AND THE CITY OF FORT WORTH This First Amendment ("Amendment") to the Interlocal Agreement Between Tarrant County, Texas ("County") and the City of Fort Worth ("City"), shall be effective on the date the last signature is affixed ("Effective Date"). County and City have reviewed the Amendment and make the following findings: RECITALS WHEREAS, County and City entered into an Interlocal Agreement Between County and City ("Agreement") on January 13, 2026, following approval by the Tarrant County Commissioners Court as reflected in Commissioners Court Order Number 146549, to provide City with forensic analysis of evidence in criminal investigations and prosecutions in exchange for a fee, WHEREAS, County has sufficient forensic analysis capacity to assist City in expediting the testing of controlled substances in certain cases associated with the pending criminal charges and cases of incarcerated individuals, who may be eligible for release from a Tarrant County jail facility upon the completion of the testing of the controlled substances; and WHEREAS, the expedited testing of controlled substances by County associated with individuals arrested by City and held at a Tarrant County jail facility will assist in reducing the Tarrant County jail population and provide defendants with the opportunity to obtain a bond and more expeditiously resolve their criminal charges; and WHEREAS, County and City wish to amend the Agreement to allow for the forensic analysis of evidence from certain identified cases at no cost to City; WHEREAS, County and City will continue to make any and all payments or performance required by the Agreement and this Amendment from current revenues legally available. NOW THEREFORE, County and CCA agree as follows: 1. Under Paragraph 1, titled "Description of Work," subparagraph B is amended to read as follows: B. WORTH, TX Pagel of3 1. County may identify selected cases to City which are associated with a person incarcerated at a Tarrant County jail facility for expedited testing. A designated employee of the Tarrant County Medical Examiner's Office will provide City with information identifying cases selected for expedited testing by the County. For cases selected by the County for expedited forensic analysis and which the Tarrant County Medical Examiner's Office identifies to the City, County will provide these services at no cost to City. 2. DISCUSSION: Since 2003, the Fort Worth Police Department's Crime Laboratory (Crime Lab) has utilized the Tarrant County Medical Examiner's Office to conduct professional forensic analysis to aid in efficiently managing the Crime Lab's caseload. This Mayor and Council Communication is to request authorization to execute an agreement with Tarrant County, acting on behalf of the Tarrant County Medical Examiner's Office, in the amount of $350,000.00 annually for an initial term of one year and four (4) additional renewal options. Tarrant County Medical Examiner (TCME) will provide toxicological analysis and other forensic laboratory services for the Crime Lab as requested to help reduce any backlog of Sexual Assault Kit analysis and other forensic case analysis. ADMINISTRATIVE CHANGE ORDER: An administrative change order or increase may be made by the City Manager up to the amount allowed by relevant law and the Fort Worth City Code and does not require specific City Council approval as long as sufficient funds have been appropriated. AGREEMENT TERM: Upon City Council approval, the agreement shall begin upon execution by the Assistant City Manager and expire October 31, 2026. RENEWAL OPTIONS: The Agreement may be renewed for up to four (4) one-year renewal terms, at the City's option. This action does not require specific City Council approval provided that the City Council has appropriated sufficient funds to satisfy the City's obligations during the renewal period. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are available in the current operating budget and grant budget, as previously appropriated, in the General Fund and the Grants Operating State Fund for the FY2026 State SAK-ET Program to support the approval of the above recommendation and award of the contract. Prior to any expenditure being incurred, the Police Department has the responsibility to validate the availability of funds. BACKGROUND On January 13, 2026, the Commissioners Court, through Court Order 4146549, approved an ILA with the City of Fort Worth for the TCMEO to provide forensic laboratory services, including Biology/DNA, Firearms, Toxicology and Drug Chemistry analysis, in an amount to not exceed $350,000. The term of the ILA is from October 1, 2025, through September 30, 2026, with three (3) one (I) year renewal options. This amendment allows the County to identify eligible cases for expedited testing and provide those specific services at no cost to the City. All other services will continue to be provided in accordance with the existing fee schedule .and terns of the original ILA. The District Attorney's Office has approved this amendment as to form. FISCAL IMPACT Expenses incurred by providing specific services to the City at no cost are anticipated to be offset by expediting case adjudication. Revenue Tarrant County receives will be dependent upon the number of requests for services that the TCMEO receives, and will be deposited in 10000-2026 General Fund/23 10 100000 Medical Examiner/Various revenue codes. Fees billed to the City of Fort Worth for FY 2026 as of May 1, 2026 is $95,375.
