HomeMy WebLinkAbout025162 - Construction-Related - Contract - Tarrant County, • r �� � 1 / v THE STATE OF TEXAS �r�•I1 > ` ; . � � �.� CON R CiEfTVApRY o��./�� KNOW ALL BY THESE PRESENTS COUNTY OF TARRANT INTERLOCAL AGREEMENT This Agreement is made and entered into this ��%�� day of �, 1999, by and between the County of Tarrant, acting herein by and thro h rts0governing body, the Commissioners Court, hereinafter referred to as COLJNTY, and the City of Fort Worth, acting herein by and through Mike Groomer, its duly authorized Assistant City Manager, hereinafter referred to as CITY, both of Tarrant County, State of Texas, witnesseth: WHEREAS, this Agreement is made under the authority of Sections 791.001- 791.029, Texas Government Code; and WHEREAS, each governing body, in performing governmental functions or in paying for the performance of governmental functions hereunder, shall make that performance or those payments from current revenues legally available to that party; and WHEREAS, each governing body finds that the subject of this Agreement is necessary for the benefit of the public and each has the legal authority to perform and to provide the governmental function or service which is the subject matter of this Agreement; and WHEREAS, each governing body finds that the performance of this Agreement is in the common interest of both parties and that the division of costs fairly compensates the performing party for the services or functions under this Agreement; and WHEREAS, each governing body agrees to share in the cost of the services described below. NOW THEREFORE, the COLTNTY and CITY agree as follows: 1. The COLJNTY agrees to provide the labor and equipment necessary to: (a) provide reconstruction and maintenance on North Tarrant Parkway from U.S. Hwy. 377 west to Fossil Ridge High School; and, (b) reconstruct approximately 132,204 square feet of the City's sections of Haslet Roanoke Road (also named Westport Parkway/Keller Haslet) between Denton Road and Chaparral. The CITY'S sections of Haslet Roanoke Road in need of reconstruction include sections from the center line of the road and other ����� C� ��r�P� U'�� �Q� � � ���'�G���Y �. � ;;,�,� ' . �o ��".�t';� � � ` . - .� full sections of roadway. In conjunction with the repair of the CITY' S sections, the COiTNTY will reconstruct their sections from the center line of the roadway. The work will include 6" of base stabilization and a 2 course chip seal penetration surface. The COiJNTY will clean and pull ditches as needed on both projects. 2. The COUNTY agrees to pay for the cost of the materials for any maintenance and reconstruction of North Tarrant Parkway, as specified in paragraph 1(a) of this agreement. The CITY agrees, at its sole option, to either deliver to the COLTNTY all of the materials necessary and required for the reconstruction of the CITY' S portion of Haslet Roanoke Road, as described in paragraph 1(b) of this agreement, or to pay for the actual cost of the materials incurred by the COUNTY. The value of the materials for the reconstruction of Haslet Roanoke Road shall not exceed $ 31,500. 3. The CITY agrees to the closing of the road for through traffic for the duration of the project or as deemed necessary by the COUNTY. Q Nothing in the performance of this Agreement shall impose any liability for claims against the COLJNTY other than claims for which liability may be imposed by the Texas Tort Claims Act. 5. Nothing in the performance of this Agreement shall impose any liability for claims against the CITY other than claims for which liability may be imposed by the Texas Tort Claims Act. � The parties to the Agreement do not intend for any third party to obtain a right by virtue of this Agreement. 7. By entering into this Agreement, the parties do not intend to create any obligations express or implied other than those set out herein; further, this Agreement shall not create any rights in any party not a signatory hereto. 8. This Agreement shall terminate on completion of the subject matter of this contract or on the conclusion of the COIJNTY' S fiscal year, unless renewed for a period of one year in written notice signed by both parties. DISCUSSION: Tarrant County has submitted an interlocal agreement to reconstruct and provide maintenance on North Tarrant Parkway from U.S. Highway 377 west to Fossil Ridge High School at no cost to the City. Tarrant County will also reconstruct the City's section of Haslet Roanoke Road (also named Westport Parkway/Keller Haslet) between Old Denton Road and Chaparral. Under this agreement, Tarrant County will provide all necessary materials, equipment and labor to reconstruct North Tarrant Parkway. The City agrees, at its sole option, to either deliver to Tarrant County all of the materials necessary for reconstruction of the City's portion of Haslet Roanoke Road, or to pay for the actual cost of the materials as incurred by Tarrant County.
