AMENDMENT No . 1
TO CITY SECRETARY CONTRACT No. 56386
WHEREAS, the City of Fort Worth (CITY) and DeOtte, Inc, (ENGINEER)
made and entered into City Secretary Contract No. 56386, (the CONTRACT)
which was authorized by M&C 21-0552 on the loth day of August, 2021 in
the amount of $ 545,029; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
HROM, S Cravens Rd Culvert Improvements Design Contract; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated April 3, 2026, a copy
of which is attached hereto and incorporated herein. The cost to City
for the additional design services to be performed by Engineer totals
$ 35, 4 64 .
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $580,493.
3.
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

CIVIL ENGINEERING
This Contract Amendment is in reference to the contract between DeOtte, Inc. and the
City of Fort Worth (the City) dated September 28, 2021, herein referred to as the
"Contract."
Our services during construction of this project exceeded the allotted time for those due
several factors. The project was to be completed within 140 Days of the Notice to
Proceed which occurred on October 1, 2021. Factors outside of our control and yours
as well delayed the completion of the project almost 4 years. Certain design
considerations, specifically addressing concerns over the sewer including bypass
pumping design and development of a contingency plan when the requirements of the
plan were illusive. Right-of-way, specifically easements, for the project required many
adjustments and preparation for legal proceedings.
The attached Level of Effort Spreadsheet includes the work for additional design work,
project coordination and project management for the Project. We anticipate that the
amendment amount will be sufficient to complete all work through completion of design
and initiation of the construction phase of the project.
Original Contract Amount $545,029.00
Contract Amendment No. 1 $35,464.00
Revised Contract Total $580,493.00
