Home My WebLink About056722-A3 - Construction-Related - Contract - Garver, LLCCSC No. 56722-A3 AMENDMENT No.3 TO CITY SECRETARY CONTRACT No. 56722 WHEREAS, the City of Fort Worth (CITY) and Garver LLC, (ENGINEER) made and entered into City Secretary Contract No. 56722, (the CONTRACT) which was authorized by M&C 21-0876 on the 911 day of November, 2021 in the amount of $ 217,498.00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment No. 1 in the amount of $71,325.00 which was administratively authorized on Setember 4th 2022 and Amendment No. 2 in the amount of $ 259,802.00 which was authorized by M&C 23- 0501 on June 13th, 2023; and WHERE AS, the CONTRACT involves engineering services for the following project: Water and Sanitary Sewer Replacement Contract 2019, WSM-N, CPN 103358; and WHERE AS, it has become necessary to execute Amendment No. 3 to the CONTRACT to include an increased scope of work and revised fee. NOW T HEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $188,535.00. (Water: $94,033.00; Sewer: $94,502.00) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $737,160.00. 3. On November 171h, 2025, the City provided correspondence directing the inclusion of the identified infrastructure for replacement and to be included in a separate design package as part of the project. Garver will also perform record drawing and utility research within the proposed improvement areas to identify potential utility conflicts and challenges. The improvements are located within the existing City right-of-way and will terminate prior to entering TXDOT right-of-way near SE Loop 820. This work is anticipated to align with the basic scope of services outlined in the original agreement. Upon acceptance of this amendment, Garver will immediately mobilize survey crews and begin design efforts. To ensure alignment and clarity before advancing to detailed design, Garver will prepare a 30% conceptual deliverable illustrating the proposed improvements. This conceptual package will allow for review and feedback prior to incorporating the amendments into the overall 90% design deliverable. The work will proceed alongside the original project scope through completion, and no separate bid package will be created. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize execution of Amendment No. 3 in the amount of $188,535.00 to an Engineering Agreement with Garver, LLC, for the Water and Sanitary Sewer Contract 2019 WSM-N project (City Project No. 103358). On November 9, 2021, M&C 21-0876, the City Council authorized an Engineering Agreement in the amount of $217,498.00 with Garver, LLC. (City Secretary Contract No. 56722) for the Water and Sanitary Sewer Contract 2019 WSM-N project. The agreement was subsequently revised by Amendment No. 1 in the amount of $71,325.00, administratively authorized on September 4, 2022, that provided survey and design for the additional water and sanitary sewer mains on the project; and Amendment No. 2 in the amount of $259,802.00, authorized by M&C 23-0501 on June 13, 2023, for survey and design for the additional water and sanitary sewer mains on the project. Amendment No. 3 will provide for the necessary design services for the replacement of 24" water main and 8" sanitary sewer on Oak Grove Road from Sycamore Creek to South East Loop 820 Freeway. It is the practice of the Water Department to appropriate its Capital Improvement Program (CIP) plan throughout the Fiscal Year (FY), instead of within the annual budget ordinance, as projects commence, additional funding needs are identified, and to comply with bond covenants.
