AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GRANTS OPERATING OTHER FUND, FROM
AVAILABLE FUNDS, IN THE AMOUNT OF $75,000.00 FOR THE TEXAS OPIOID
ABATEMENT (CITY PROJECT NO. 104782); PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS THAT:
SECTION 1.
In addition to those amounts allocated to the various City departments for Fiscal Year 2025-2026 in
the Budget of the City Manager, there shall also be increased estimated appropriations in the Grants Operating
Other Fund in the amount of $75,000.00, from available funds, for the Texas Opioid Abatement (City Project
No. 104782).
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions
shall be and remain in full force and effect.
SECTION 3.
This ordinance shall be cumulative of Ordinance 27979-09-2025 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

(ALL) Approve the Allocation of Texas Opioid Settlement Funds in the Amount Up to $648,136.56 to the City of Fort Worth Fire Department, the
City of Fort Worth Homeless Strategies Division, and the City of Fort Worth Neighborhood Services Department; Authorize the Use of Interest
Earnings in an Amount Up to $75,000.00, and Adopt Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Approve the allocation of Texas Opioid Settlement Funds to implement opioid mitigation activities for the City of Fort Worth Fire Department
in the amount of $410,204.00; the City of Fort Worth Homeless Strategies Division to increase the High ImpACT services contract with My
Health, My Resources of Tarrant County in the amount of $236,625.00; and to the City of Fort Worth Neighborhood Services Department in
the amount of $1,307.56 for administrative costs,
2. Authorize the use of interest earnings in an amount up to $75,000.00, all subject to receipt of interest earned from the award,
3. Authorize execution of an amendment to City Secretary Contract 64551 with My Health, My Resources of Tarrant County to increase funding
by $236,625.00, to be spread over the remainder of Fiscal Year 2026, Fiscal Year 2027, and a portion of Fiscal Year 2028;
4. Adopt the attached appropriation ordinance increasing receipts and appropriations in the Grants Operating Other Fund for the Texas Opioid
Abatement Fund project in an amount up to $75,000.00 (City Project No. 104782); and
5. Authorize the City Manager or his designee to administer and allocate the funds to the departments for eligible opioid mitigation activities in
accordance with the Texas Opioid Settlement requirements and City policies.
DISCUSSION:
The purpose of the Mayor and Council Communication (M&C) is to approve the allocation of Texas Opioid Settlement Funds to implement opioid
mitigation activities for the City of Fort Worth Fire Department, the City of Fort Worth Homeless Strategies Division and to the City of Fort Worth
Neighborhood Services Department.
Through the adoption of Resolution 5499-11-2021 on November 9, 2021, the City Council approved the City of Fort Worth (City) joining the opioid
settlement negotiated by the Texas Attorney General, affirmed its support for the Texas Opioid Abatement Fund Council and Settlement Allocation
Term Sheet, and recognized the need for resources to address opioid-related harms in the City of Fort Worth.
On March 1, 2023, the City received its first opioid settlement payment from the Texas Opioid Abatement Fund Council in the amount
of $665,760.73. On April 11, 2023, M&C 23-0255 approved the use of these funds and designated the Neighborhood Services Department as the
lead department to oversee the allocation and administration of the opioid settlement funds. The settlement program is expected to last
approximately 18 years, and the City anticipates receiving an estimated total of nearly $2.6 million from the initial settlement and nearly $2
million from a subsequent settlement.
On April 16, 2024, the City received its second settlement payment in the amount of $129,518.88. On April 10, 2025, the City received its third
settlement payment in the amount of $631,860.97. These funds were deposited into the Grants Operating Other Fund for allowable expenses
related to opioid remediation activities as defined by the Texas Opioid Abatement Fund Council for the Texas Opioid Abatement Fund project
(City Project No. 104782).
Staff recommends allocating these funds to support opioid mitigation activities administered by City departments as outlined below:

The High ImpACT program addresses the intersection of severe mental illness and unsheltered homelessness by providing mobile psychiatric
services and housing assistance and is managed by My Health, My Resources of Tarrant County (MHMR). On March 19, 2024, City Council
approved M&C 24-0200 to fund the first five months of the 17-month High ImpACT Pilot Program in the amount of $1,096,847.00. On December
10, 2024, City Council approved M&C 24-1032 allocating $2,178,304.00 to fund the remaining 12 months of the pilot program. On August 12,
2025, City Council approved M&C 25-0658 authorizing the execution of a $1,269,005.00 contract with MHMR, along with contracts with Acclaim
Health and Partnership Home, to continue the program in Fiscal Year 2026 with options to renew through Fiscal Years 2027, 2028, and 2029.
The City Manager's Office Homeless Strategies Division will utilize the opioid settlement funds allocated through this M&C to increase the MHMR
contract through a two-year agreement spanning three fiscal years to provide substance use counseling and medication services for individuals
experiencing opioid addiction who are enrolled in the High ImpACT program.
In addition, interest earnings associated with the Texas Opioid Abatement Fund project have accrued and continue to accrue. Currently,
$15,240.10 in interest earnings have been recorded, with additional estimated interest earnings expected to be received. This M&C
authorizes the use of interest earnings in an amount up to $75,000.00, subject to receipt of interest earned, and adopts an appropriation ordinance
to increase receipts and appropriations in the Grants Operating Other Fund for the Texas Opioid Abatement Fund project (City Project No.
104782).
The departments will implement eligible opioid remediation activities and establish program timelines necessary to carry out program goals in
accordance with the Texas Opioid Settlement requirements and City policies. Awarded funds should be spent within a 24-month timeframe.
The City was notified that a fourth distribution from the Texas Opioid Abatement Fund is forthcoming; however, the amount and timing of the
distribution have not been confirmed. Staff will monitor the receipt of these funds and will return to City Council with a future M&C to appropriate
and allocate the funds in accordance with applicable requirements.
The programs will be available in ALL COUNCIL DISTRICTS.
A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: Fire
Department and Homeless Strategies
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds
will be available in the current operating budget in the Grants Operating Other Fund and that funds are available in the current operating budget, as
previously appropriated, in the Grants Operating Other Fund for the TX Opioid Abatement Fund project to support the opioid mitigation activities
and execute the contract. Prior to any expenditure being incurred, the Neighborhood Services Department has the responsibility to validate the
availability of funds.
