MORPHY STREET, RIGHTS -OF -WAY LOCATED BETWEEN MAGNOLIA AVENUE AND ALLEN AVENUE; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: SECTION 1. St. Joseph Court, a fifty-seven (57) foot wide right-of-way located between South Main Street and BNSF Railway Company, situated in the F. Richards Survey, Abstract No. 1297, and including a forty (40) foot wide strip dedicated by the plat filed in Volume 63, Page 56, Plat Records of Tarrant County, Texas, and including a seventeen (17) foot wide strip dedicated by the plat filed in Cab. A, Slide 3086, Plat Records of Tarrant County, Texas, and containing approximately 0.643 acres of land more or less, as more specifically described in Exhibit "A" which is attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. A portion of Bryan Avenue, a sixty (60) foot wide right-of-way located between W. Magnolia Avenue and E. Morphy Street, situated in the F. Richards Survey, Abstract No. 1297, according to the plat filed in Volume 32, Page 382, Plat Records of Tarrant County, Texas, and including a 5'x5' R-O-W dedication, as filed in Instrument No. D222129369, and being a portion of E. Morphy Street, being dedicated in parts totaling a sixty (60) foot wide right-of-way located between S. Main Street and Bryan Avenue, as filed in Volume 32, Page 382, Plat Records of Tarrant County, Texas, Volume 388-137, Page 82 and Volume 388-202, Page 95, Plat Records of Tarrant County, Texas, and containing approximately 0.843 acres of land more or less, as more specifically described in Exhibit "A" which is attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 3. Easements to the land in the above -described vacated rights -of -way are hereby released and shall revert to the adjacent owner as provided by law. SECTION 4. Ordinance No. 28435-04-2026 Page 1 of 2 All existing utility easements shall be retained by the City until such time all utilities located in the easements are relocated at the owner's expense. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 6. That this ordinance shall take effect upon adoption. Waive any and all purchase fee value of the vacated land in accordance with City policy. DISCUSSION: Teague Nall and Perkins, on behalf of the Tarrant County Hospital District, has requested a vacation of the above -mentioned rights -of -way, all of which will be replatted with the adjoining property to allow for consolidation of the John Peter Smith (JPS) hospital campus and construction of a new hospital tower and Central Utility Plant (CUP). The City Plan Commission recommended approval of this request at its October 15, 2025 meeting. A final plat application (FS-25-310) has been received and is under review in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the identified rights -of -way through plat dedication. The City does not own any fee interest in the rights -of -way or own any property adjacent to the rights -of -way and did not expend any City funds to obtain the rights -of -way. In accordance with the City's policy regarding street and alley vacation transactions Mayor and Council Communication (M&C G-15624), staff recommends waiving the purchase price of the identified rights -of -way. This project is located in COUNCIL DISTRICT 9. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
