HomeMy WebLinkAbout28436-04-2026 - City Council - OrdinanceORDINANCE NO.28436-04-2026 AN ORDINANCE VACATING AND EXTINGUISHING AN ALLEY SITUATED BETWEEN STATE HIGHWAY 121 AND NOBLE AVENUE, AND BEING ALL THE REMAINING ALLEY BETWEEN LOTS 33-40 AND LOTS 65-72 OF THE BAKER BROTHERS ADDITION, SECOND FILING, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS ACCORDING TO THE PLAT RECORDED IN VOLUME 600, PAGE 578, PLAT RECORDS, TARRANT COUNTY, TEXAS, CONTAINING APPROXIMATELY 5,329 SQUARE FEET MORE OR LESS; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the alley situated between State Highway 121 and Noble Avenue, in the Atkin McLemore Survey, Abstract No. 1056, and being all the remaining alley between Lots 33-40 and Lots 65-72 of the Baker Brothers Addition, Second Filing, an addition to the City of Fort Worth, Tarrant County, Texas according to the plat recorded in Volume 600, Page 578, Plat Records, Tarrant County, Texas, containing approximately 5,329 square feet of land, more or less, and as more specifically described in Exhibit "A," which is attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the easements to the land in the above -described vacated alley are hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing utility easements shall be retained by the City until such time all utilities located in the easements are relocated at the owner's expense. Adopt an ordinance vacating the alley located within the Baker Brothers Addition between State Highway 121 and Noble Avenue; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. DISCUSSION: Audra Buckley of Permitted Development LLC, on behalf of Sami Ebrahim of DFW Oil, Inc., has requested a vacation of the alley right-of-way located between Lots 33-40 and Lots 65-72 of the Baker Brothers Addition, Second Filing. The alley is located north of State Highway 121, south of Noble Avenue, west of Riverside Drive and east of Chandler Drive. The City Plan Commission recommended approval of this request at its October 15, 2025 meeting. An acceptable final plat (FS-25-286) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the identified right-of-way through plat dedication. The City does not own any fee interest in the right-of-way or own any property adjacent to the right-of-way and did not expend any City funds to obtain the right-of-way. In accordance with the City's policy regarding street and alley vacation transactions (Mayor and Council Communication (M&C) G-15624), staff recommends waiving the purchase price of this right-of-way. This project is located in COUNCIL DISTRICT 11. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
