("Consultant") made and entered into City of Fort Worth Secretary Contract No. 24224 ("Contract"), which was authorized by the City Council by M&C C-16995 on the 25th day of August 1998; and WHEREAS, the Contract involves professional services for the following project: Village Creek Wastewater Treatment Plant Uprating Modifications - Phase I; and WHEREAS, it has become necessary to amend the Contract to include an increased scope of work and/or revised maximum fee. NOW, THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the contract: 1. EXHIBIT A- Supplemental Scope of Services of the Contract is amended by inserting Section 2- Basic Services, Item 2.11: "Amendment No. 1 provides for the design of the additional electrical improvements as summarized in Exhibit "B-6", attached hereto and incorporated herein. 2. ATTACHMENT "B" - Compensation and Schedule of the Contract is amended to provide for an increase of $130,000.00 in the maximum fee to be paid to Consultant for all work and services under the Contract, as amended, so that the total fee to be paid by City for all work and services shall not exceed the sum of $703,222.00. 3. A short tap feeder is provided from the manhole to the slector switch. Two longer feeders are provided from the protective switch to the selector switch in the the plarrt process area. FOR THE DESIGN OF THE VILLAGE CREEK WASTEWATER TREATMENT PLANT UPRATING MODIFICATIONS, PHASE I �COMMENDATION: It is recommended that the City Council authorize the City Manager to execute Amendment No.1 to the engineering agreement with Freese & Nichols, Inc., City Secretary Contract No. 24224, for the design of the Village Creek Wastewater Treatment Plant (VCWWTP) Uprating Modifications, Phase I, increasing the total contract cost by $130,000, from $573,222 to $703,222. DISCUSSION: On August 25, 1998 (M&C C-16995), the City Council authorized the execution of an engineering agreement with Freese & Nichols, Inc. for the design of the VCWWTP Uprating Modifications, Phase I. The Texas Natural Resource Conservation Commission requires that the VCWINTP either be expanded or that the current permit be upgraded to a higher rated capacity. This project includes specific facility modifications to provide the required capacity for the proposed rating of 166 MGD (average day flow) and/or 369 MGD Peak Flow (2-hour peak). The project also includes the installation of the four automatic backwash effluent filters and modifications to several existing final clarifiers and aeration basins. As part of the design, the engineer was required to review the dual electric power system for the connection of new process equipment. The engineer found that the primary equipment fuses and electrical cable in the planYs dual electrical feed manholes facilities need to be replaced. This amendment is for the design of additional electrical improvements for the VCWWTP. These improvements include relocation of the primary equipment fuses and electrical cable in the planYs dual electrical feed manholes. Freese & Nichols Inc. has proposed to do this work for a fee not to exceed $130,OQ0. Freese & Nichols, Inc. is in compliance with the City's M/WBE Ordinance by committing to an additional 33% M/WBE participation on this amendment.
