HORTON — TEXAS, LTD. This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 61622 ("First Amendment") is made and entered into by and between the City of Fort Worth ("City"), a home -rule municipal corporation of the state of Texas, and D.R. Horton — Texas, Ltd. ("Developer"), a Texas limited partnership. WHEREAS, the City and Developer entered into a Community Facilities Agreement for the construction of public infrastructure improvements for a Project known as Northstar West Phase 2, City Project Number 104823, City Secretary Contract Number 61622 ("CFA"); and WHEREAS, a portion of the sanitary sewer Improvements being constructed pursuant to the CFA will connect lots to a gravity sewer main that is being improved by 170 Northstar Ranch Developer, Inc. under a separate community facilities agreement referred to as the Primary Project in the CFA ("Gravity Lots"); and WHEREAS, the remaining sanitary sewer Improvements being constructed pursuant to the CFA will connect lots to sanitary sewer mains being constructed by 170 Northstar Ranch Developer, Inc. under a separate community facilities agreement, referred to as the Primary Project in the CFA, that will ultimately connect to a lift station that is currently under construction ("Lift Station Lots"); and WHEREAS, City and Developer desire to amend the CFA to reflect the timing of the provision of sanitary sewer service to the Gravity Lots and the Lift Station Lots; NOW THEREFORE, City and Developer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends City Secretary Contract No. 61622: 1. The CFA is amended to add Section 37 which shall be and read as follows: OFFICIAL RECORD CITY SECRETARY City of Fort Worth, Texas Amendment No. 1 to City Secretary Contract No. 61622 FT. Sanitary Sewer Service The Improvements being constructed pursuant to this Agreement are being constructed in connection with the Northstar West Phase 2, final plat FP-25-034 ("Final Plat"), which consists of 250 residential lots. Of the 250 lots, 70 of the lots will connect to a gravity sewer main that is being improved by 170 Northstar Ranch Developer, Inc. pursuant to the Parent Project ("Gravity Lots"). The remaining 180 lots connect to sanitary sewer mains being constructed by 170 Northstar Ranch Developer, Inc. pursuant to the Primary Project and will ultimately connect to a lift station being constructed by Developer, City Project Number 105187, City Secretary Contract Number 63381 ("Lift Station") that is currently under construction ("Lift Station Lots"). The Gravity Lots and Lift Station Lots and their connection points are more specifically identified in Exhibit D which is attached hereto and incorporated herein by reference. After the City has accepted the improvements in the Parent Project, and the Final Plat is recorded, City will allow sanitary sewer service to be provided to the Gravity Lots. The City shall not provide sanitary sewer service to the Lift Station Lots, and the City shall not issue any building permits for the Lift Station Lots until the Lift Station is constructed and accepted by the City. 2. The CFA is amended to add Exhibit D, which is attached hereto and incorporated herein by reference. 3. a. All other provisions of City Secretary Contract Number 61622 which are not expressly amended herein, shall remain in full force and effect. b. All terms in this First Amendment that are capitalized, but not defined, shall have the meanings ascribed to those terms in City Secretary Contract Number 61622.
