FOURTH AMENDMENT TO
MASTER SERVICES AGREEMENT (CSC# 61043)
This Fourth Amendment to Master Services Agreement ("Fourth Amendment") is made
between the City of Fort Worth ("Fort Worth") and Event Facilities Fort Worth, Inc. ("EFFW").
WHEREAS, Fort Worth and EFFW entered into a Master Services Agreement identified
as Fort Worth City Secretary Contract No. 61043, which has been previously amended by First
Amendment to Master Services Agreement, Second Amendment to Master Services Agreement,
and Third Amendment to Master Services Agreement (collectively, the "Agreement"); and
WHEREAS, City Code of Ordinances, Part II, Chapter 7-1 Fort Worth Building
Administrative Code, Section 109.2.1, Exception 2 provides, "Work by non -City personnel on
property under the control of the City of Fort Worth shall be exempt from the permit fees only if
the work is for action under a contract that will be or has been approved by City Council with notes
in the contract packages stating the fee is waived"; and
WHEREAS, Projects undertaken by EFFW under the Agreement are within this exception
to Fort Worth's building permit fee requirements; and
WHEREAS, Fort Worth and EFFW desire to amend the Agreement to provide that no
building permit fees shall be charged for each Project under the Agreement.
NOW THEREFORE, for good and valuable consideration, Fort Worth and EFFW, acting
herein by and through their duly authorized representatives, agree to amend the Agreement as
follows:
1. Section 3 of the Agreement is hereby amended by adding the following sentence to
the end of the section:
"Upon the City's written approval of each Project, that Project shall be exempt from
all City building permit fees."
2. All other terms, provisions, conditions, covenants and recitals of the Agreement not
expressly amended herein shall remain in full force and effect.
