TARRANT COUNTY COLLEGE DISTRICT (TCCD) WILL: 1. Provide 10,000 contract hours to Fort Worth between June 1, 2026, and December 15, 2026. These hours can be used for any Fire/Rescue continuing education (CE) class or training event that Fort Worth allows personnel to attend. The CE courses can include but are not limited to, live fire training, special operations classes, state certification classes, etc. 2. Ensure that the maximum number of students registered for each section does not exceed seventy-five (75) students per session. 3. Provide a TCFP licensed coordinator of record for this course and ensure instructional quality control, i.e. The College reserves the right to approve/disapprove/remove the instructor. 4. Provide access and all utilities to TCCD facilities necessary to complete the training/scenarios. 5. Maintain permanent records of students' participation via a transcript made available to students upon request to the Registrar's Office. 6. Maintain authority of class instruction at the site. 7. Provide certificates of completion and/or certificates of participation upon successful completion of the course to the Training Officer. 8. Provide proper college orientation for instructors and students prior to the beginning of the program. 9. Provide a separate section of any state certification and/or special operations class as requested with at least a minimum enrollment of 10 students. 10. Provide an invoice for $10,000.00 upon commencement of training. FORT WORTH WILL: 1. Follow the current Fire/Rescue Training registration process for each class. There will be a maximum of 12 Fort Worth personnel in each regularly scheduled state certification or special operations class. 2. Can request a separate section of any state certification and/or special operations class with at least a minimum enrollment of 10 students. 3. Assure a maximum of seventy-five (75) students per session is not exceeded. 4. Provide oversight of student scheduling and attendance and maintain a spreadsheet of hours used. The spreadsheet will be audited monthly with Fire/Rescue Training records. OFFICIAL RECORD CITY SECRETARY FT. WORTH, TX 5. Ensure that all state certification examinations are conducted at the Fire/Rescue Training or any other regional testing facility. 6. Assure payment in the amount of $10,000.00 due upon receipt of the billing invoice. 7. Pay the current tuition price for any course once the 10,000-hour bank has been exhausted, as requested in writing by Fort Worth. GENERAL GUIDELINES: For TCCD to offer Continuing Education Units (CEUs) to the employees of Fort Worth the College must comply with its internal policies and regulations, the rules and guidelines of the Southern Association of Colleges and Schools Commission on Colleges, the Texas Higher Education Coordinating Board, and the State of Texas. In the matters of curriculum and instruction, the College must be able to demonstrate it is in sole and complete control of the curriculum, and the instructor with "sole and complete control" is defined to mean the College has the authority and right to establish, review, and modify, if appropriate, the curriculum, to approve/disapprove any instructor(s) and to cause an instructor to be removed from the teaching and learning environment, if appropriate. The signature of the undersigned indicates agreement with, and acceptance of, these requirements. 2. If classes must be canceled because of severe weather or other unforeseen circumstances, rescheduling will be made as soon as possible at a time mutually agreeable to both parties. 3. Modifications or termination of the above agreement will be made only upon agreement between Tarrant County College District and Fort Worth. 4. Fort Worth and TCCD agree that neither is the agent, servant, officer, and/or employee of the other and that nothing in this agreement creates grants or assigns rights or responsibilities to act as a joint venture, partnership, or agent one to the other. In addition: To the extent permitted by relevant Texas law, Fort Worth shall hold harmless, defend, and indemnify TCCD against any suits, liabilities, claims, demands, or damages, including but not limited to property damage, personal injuries, and attorneys' fees, arising from Fort Worth's acts or omissions. Notwithstanding the above, in no event will this provision be read as to require Fort Worth, and in no event will Fort Worth be required, to establish a sinking fund. TCCD shall hold harmless, defend, and indemnify, to the extent permitted by law, Fort Worth against any suits, liabilities, claims, demands, or damages, including but not limited to property damage, personal injuries, and attorneys' fees, arising from TCCD's acts or omissions. Nothing herein shall constitute a waiver of the immunities applicable to TCCD or Fort Worth. Fort Worth and TCCD agree that any liability or damage as stated above occurring during the performance of this agreement and caused by the joint or comparative negligence of Fort Worth, TCCD, their agents, servants, officers, and/or employees shall be determined in accordance with the Comparative Responsibility Laws of The State of Texas. Further, nothing in this Agreement waives any immunity, protection, right, limitation or cap on damages, as recognized in the Texas Tort Claims Act as to either of the parties or as to any third party. 5. Each party paying for the performance of governmental functions or services under this Agreement shall make those payments from current revenues available to the paying party.
