HomeMy WebLinkAbout061043-A6 - General - Contract - Event Facilities Fort Worth, Inc.CSC No. 61043-A6 SIXTH AMENDMENT TO MASTER SERVICES AGREEMENT (CSC# 61043) This Sixth Amendment to Master Services Agreement ("Sixth Amendment") is made between the City of Fort Worth ("Fort Worth") and Event Facilities Fort Worth, Inc. ("EFFW"). WHEREAS, Fort Worth and EFFW entered into a Master Services Agreement identified as Fort Worth City Secretary Contract No. 61043, which has been previously amended by First Amendment to Master Services Agreement, Second Amendment to Master Services Agreement, Third Amendment to Master Services Agreement, Fourth Amendment to Master Services Agreement, and Fifth Amendment to Master Services Agreement (collectively, the "Agreement"). WHEREAS, the parties agree to amend the scope of work of the Agreement to allow EFFW to design and construct certain improvements to the Burnett Building at the WRMC as described in Attachment A; and WHEREAS, the additional scope of work will increase the total value of the contract sum due EFFW in accordance with the Agreement, with the City reimbursing EFFW for the actual project costs, but with no additional management fee or compensation to EFFW for these services as reflected in Attachment B. NOW THEREFORE, for good and valuable consideration, Fort Worth and EFFW, acting herein by and through their duly authorized representatives, agree to amend the Agreement as follows: 1. The Agreement is hereby amended by adding the scope of work detailed on Attachment A, attached hereto, to Exhibit A of the Agreement. 2. The Agreement is hereby amended by adding the budget detailed on Attachment B, attached hereto, to Exhibit B of the Agreement. 3. All other terms, provisions, conditions, covenants and recitals of the Agreement not expressly amended herein shall remain in full force and effect. WORTH, TX Sixth Amendment to Master Services Agreement Page 2 of 6 ATTACHMENT A: Proiect Scope The Master Services Agreement, signed and enacted on April 2024, authorizes EFFW to provide planning, construction management, and procurement services to the City for approved capital projects at WRMC, with the City reimbursing EFFW for the actual project costs, but with no additional management fee or compensation to EFFW for these services in support of City Project Number 104397, Burnett Stalls Replacement. The Burnett Building at the Will Rogers Memorial Center was originally constructed in 1988. The building is approximately 175,400 square feet and is mostly comprised of horse stall areas. Cattle pens are located in the center of the facility. There are aisles and/or tunnels that connect directly to the Coliseum as well as to the Richardson -Bass Building. This building also contains veterinary and wash facilities for animals, a fire station, a small concession stand and a few administration offices as well as restrooms and several other support spaces As a result of the 2018 WRMC Facilities Assessment, major issues were discovered that include (but not limited to) the following: • current stall panels currently located in the Burnett Building, at the WRMC, are heavy, bulky, and pose a danger to employees with numerous movements throughout the year • the majority of the plumbing systems in the Burnett Building are original from when the building was constructed and requires major repair and replacement. • floors in the equestrian stall areas are heaving from constant use by horse traffic and are creating opportunities for liquids to pool instead of draining to floor drains. These pooling, low lying areas not only contribute to the degradation of the concrete and asphalt surfaces below, but are also a dangerous uneven surface for both pedestrians and animals. • power distribution is inadequate and does not meet the various stall configurations required for different events. This project will address the prementioned issues as well as the following: • the design and manufacturing of new lightweight, durable, and transportable stall panels to include power distribution cable protection; • repair and replace water and sanitary sewer lines and replacing fire risers valves and hose cabinets; • improves overall power distribution throughout the interior of the building to the end user by upgrading existing electrical equipment such as switchboard, transformers, and associated wiring; • replaces existing asphalt and concrete floors. Sixth Amendment to Master Services Agreement Page 3 of 6 -Additionally, this project updates accessibility standards as outlined in local, state, and federal guidelines. As a result, the City of Fort Worth contracted with Elements of Architecture to provide design services to address the aforementioned deficiencies and contracted with Sedalco Construction Services to execute the work. Through the process the WRMC staff in conjunction with the FWSSR staff and Equestrian user groups identified several other client and patron facing deficiencies that need to be addressed. As such EFFW, has agreed to address these deficiencies according to the prioritization and budgetary availability outline in Attachment B.
